Have you submitted your AOS and DS-261 yet?
We filed our I-130 on 01/08-2020 and received our Approval in May.
I also paid the fees for the AOS and the DS-261 at that time.
We didn’t submit the documentation for those yeah at the time because I was still visiting the Philippines and I would be heading back to the United States in June and I felt that I would take care of all that when I got back. But I ended up being stranded in the Philippines due to Covid for close to seven months.
Since I was stranded there, by August we decided we better start gathering the documents and fill out the forms. around the middle of August I submitted everything to the NVC. On August 24 we were notified that the DS-261 was Accepted, but my AOS was rejected because I used an expired form. They also said they needed copies of my two divorces.
We haven’t done anything for the past year because my wife is afraid when I submit everything again that she will get scheduled for an interview before I am able to get back to the Philippines.
And I see that you’ve been waiting for a while also.
Are you waiting for the same reasons?
I’m starting to get all the documentation ready now because I’m tired of waiting. Hopefully I can find a way to get back into the Philippines.
*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
** Not all cases are transfered
