Review Topic: IR-1/CR-1 Visa

May 2nd went to his interview appointment. He arrived at 7:15 and his appt. was at 7:45am. They let him in at 8:15, first a lady took all the missing paperwork, asked a few questions and told him to wait for his interview with the Counsel. He waited for about 40 mins until they were ready to interview him. The Counsel was very nice and pleasant, he asked a few simple questions like have you ever been to the US? Why do you want to go to the US?, where does your wife live?, whats her mother and fathers names?, Have you ever been to the West Bank?, When was the last time you saw your wife?, What do you plan to do for a living when in the US? He then took his passport said congrats and said that his passport will be returned to him with 10-14 days. Overall it was a simple and quick process. Good luck to all!!

At the time of his departure, My husband was unlawfully present in the United States for more than 180 days, but less than 1 year (from November 6, 2007 to September 11, 2008 – the date of the issuance of the NTA). INA §212(a)(9)(B)(i) states, in part:

“Any alien […] who-- §212(a)(9)(B)(i)(I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States prior to the commencement of proceedings […] and again seeks admission within 3 years of the date of such alien's departure or removal […] is inadmissible.” Italics added.

Since My husband voluntarily departed the United States after the commencement of his removal proceedings, he is not subject to the inadmissibility criteria as outlined in INA §212(a)(9)(B)(i)(I) or INA §212(a)(9)(B)(i)(II) or any other relevant section of INA §212(a),
which would make him admissible to the United States at the present time.

I HAVE BEING TRYING TO EXPLAIN TO YOU THE STATUS OF MY HUSBAND BUT IT SEEN THAT WE ARE NOT GETTING ANYWHERE SO MY LAST RESOURCE IS TO SPENT MORE MONEY CONTACTING A LAWYER TO HELP ME.

IAM VERY SAD AND DESAPOINTED WITH YOUR DECISION. I DONT UNDERSTAND WHY IF YOU KNOW THIS DECISION DO NOT APPLY TO HIS CASE.

Carefully review this information again please we have suffered for about almost three years and hope to end this with a happy end. I explain everything the best I could but i guess it was not good enough for your office. I would have an
attorney explain to you everything again with all the legal terms.
please have compasion on us
our life away from each other have being very dificult. please give us the opportunity to be happy. please i bet you.

We appreciate your bringing the specific details of your husband case to our attention. Presently we are reviewing your husband current ineligibility under INA §212(a)(9)(B)(i). To help us with this review, we require documentation regarding the voluntary departure you mention in your email, specifically the fact that attended all removal proceedings. When these documents are received we will review them and, if necessary, seek an Advisory Opinion from Washington, D.C. in the matter; the duration of such reviews is unpredictable.
Further, in response to the facts provided to us in your email, we are also investigating possible additional ineligibilities to which may be subject. Specifically, under INA §212(a)(6)(B) for Failure to Attend a Removal Proceeding. Should be found ineligible under this provision of U.S. Immigration Law, the ineligibility runs for five (5) years, and no waiver is available.

do anyone have any idea of what could i do next....wow i being trying but they are trying to make me give up. and yes the second code the put it do not apply my husband was in custody until he was given voluntary departure and was put on a plain by the officers with a ticket purchase by us.

Got there really early, 7:30 so didn't wait too long. You sit in a waiting room that has the windows that you get called up to, first you get called and you hand in all the paperwork and forms, then I sat for another half hour and was called for the interview, it was short and friendly and on the spot was told that within a couple of hours after my fingerprints will be verified (given I don't have a crazy criminal past) the visa will be officially approved.
all in all, it was a good experience.

I had my interview last Friday (July 16th 2010). It was scheduled for 8:30am. I arrived at 7:45am and after a short wait outside the building was directed upstairs to the waiting room. I waited about forty five minutes before I was called to one of the 'booths' where I was asked to submit all my medical files. I was also told that my photo was not acceptable as my bangs were slightly covering my forehead so I needed to bring them another photo before they could process the visa. They confirmed they had recieved all the other necessary documents and sent me back to the waiting room to wait until I was called for my interview. I waited about twenty five minutes to be called up again, and was called back to a different booth for my interview. I didn't expect the interviews to take place the way they did, with four other people lined up in booths next to me, all answering questions like I was, through the glass, straining to hear. It was very confusing as you can hear what everyone else is being asked/answering. The interview itself was the shortest part of the whole ordeal. I was interviewed by a really nice woman. She asked basic questions:
- where we met
- how we met
- how long after the first time we met did we see each other again
- what was my longest stay in the US
- she mentioned his parent's names and asked who they were
- what was my husband studying
- why we were moving to the US
- where we got married
- who was at our wedding

As far as I can recall that was about it, she handed most of the forms back to me and almost as an afterthought asked to see some pictures of us. She singled out a few and asked me where they were taken. Satisfied, she took my passport and told me to go and take a new photo and bring it back as soon as possible as it was the only thing delaying my application. Then she gave me an estimate of two weeks for the visa to be ready.

It took a long time to get to the interview itself but it was the quickest and most painless part of the whole process so far. Good luck!

My fiance had her interview today and since I wasn't present I will relay what she told me. She got their at 8:20 AM for her 8:30 AM appointment. She had to bring our 1 year old daughter with her to the interview, but once there they would not allow her to bring the baby stroller in, strike 1. She then told me the first CO she talked with was a very nice young man who gathered all the paperwork they would need from her, he also noticed that our daughter was starting to get really unhappy and put her application at the top of the pile so she could go first., got the strike back. The next time they called her up she met with a woman whom she said was not very nice at all. She asked her questions about how we met. How did we prove that my daughter was mine, which was stupid because on my last trip there I registered her as a US citizen born abroad which was a pain in the rear in and of itself. Needless to say I had to do a DNA test to prove to the US and Israeli governments that she was indeed my child. She then double and triple checked the paperwork for that again! She also asked about any plans we had for the wedding and what she planned to do for work once she got to the states. She then took her passport and told her she "qualified" for the visa. My fiance asked her if that meant she was approved she said yes. Overall it took 20 minutes for the interview and I guess wasn't to bad.
