Hi Dear, did your beneficiary required to have police clearance from Iran? My beneficiary is Living in Iran and I received NOA in February, 2022 but haven’t received anything from NVC

Hello, Rezvan got a police check (stating that she was never arrested), but she was never asked for it. I do not know if that is what you mean by police clearance. I agree with Rezvan that it is better to have the paperwork and not need it than to not have the paperwork and need it. Rezvan was well prepared, but they only asked for a few pieces of paper during her interview appointment. When you say NOA do you mean your NOA 2? This means that USCIS approved your case and has sent it to the NVC. If so, you probably will not hear from the NVC till the embassy your beneficiary is ready to schedule an interview appointment. I recently heard that the NVC timelines have gotten longer. Also, from my understanding the NVC runs another background check and coordinates with your guys' chosen embassy. Just so you know times also very from case to case. If you didn't know you can check you case status at https://ceac.state.gov/CEACStatTracker/Status.aspx . You use you USCIS case number until you are given an embassy case number. I believe that you want to select Nonimmigrant Visa (NIV) until you get your embassy case number. At that point they switch it to an Immigrant Visa (IV). Trust me, we know that the lack of communication can be maddening. Let me know if you have anymore questions and I will do my best to help. Steven P.S. Which embassy did you guys pick to do your interview at?

Thank you so much for the fast reply and great information. NOA 2 was received in February 2022. We picked the embassy in Baghdad, Iraq as the place of interview when filled the form I-129F, but later we found out that the embassy in Iraq is not processing any cases. I contacted NVC through public inquiry, they replied that they don’t have my case yet! When phone line was answered the nvc representative told that we need to first receive your case then changing the place of interview for you

That is odd. When is the last time you spoke with the NVC? Have you tried contacting USCIS? NOA2 means they have sent your packet out, but if the NVC has not received it there may be a problem with the delivery. I would try USCIS. If that does not work I would contact your local senators office. They have people in there office that can try and help with immigration issues.

Yes Just recently both NVC and USCIS and I contacted the congress office last week they submitted an inquiry to USCIS it takes up to 30 days for them to respond Thank you so much for the all avenues you recommending to contact 🙏

Hey @Mohadesa , Have you tried sending email to nvcresearch@state.gov? They usually reply in a few days. USCIS was initially telling us that they forwarded our case to NVC, but it turned out later that they didn't, so it's worth submitting a service request at USCIS service center where your case was approved for someone to go check if the case was indeed sent to NVC. That's what we did when we learned that they actually didn't send our case to NVC.
blank avatar Mohadesa on 2022-10-16 said:
Hi @Parisaa yes I did and anytime the replied that they don’t have the case! Finally our congress man last week got a response from them that they have received the case but a case number not being created yet

That’s good news @Mohadesa ! Same with our case, waiting for them to assign a case number to it. Hope the rest of the process moves smoothly.

did you receive your visa?
blank avatar Rezvan And Steven on 2023-01-03 said:
No. My fiancée was put into Administrative Processing because she is Iranian. She was missing no documentation at the interview. It has been over 4 months since her interview and the embassy gives you no way to contact them.

Hi my friend. Are you out of administrative processing yet? Also can you elaborate on if it was a lot of information you had to put on the DS 5355. We just had our interview 2 days ago and got hit with AP too and it’s dreadful
blank avatar Rezvan And Steven on 2023-05-15 said:
Hello Inveigh, Sorry for the late response, it has been a little busy here the last few weeks. Rezvan received an email on April 18th informing here that her Administrative Processing was over, and that the embassy was ready to issue her visa. After having to redo her medical exam, updating some of my tax information and turning in here passport, Rezvan was issued her visa. There were a lot of questions in the email (DS 5355), but it was mostly stuff that we had turned into USCIS or the embassy prior to Rezvan's interview. The AP process took us 233 days to get the email saying Rezvan's visa was approved. We were told that her visa had gotten stuck. I do not know if it helps at all, but we were told that the embassy tells you "no" in person and "yes" through email. This is a tough time and feels extremely unfair to people put into AP, but eventually you will get your approval. I hope you two have turned your DS 5355 back into the embassy. We turned ours back into the embassy the night it was sent to us. Let me know if you have any more questions and I will try to help out as much as I can. This time will pass, Rezvan entered the United States two weekends ago.

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
