Review Topic: K1 Visa

My fiancee and I got to the consulate around 7:00 am. There were about four people ahead of us. They started letting people in around 7:30 checking off names from a list to make sure they had their appointment that day. Once in, we passed throug a security check point and were directed to the second floor where the K1 visa interviews take place.

Once upstairs, there are three steps to the visa interview process.

1) First a lady calls the applicants by order of arrival to ensure that they have all the required documents and that they are place in the correct order. She was friendly and informative. The major issue people had at that point was that they had the wrong police certificates. That is, that they had requested it from the justice department and it was supposed to be from the police department. In our case, we had the right one from the secretaria de seguranca publica. Once the lady reviewed and put all the documents in order, you'll wait to see another consular officer.

2) They call you to a booth and a second consular officer further reviews the documents you have provided. He asks some questions. In my case he asked if I had been to the States in the past and if I had applied for visa before. He only kept some copies of documents and returned the originals. He then put the documents he kept and the forms together with the package they received from USCIS. He said the everything was OK and to wait outside for the cosul to see us. He was polite but very serious.

3) The last step was to see the consul. We were called second to see the consul even thought we were 4th on line because the other people ahead of us were missing documents. Once we got in to see the consul, the interview was not long. He asked me how we met? If I had been to the States before? What countries had I traveled? Then he turned to my fiancee and asked her how did we meet and to tell him our relationship story. After that he said it seems like everything is OK and your visa has been approved. He never ask to see any prove of relationship. He was extremely serious.

As expected the visa was denied due to her overstay of her visa past the age of 18. Thankfully she is eligable for the waiver and we got all our paper work almost done for the interview on the 10th of december. We still got a lot more waiting but we are confident and happy that another step is being taken. The interview was very short (once again as expected) and straight foward. the officer was polite but firm. Towards the end of the interview we received some positive feedback from the officer which made us a little less sad. For all of those waiting for the interview my only piece of advice is reasearch as much as possible so you'll be prepare for whatever happens, as we were.

We arrived at the Consulate around 6:30am. Our appointment was at 7:45 am as were all the other K1 visa applicnts. We were he first in line then one guard told us we were in the wrong line only to find out later that it indeed was the correct line. After getting back in the correct line only to be about 11th in line now. We were aloud to go through security check 5 at a time. Once through the security check we had to go up to the second floor by stairs. That was a little difficult with a baby stroller. Once inside we had to fill out form DS-230 part 1. Word to the wise for anyone that files any K visas you have to have this form. It is available at the consulate. We were called up to the desk and the lady there checked our paperwork and gave us back anything they did not need. That is where we found out that the State police record my fiance got was not the right one. Next we went to window #1 and the gentleman there looked through the paperwork and stated that we were missing the state police record. He said the consulate would let us know what to do. Once the consulate started seeing people we were the third to be seen because we had the baby with us. Once inside this tiny cublicle he asked a few questions.
1. Asked Wellington who I was to him
2. Asked me my name
3. Asked us if we have ever been married
4. Asked me if I lived in Brazil and when did I get there
5. Asked us to raise our right hand and swear to tell the truth
6. Asked me if I have ever been married (second time)
7. Asked me where do I live and with whom
8. Asked me if I have ever been married (third time)
9. Asked Wellington if he had ever been married (second time)
10. Asked who the baby was
11. Asked me what I do for a living
12. Asked Wellington how long he was detained for
13. Asked Wellington if he had ever been married (third time)
14. Asked me if I had ever been married (fourth time)
15. Asked me to show proof of relationship (started showing him pictures of Camila's birth and our first trip to Brazil)
16. Asked me who;s first trip to Brazil
He then asked me to leave the cubicle so that he could speak to Wellington
17. Asked him how we met
18. Asked him if he worked in the US
19. Asked him if he had ever been married (fourth time)
20. Asked him how he came to US the first time
21. Asked him how he was detained and when was he deported
After all the questions he was told that he would be refused the visa at this time, but he is eligible to file the I-601 waiver. Also before he can schedule the interview for the waiver he has to get the correct state police report and he also has to get the Certificado de reservista. It was another 10-15 minutes and we were called to window #2 where the nice lady gave us the paperwork and all the information we needed. She told us good luck and we were on our way. We were finished at the Consulate around 11:30 or 11:45 and we were back at the hotel by 12pm. All in all it is a long time at the Consulate but it goes by pretty fast with all the people there you can talk to. They have a place in the back were there are lots of toys and books to keep the children busy.

Went to my interview and got my visa approved. I waited there for many hours and the Consul was not exactly pleasant, but it was all fine. They never looked at any evidence that I brought with me, just required documents and many questions.

Don~t plan a trip to a date close to the interview date. This Consulate has been taking 7-10 days to deliver the visa to applicant~s house and you don~t have an option to go pick it up directly with them.

Vera was approved this AM! Officer was straight to the point. He asked the same questions more than once, just rephrased them. He never asked to see relationship proof, she offered to show him but he refused. :P She waited about 4 hours for interview.
