  1. JoyDee:

Let me say this: the USCIS are indeed preferentially giving priorities to the illegal haitian immigrants already living in the USA, versus legitimate needs of US citizens who needs to bring their loved ones in. What we are complaining here is that they put the first priority on processing TPS versus K-1/K-3 cases. That is wrong.

In your case. You are NOT a TPS case. You are a K-1 case just like the rest of us are: US citizens trying to bring a loved fiance/fiancee in. You are on the same boat. Actually consider the special circumstance of that country your fiancee comes from, we might agree that you can get a little bit priority over the rest of us K-1 petitioners.

But please don't for a moment have the illusion that your K-1 case is given a priority consideration just because you received that email from USCIS. I am pretty sure that email actually means NOTHING pertaining to your case. I can bet, your K-1 file is just sitting in that box with the rest of the K-1 files, collecting dust, waiting ... waiting ... waiting, while they put priority in processing the TPS cases first. You are not getting a single day ahead of the rest of us K-1 filers. If you do I will be surprised and I will be happy for you. How long have you been waiting? When did you get that email? If they really mean to have pulled your file off that box and processed it expeditely you would have gotten your approval by now, because it really only takes 20 minutes to adjudicate a case once it was pulled off a box.

Again sadly they put priorities of illegal immigrants over US citizens.

I'm waiting like the rest of you, and I'm not frothing at the mouth over wait times. I knew how long it would take when I sent my application out, and now I wait and see how long it takes to go through. Other Haitian cases on VJ have gone through in two-three months which is an expedite from the standard six months wait time. I'll take whatever I can get.

  2. Non-citizens do not apply for K-1s, CR/IR1s, the citizen does, the non-citizen doesn't even really matter until USCIS approves of the petition.

Last time I checked, TPS is NOT done by citizens. Clearly you need need to actually read what each petition requires on the USCIS site before you make a blanket statement. Furthermore, the posted link goes into great detail how the administration begun to cater to the needs of non-citizens, specifically, Haitians, asap. Also there was a link posted here a month or so ago where reporters found out that illegals in the U.S. from Haiti were given TPS visas (about 130,000 illegals).

I don't even need to engage you anymore. You proved your mentality several months ago on the forums in regards to your petition.

"Charity begins in the home", U.S. government would be better off if they followed that saying.

WE ARE A NATION OF IMMIGRANTS. The department of UNITED STATES CITIZENSHIP AND IMMIGRATION deals with IMMIGRANTS.

I am glad to know that my application was prioritized. If you have problems with that, take it up with Napolitano.

No country in the entire world, other than the U.S., would remotely consider ignoring the needs of its own citizens to help foreigners.

And here is that e-mail, which apparently was not meant by USCIS to be seen by non-Haitian eyes, on a public messaging board, so the world can now see how USCIS screws its own citizens:

12-13-2010 Response via email, all VISAs from Haiti are expedited

"VSC has pulled all Haitian National pending petitions (including petitions that were returned from an American Consulate or American Embassy) for adjudicative review. These cases have been prioritized and are currently being adjudicated in an expeditious manner."

Right, they treated me well. I am a US citizen with a loved one in Haiti. This email was in response to my request as a US CITIZEN for an expedite for my fiance.

  3. Well, that confirms the "speculation" by numerous members here about USCIS prioritizing non-citizens over citizens. Though, only one to blame for this is Napolitano, not those working at USCIS.

Interesting read though and i hope their request for a budget increase makes them more efficent in processing applications.

What you said makes no sense. How do you figure they are prioritizing non-citizens? Of course they are prioritizing non-citizens, that's who applies for immigration. Additionally, every petition has both a citizen and a non-citizen attached to it; that's the point of family-based immigration, including adoption.

  4. When I was in grad school, I was a TA. If you have the chance to do a TA'ship, then there is a good chance that your pay (even part time) will be higher than the minimum for a household of two.

Yes, it depends what kind of grad program you are applying for. If it is a Phd you are more likely to get paid, a MA, not likely. Also, if you start school in the fall you won't have a full year of pay for the tax return.

