Consulate Review: Juarez, Mexico
Review Topic: IR-1/CR-1 Visa
Event Description
Review Date : April 16, 2019
Embassy Review : I went to Juarez hoping that all was going to be ok and approved. I wasn't, the overall process was acceptable, I even liked Juarez, it has much better pavement then Reynosa. But I was declared inadmissible and was given the opportunity to apply for a waiver and that was all I was told. I guess we are not the first nor will be the last ones. I left the consulate really disappointed because we have been in this process since April 2017, but I guess, it is what it is.

Hope your interview goes well. We did ours last year, was very simple.

Thanks! we are going to Juarez by end February, hopefully will be updating the timeline by early March once we have It approved it. WE have been married for 3 years.

Sorry to hear about your outcome. You're definitely going to want to consult with a lawyer on that.

thank you Gavin68, we are now working on getting all the evidence to the lawyer to submit with the waiver. This has been so far one of the most traumatic experiences in my life. I don't even have parking tickets now it turns out we need an attorney to fix my legal immigration status. I am seriously concern. :(

If it was due to unlawful presence in the US, I believe there are waivers available. But its imperative to use a lawyer to navigate the complexities of the US immigration system. It's not easy and you should seek professional help, but I am sure it will work out for you. Good luck.

Sorry to hear about the outcome of your visa interview. Any idea what may have been the problem? Which waiver are you applying for? Wishing you the best of luck.

Belinda, What happened??? I thought you were a sure thing to get the visa. I don't know how they found you to be inadmissible since you always come to the USA with a visa. You two also lived apart all this time....I am so sorry to hear this.....
James Belinda on 2019-04-22 said:
thank you for all your comments, yes, we are working with a Lawyer now to issue the waiver in the correct way.

Gavin68 I never crossed illegally not misuse my tourist visa, but the Consular officer lady didn't ask me for any evidence, all she gave was a blue sheet with a INA code and that's all.
James Belinda on 2019-04-22 said:
Trac3rt the consular officer said that I said to her that under oat that I did intended to live in USA with my tourist visa when I didn't say that to her, she asked me all in a not so clear Spanish and when I tried to speak in English she responded to me no so clear Spanish. and now, that "misunderstanding on her end" is costing us 4 thousand dollars(waiver+ lawyer fees) and more time in waiting.

Wait I’m not understanding, if you were applying for an ir1 or a cr1 visa of course you were intending on living in the United States. A waiver is to ask for a pardon but be pardoned from what?

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
