I'm not sure what the answers are to your other questions but I would just like to comment on this part of your post...
we have a 3 yrs old boy who had a skin test last sept 2008. He is my petitioner son but his not USC yet since he got born in my place when his father is not a USC yet. And we are applying for his USC together with my AOSI hope you are saying that you are applying for a green card (form I-485) for your son and not the N400 (application for naturalization) nor N600 (application for certificate of citizenship). Since your son was born before your husband became a USC, he has to be legally admitted as an immigrant (get a green card) before he can automatically gain citizenship by virtue of one of his parents being a USC.

It won't matter even if you file separately as long as you show your status as MARRIED in your tax filing.

They usually put you in queue for interview schedule only after the name/finger print checks are completed. So, I guess in a way the interview schedule is dependent on biometrics as the check can only be done after finger prints are taken.

As to your evidence for the I-751, I suggest that you request 2 years tax transcript (2006 and 2007) from IRS. It's free and you usually get them in 2 weeks (or less). Check here on how to make the request.

I've seen other couples with similar living arrangements as you and your wife and they didn't have any problem removing conditions. What's important is you continue to keep documentation that your marriage is still valid and viable in the event that you are called for interview and asked for additional documentary evidence.

Be sure to look nice if you want to have your digital picture come out good. They will put that digital picture on your EAD and your GC.

Don't forget to include a copy of the NOA for the I-130 that you have already submitted. This will enable the USCIS to "attach" your I-130 and AOS files for concurrent processing.

I agree with LaL that you will need to consult with a good immigration lawyer. One of the things you will have to consider is whether you have already incurred any overstay that will make you subject to a ban for re-entry into the US.

Try to file first the AP (advance Parole) and EAD before filing your AOS. I think there's no payment for it only the AOS. you can have it for a month or more for approval. Mine i have 72 days both AP and EAD after filing. you can travel to the Philippines using your AP.
I'm sorry but it's not possible for the OP to file EAD first without filing the AOS. OP came in on a K1. As such, she can only apply for AP and EAD together with or immediately after filing the AOS.
Like most people here, I would suggest you file your AOS with the AP and EAD. But if you really think that it's a better decision, financially, to go back to the Philippines and have the baby there, then I would suggest you do so before you reach 180 days after expiration of your I-94. True that bans (3 or 10 yr) are waivable but your husband will have to prove that it will be a hardship for him if you are not granted a visa and admitted back to the US.

What is the purpose of applying for unrestricted SS card?
If/when you change employers, you just present your unrestricted SS card + state issued ID or driver's license to show that you are authorized to work. No need to show your green card. It is much simpler and less confusing to a lot of employers. They won't have to re-verify your status as the SS card does not have an expiration date.
I thought you would have to let them know, after all you were only a "lawful" permanent resident, don't they need to know that that has been lifted and you are now an "actual" permanent resident???? that your going to be here at least for the next 10 years, unless you become a citizen.An LPR is an LPR regardless of whether you have a 2yr or 10yr green card.

Unfortunately that might be true. However, kudos to you for keeping your cool in spite of the DMV people being such a pain.

Unfortunately, not everyone's timelines can be the same, even if you have the same service center and district office. There could be several reasons for longer timelines that some people are seeing, like being held in name-check or if there are files that need to be consolidated. I know how hard it is to wait.

There's really no urgent need to apply for citizenship unless:
> you want to vote at the local/state/national elections; or
> you want to petition a relative/relatives; or
> you want to apply for a federal job; or
> you want to travel on a US passport; or
> you have an immigrant child who will automatically become a USC once you become one.
In my case, I have a 16 year old son who will become a USC as soon as I take my citizenship oath. That saves him/us another $675 and waiting time.

I agree with Rebecca. The only option you have is to do an INFOPASS and discuss this matter with an IO at your local USCIS office. Hopefully they can get your file updated and you can get a correct GC with a 10yr validity.

I had my interview last Monday and got my oath letter on the same day. No change on my online case status.

I sent my N400 to TSC and our check was cashed the day after they actually received my file. It might be different for your service center. Although all the files are forwarded to NBC where they are centralized for initial processing, I believe checks are cashed by the service center where they are first received.
Hope you get your NOA soon. I know how anxious you can get about your file being complete until your check is cashed or you actually get your NOA.

I had my big file for my I-751 and N400, which contained the originals of all the evidence I had sent. Decided to take these two big files since we didn't have an AOS interview nor an I-751 interview. The IO only looked at my husband's original birth certificate and our original marriage certificate. I'm thinking she only did that so I didn't feel bad about lugging two big files to the interview.
I also took extra passport photos but she didn't ask for them.
BTW, when I signed the forms and the passport photos that she had on my N400 file, I used my regular signature.

Another benefit is that you can petition a family member who would like to come and live in the United States.