  5. Because it would be unfair to those who could not afford it. This isn't one of those situations in life where you can throw more money at it to make it better. Everyone pays the same amount, everyone receives the same service.

This is competitive capitalist America we are talking about here, not a socialist or a communist state. I'm surprised they haven't already implemented a fee scale just to make some more money off of us considering the level of the federal deficit.

  6. Having said that, too much knowledge is still a disadvantage of open internet forums. In an ideal future, we would have a system where you could access all the information and discussion you needed, but were not needlessly exposed to horror stories until after you had completed the immigration journey. So, you could say "I have never even touched anything remotely criminal" and you would then never have to read about denials and waivers relating to criminal stuff. Personally, I could deal with everything immigration related in a rational and calm manner but visiting the US whilst waiting for my visa caused me many sleepness nights. I would've liked to have known what evidence to carry with me when flying, and also seen the statistics of other people's experience visiting for various periods of time, but not had to read about anything else.

I absolutely know more about defrauding the system after visiting this site, and how seemingly benign activities can be interpreted as fraudulent. I am also significantly more terrified than I was previously, and I can assure you, that's not useful.

  7. Hi everyone,

Happy holidays to all Visa journeyers.

But my fiancee has some doubts if he need to include his original passport and Naturalized US Citizenship original papers? ( He is Canadian Citizen by blood ) as these papers are very important to him in his stay at the US.

    tess129

They would not bring his citizenship status into question at the interview. That should have been handled by USCIS. I can think of no reason for him to send you his passport and original naturalization documents. Photocopies should suffice.

  8. I'm getting married tomorrow, and as the subject suggests, I'm pregnant (6 weeks). Do I qualify for medicaid? I know I can apply for food stamps, but not welfare. What about medicaid? I am going to be going to the doctors for the I693 form, so I guess when they do the checkup, they will take a blood test and everything. Is there any insurance I can apply for, so I can give birth down here? If not, should I travel (with permission) to Canada a month before the baby is due and wait till it's born?

Thanks everyone. I want to make the best out of this situation!

I'm not 100 percent sure on this, but Medicaid is generally run by each state, not the federal govt. What state do you live in? Some states have much better programs for women and children than others. Of course, each state will have different reqs for who qualifies as well. If you are in the US, you can ask at the doctor's office or hospital about these programs. they generally have case workers there to deal with insurance and lack of insurance issues.

  9. All expenses including but not limited to her visa expenses, airline return tickets and cost to come to the United State, US domestic travel, lodging, boarding, food, incidental expenses and medical insurance.

Sounds like he was pretty thorough. Why would that be a problem?

  10. Hello everyone,

How's it going? I have a question for those who had sent in their original petitions with success and no RFE's on how the petition was put together. USCIS recommends the we use ACCO fasteners; I was wondering what size are the correct ones? What are the dimensions? Does anyone have a link to the exact ones because I don't even know what they look like? I sort of have a little idea, but not completely sure. Also do I put the whole petition documents together in one bunch on one fastener or do I separate them in sections? I wish USCIS wasn't so picky, but that's just the way it is. Can't change a bureaucracy, but the bureaucracy will change you. It's sounds like this ACCO company has been favored by USCIS or they are connected, either way this probably keeps them in business. Like the military and Haliburton. LOL. Since the amount of petitions is skyrocketing, it might be a good idea to buy stock in ACCO. Your advice and help will be much appreciated. Thanks.

    Mike

I just used staplers and binder clips. (Sending it with/without ACCO fasteners should be uncorrelated with RFEs)

  11. maybe it's because you stated that your parents did'nt approve the relationship. i've heard they can deny you a visa if the OP'S parents or children disapprove the relationship. they believe this may pose a problem to the relationship and the marriage will not last

That sounds preposterous! I can see if someone calls the consulate and says you are getting married just for US entry, which would be the best way for a(n evil) family member to go. Saying that your parents disapprove (who knows why you'd even consider saying that) should have no bearing on the legitimacy of the relationship or the intention to marry. Here's where its better to keep your mouth shut, both at the interview and around the watering can.

This article again makes me feel like I'm dealing with the Gestapo. Very much appreciate the Kafka-esque nature of the whole thing. Are there real people in there? Can we be human beings with human failings instead of paperwork that gets rejected because of a typo? sheesh. i'm turning into a giant insect over here thinking about it.

