Embassy Review : I have overstayed my visa for more than 5 years. My husband petitioned me a month after we got married, he was an LPR then. After he got his citizenship last year, we immediately sent the forms i-485, i-765, approved i-130 (our lawyer upgraded this to ‘spouse of US citizen’).
Okay so we had our AOS interview yesterday in Newark. Our appointment is for 2:30 pm. I’ve read some things that having an afternoon appointment is not a good sign, well they couldn’t be more wrong in my case. My husband and my 5 year old daughter were with me.
We parked in a parking lot just across the building, around 1-2 min. walk. We entered the building and went through security inspection. We then went up to the 13th floor (via elevator, of course). There was a female security guard who asked for my appointment letter and id’s from both me and my husband. We entered the waiting room, I honestly expected it to be jampacked, but the amount of people was fair. I then handed my appointment letter to a woman by window 1, she asked “Are you waiting for your lawyer?”, I said “Yes.” She handed the letter back to me and said kindly “Give this back to me when your lawyer is here.” So of course I thanked her. It was around 1:45pm-2pm when we arrived in the waiting room. A few minutes later, our lawyer arrived and she was the one who handed out the appointment letter to the woman in window 1. After 15-20 minutes later, my name was finally called by a male officer probably in his late 30’s. I can’t say what his race was, I am pretty sure that he is not black or asian. He might be European/ middle eastern mixed with Caucasian. Really couldn’t tell, Lol javascript:emoticon('')! Anyway, at the moment, you could probably imagine how nervous I was, it was like my heart was going to explode from beating so fast. My husband wasn’t nervous at all, good for him. There was actually an awkward moment when he thought that my lawyer was me! I guess that’s a compliment. Lol!
So then he told us to follow him into his cubicle. There was his desk that was facing the open part of the cubicle, on his left was a filing cabinet, on the front were 2 chairs for me and my husband (my daughter sat beside me) and the left corner across his table was a chair for the lawyer. I remained standing but my husband sat right away (not a surprise for me,javascript:emoticon('')). Our IO told him to stand up to do the oath, and of course we said “I do.” Then we sat.
He then asked for,
ME:
-passport (my i-94 was inside)
-birth certificate
-OUR marriage certificate
MY HUSBAND:
-proof of citizenship
Now the questions.
IO ( to me): So your address is so and so?

IO: Did you file for a Change of Address?
Me: Yes. (Our lawyer then handed out a proof that we filed for a Change of Address)
IO (to my husband): You became a US citizen in 2010?
Husband: Yes.
IO( to me): Are your family and relatives here or in your country?
Me: My immediate family is in the country that I grew up in, but I have some relatives here.
IO: Okay.
IO: Your last entry was on 20XX, is that correct?
Me: Yes.
IO: Was that your first entry in the US?
Me: No.
IO: When was your first entry?
Me: I do not remember, all I know is that me and my family have been having vacations here in the us since I was a baby.
IO: How long was your longest stay?
Me: Around a month. (I told a story why we stayed that long here, I just realized after that that it was unnecessary, but oh well, I still got approved.)
He now asked me the yes/ no questions from the form I-485, of course I said No to all of it. Then after that, he said (putting his hands together) “Your card should arrive in the mail within 4 weeks.” I just went numb. I asked “Am I approved?”. He said, “Yes.” I joked “Can I give you a hug?” Then everyone laughed including the IO, he just said “You should hug him (pointing at my husband), he did this.” That was pretty much it. I was honestly holding back my tears at that point. As we walked out of the cubicle, I hugged and thanked my lawyer and my husband too. It was easier and faster than I thought it would be. We were over prepared, but that’s better than not having what the IO wants. My countless prayers were answered and couldn’t be more thankful to God. I hope and pray that all of the deserving couples will have their interview just like ours.
