Hello there, I see you filed you AOS after the 90 days. I am about to do that as well (got married the 90 days.) Do you think it is okay to have filed after the I-94 has ended?

Hello, Mmsamor! So... My I-94 expired on Aug 11 and I filed everything on the 8th. I got a text on the 26th with my receipt number and they said my NOA was coming through mail, probably by next week (I'm guessing). However, I also searched if it was possible to filed them with a I-94 expired, and apparently you can only if you got married within the 90 days, but you need to attach another form and pay a $1000 fee because you would be out of status. Not sure where I read this, maybe it was on the form i-458 instructions because I know they asked if you are out of status. I'll see if I can find something on my notes.

Thanks for getting back to me. That would really suck for me- Our 90 days is up 9/4 and we still have to translate the birth certificate and do the medical exam. Did you do the medical exam- do we need to since we just had one?

I see. The translation of the birth certificate was a problem for us too! No, I didn't have a medical exam here because I had one in Brazil. If you had one before, the doctor probably gave you a folder with your vaccination record (in English), and the results of the exams (in your native language). You just need to send a copy of the vaccination record (keep the original) with the form, and take the originals to the interview.

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