  12. My husbands CR1 was appoved at nvc on dec 8, 2010, it hase been forwarded to haiti and I am waiting on an appointment date. When contacting the NVC they state they don't know when appointment will be scheduled but is CR1 and K1 being expedited for all Haitian petitions

looking at your timeline, you definitely got NOA2 faster than most. I don't know what happens btwn NVC and interview, so please keep us posted! I'm not sure if you have to ask again for expedite at NVC stage, maybe someone else knows?

  13. Thanks to all for your advisement.

Atpeace, you said that package 3 will tell me what they need. The petitioner sends that back to NVC, yes? If they need it they can have it. Otherwise it just doesn't seem wise to have originals floating around in a country where plenty of people would love to get their hands on a US birth cert.

Off I go.. have a great holiday everyone!

  14. Did you list his name next to the local number on rebtel, if you list a nickname, update it to his legal name. You can print out the detail page that shows his international number attached to his local number.

Done. That's a relief. Sometimes it's hard not to imagine that we're dealing with the Gestapo. Especially when we have to expose and have proof of evidence of our most private relationships.

I'll just stop worrying now, cross my t's, and hope for the best.

  15. Scan any doc's he may not have and send them via e-mail attachment. Give NVC your email address to send everything to, and then you forward it to him. I used rebtel for phone calls, and that was easy for us. You will need to show phone communication, so he will need copies of this information as well. He should have the last 3 months up to the interview date.

We use rebtel too! I was worried about that because it doesnt give numbers, just whatever you put in when you set it up. I was thinking that i'd send my cell phone bill too but it calls local numbers to connect; I don't even really know how remote calling works let alone explaining it to immigration.

  16. He will not need orginals, so copies will be okay. If you don't want your SS number visible to everyone, on the copies black themout. Is Mail not going in and out of Haitia, I am in contact with a friend of mines via the internet, so I know the internet cafes are working.

    Thanks Atpeace,

Internet is up and running! The internet cafe's usually have generators b.c state electricity is only up for about 4 hrs a day. But there's no mail, hasn't been for years. Good call about the SS#s.

    Thank you!

  17. In going thru this process you should have made 3 copies of everything you have sent to USCIS and NVC, one copy for you, one copy for your finance and a copy for file. You can not predict what may have gotten loss in transferring the case from one agency to another. Think of this process as a business transaction.

    Hi Atpeace,

I did make copies of everything. I want to hang on to originals in case i get an RFE from USCIS. But the consulate info says they always want the originals. I'm wondering if its okay if they get copies at the consulate. By the time my NOA2 comes through there will be no way to get the originals to future hubby.

  18. Question: Does all the info that the petitioner sends back to NVC end up at the interview? I ask because it is impossible for me to get documents to and from my fiance.

For instance, If I submit the tax information in what I send to the NVC does he have to also bring a copy of this to the interview? (I could email him copies of everything, but they either won't be signed or they will be scanned non-originals)

Also of concern, the original evidence of our relationship which I have in my possession. Does he need to get this or will what I submitted with the I-129f be attached to the whole dossier that gets sent to the consulate?

I'm not near the NVC phase but I'm going to be seeing him next week and I want to make sure that we both have everything we need because after that the next time will be when he gets here (hopefully!).

  20. it seems like it is a competition to you, youre most certainly not the first one with a partner in a third world country or disastrous situation, but you sure act like it.

to be honest you seem ungrateful,a couple from Sudan were just recently denied their expedite just because the reason wasnt humanitarian enough for USCIS can you imagine?a war is not disastrous enough.like you mentioned its not a competition but you need to realize how annoying it is to see people like you, getting special treatment and just wanting more.

call your congressman all you want, youre within the timeline and therefor VSC has no obligation to proceed the inquiry your congressman makes on your behalf, good luck with the rest of your time waiting.

To be honest, that's what the Congressman is there for. He or she is the intermediary between me and my government. That's why I vote and elect these people to speak on my behalf. Its the political process, and yes, I will take advantage of it, unapologetically.
