  1. Last Thursday, I received an email re: expedite request for 765, they wanted me to fax proof/documents supporting my request. I faxed everything last Monday morning.  Then Tuesday the next morning, I received an update for my 485, RFE was sent.  Then I received a text and email regarding request to speak with a Tier 2 officer(requested this 2 weeks ago).  It says in the text and email that the officer will call in 1-2 business days. Today is the 2nd business day, What I got earlier this morning is an email, from what I understand, that the reason I want to speak with a Tier 2 officer can be answered in their website.  Still waiting for the RFE in the mail, hopefully tom or on Saturday we'll get it.

My wife tried to have an early Biometrics at our local USCIS office here in Las Vegas. Due to backlog from last year, they are not accepting early walk-ins even if you have a valid excuse that you won't be able to make it on the date that was given to you. But they can accommodate you anytime after your appointment date.  So I guess we'll just wait out our original appointment date! Good Day everyone!!!

  8. Our Packet is just a day apart received by the lockbox, that's why I'm really worried since last Wed.

I'm wondering now if it has something to do with our kids' CRBA. Both are USCs already from the US embassy in Manila.  I even remember the IO asking why we didn't apply her gc with the crba application of the kids, during that time we didn't have plans yet of moving back yet.  Hopefully they are just waiting for docs from the US embassy and didn't misplace our packet.

2/4/2022 Mailed packet (I-485, I-765, and I-130) to Phoenix lockbox

2/10/2022 USCIS charged my credit card

2/11/2022 Text message with official receipt notice for all 3 applications

    Currently waiting on NOA1

Okay, I really think I should be at least a little worried now with my timeline. Same lockbox, packet delivered Feb 9.... and still no update.

I was able to talk to an agent yesterday from the USCIS, to ask for update, the agent was very accommodating. Unfortunately, it was just our online I-130 that's popping in their system.  Still nothing with the packet sent to Arizona.  Agent said she'll give the Arizona lockbox office a call and I'll just wait for an email. And at the same time she gave the email address of the lockbox, so I can follow up with them also directly.  I emailed them just this morning.  Not expecting any email or update from them not until Tuesday.  Crossing my fingers for next week! have a great weekend everyone!

  10. Thanks Sarge, for initializing this topic for FEB 2022 AOS filers:

Based on your username I'm going to assume you're in San Francisco. Here are the published processing times. The pandemic definitely slowed things down, but some field offices are definitely more backlogged than others.

Note that if you move, your field office may change. USCIS may also choose to randomly move your I-765 to a different service center:

    Source: https://egov.uscis.gov/processing-times/

I-485 (Family-based adjustment applications) at SF field office: Estimated time range: 12.5 Months to 31.5 Months
I-765 (Based on a pending I-485 adjustment application [(c)(9)]) at National Benefits Center: 8.5 Months to 9.5 Months

Thanks for the timeline updates. I used to live in SF, but residing permanently here in Las Vegas.

As others have stated, I-130 and I-485, along with the required documents for each.  Your choice in submitting the I-130 first online and wait for the receipt number, or submit all at the same time.  There is a part on the I-130 where it asks if you will be found consular processing or adjusting status - select the latter.

The I-485 may take up to 2 yrs for approval.  Your wife cannot leave the US until it is approved and cannot work nor get a SSN, unless she applies for AP and EAD, respectively.

    I-765 ( EAD) and I-131 (AP) takes 6-9 months.

Thank you so much for the additional info. Yes, would definitely add the I-765 if the timeline for the I-485 will take 2 years at least.  Is it because of the pandemic? Because before it only took 6mos for I-485 including the interview and 3-4mos for the I-765.

What was the intent of this trip to the US?  Was it to visit or to live here permanently?

If the latter, what did you or your wife state to CBP when asked the purpose of the visit?

I'm a pilot based in the PH, as a family we visit the US at least once or twice a year, except for last year. So no questions asked when we arrived, just a "Welcome Back" gesture by the IO. I always book our tickets good for at least a couple of mos.

***Moved to the forum Adjustment of Status from Work, Student and Tourist Visas, as OP's wife is adjusting from a tourist visa***

You will file I-130 together with I-485.

Note that I-485 requires I-864 as supporting documentation.

You can also choose to file I-131 and I-765 so your wife can work and travel internationally while you wait for the green card to be approved.

Search this forum for examples of others in similar situations.

    Good luck!

Thanks for putting it on the right forum, appreciate it.  Will definitely look through the 3 initial forms you stated. Thanks again!
