Hello is me again i have another question regarding the use of the k-1 Visa ,, i had aproved my interview Ciudad Juarez mexico and im heading to my home town now in cozumel ,,i'v heard my visa ll arrive with in 3 - 4 weeks from my interview . QUESTION can i take aplane from cozumel like iv done in the past with my tourist visa and fly in to the Usa like example DAllas ?? or do i have to cross from Juarez where i was issued my k-1 i ask this cuz my sister went to something similar . they made her cross the border to get her visa stamp on the frontier .. i dont wanna take a flight and be sent back to get this done ,, so if some one can claryfi me this i will apreciate it so much , so i can make the proper plans.. thank u so much!!! and good luke to every one

    You can enter at any port in the US, air, land, or sea. Just do not leave once you enter without advance parole or a green card or you abandon the entire process.

  2. Not an expert on the country, but it seems to me a two part issue. First part is he currently does not have primary custody of the child. Even if he could fight and win, he would likely still not be able to bring the child to the US. I say this because unless she lost ALL parental rights, I do believe she has to give consent for him to be able to bring his son here, and after a court fight like that...well it will not happen. His only hope is to appeal to the mother, which I know also is somewhat difficult because she would no be in her son's life. Honestly, I do not see a realistic way this will happen. Perhaps he will be able to work with the mother on extended stays during the summer while the child is out of school and such. That would be my suggestion as at least it keeps the kid in his life, and peace between two parents. Anything else is confrontational with the mother and will likely not accomplish what he wishes anyways.

  3. If you want to move a date, I think it's better if you talk to the embassy :yes: They seem to like the US citizens more and if you e-mail them, you are likely to have a quicker reply.

    I agree emailing the embassy to request a date is good as that is how I did it. However they will not give you anything until they have put the paperwork in the system and the state department tells you that they assigned you a date, at least that is how it worked for me. I had the August 5th date, yet from an email the day before I learned they gave me a option 1 business day later after I found out about this to move it up. And I would agree, working with them to even provide financials and such is a good thing as many have reported they seem to like seeing the involvement of the US citizen. I think it communicated a level of commitment to the relationship and is looked upon as being good. There have been reports of petitioners providing more evidence and financials straight to embassy and that the interview was very easy. They suspected it was because the impression of the interviewer was already made to the positive due to this advance communication. I have did this, so I should be able to provide the results of it sometime after July 13th. There was also a reports of petitioners being allowed in if you do not directly go to the window, and can be there in the waiting room, and that the first question was if that was the fiance waiting and a couple minor questions with approval. So from what I know I will be there and communicate in such a way they realize I care about and look out for her and her children and this will be looked at as good by them. You may wish to consider the same types of things that apply for your situation.

    so if there is no packet 3, how does she (or i) find the date of the interview???

    she said she knows whats up based on her russian forums but i want to be in the loop as well... not a control freak but i really like to be in the know =)

    She will get packet, but it will be instructions and interview date, typically referred to as packet 4. Best way to find out date of interview is when NVC says it has been sent, to start calling the number at the state department above and ask, as it takes 3 days typically for response from embassy.

    I agree, send your fiance everything you sent and include financials, tax returns or tax transcripts, any proof of relationship, and I-134 form.

    Search the VJ site for DHL case tracking. There is a format you can search for your papers that are sent from NVC to embassy so you know when they arrive. The NVC will tell you when they left, and when you find it on DHL, it typically will be listed the day before. Like I said it takes about 10 days after they get it for a date to be issued and papers sent. My fiance does not have packet yet, but it matters not as you can get list of things from website needed. And moscow embassy you do not have to have letter they issue you when you go because they know mail is unreliable in many regions of Russia.

    Hang in there, it is still a little bit off. Likely will be in late August for your interview, possibly early September as they are buried in visa applications with it being summertime (at least that is my theory). They were nice enough t move ours up 3 weeks only because we have girls that need to be in school in early August otherwise ours was going to be Aug 5...but now is July 13th.

    That's what I know so far.

  5. There is no packet 3 in Russia. You have an interview date and you bring everything from the instructions to the interview. Email to the Moscow embassy takes 3 days. After NVC has sent your package, call state department at 202-663-1225, press 1 and then 0 for customer service rep. Call after 9 and Moscow embassy will be done for day so you will find out if they have received it yet and a date has been issued. This is how I found out mine before even my finacee knew. Be careful the state department may tell you that the embassy has not received it when they have and just not processed it yet to get a date. It may take up to 10 days after NVC sends to get a date even after DHL delivers the package, so be patient and just call daily after NVC tells you it is gone. Well perhaps give it 4 or 5 days after it is sent before you start daily calls. Check out the embassy website as it will give you exactly what is needed as well for fiance visa and get started on police certificate for sure as this can take 3-4 weeks. I am sure there is something I am forgetting, but that gives you a good amount to start with.

  6. OK, so even though I saw a DHL package the day prior to my send date from the NVC and it was delivered last Tuesday, the embassy still says they do not have it. I even supplied them the DHL tracking number to begin with. So talked to a lady at the State Department. Not sure if she really knew what she was talking about or not, but she said they do not all go DHL, but some go via diplomatic pouch. I am leaning toward she is just not informed because it is a little coincidental that I was able to find a DHL package just as everyone else has. Really wish if people did not know the facts, they just would be honest. And perhaps maybe, just maybe find a go-getter in the government that when I give them extra info (like the airway bill number) they go look up before they tell me they do not have it.

  7. :blush: Guys, I want to share with you my interview package. I still need to feed it up with Chris's visit this july and all our pictures. It's done around an 80%.

    Me sharing this doesn't mean that this is what you need or that it's 100% perfect. Just felt like sharing it.

    I'd love to see what you have also to get ideas of a better way to present it.

    I finally decided for a "Trapper-Keeper". Legal documents are in the transparent folders that are in the beginning.

    I did not take a picture. I left a multi pocket folder with her and arranged it in order of likelihood they would ask for it. So birth certs, divorce certs, financial documents first as those are gimmies. Then copies of tickets with originals, copies of passport pages, and then lastly the communications in email and pictures. I did this last because I sent an entire copy to the consulates and hope they will allow me in. Reports are if petitioner communicates ahead of time in such a manner, they rarely ask more than a couple questions and really do not at that point care about more documentation. In the very back is entire petition I sent in minus the birth and divorce certs that I figured they would wish to inspect the originals of.

    I just wrote the Consulate again and they told me they received my case today!! I'm just happy they have it even though I'm wondering what took them this long :blink:

    It is possible the package was received, but just was not in their system yet. The person at the Department of State says they do not know until the Embassy makes an entry into their system, yet my DHL package was delivered before I even called the DOS.

    2. In Reference, enter the info as follows:

    EXP DD MMM YYYYA

    EXP is constant

    DD is the date before the day the NVC said they shipped the case.

    MMM is the three letters representing the month the NVC shipped the case

    YYYY is the year the NVC shipped the case

    A is constant

    For example, if the NVC says they shipped the case on February 12 2009, this would be entered as "EXP 11 FEB 2009A"

    3. Date range for shipment - From: Enter the date of the day NVC said they sent the case

    4. Date range for shipment - To: Enter todays date

    5. Keep the rest of the fields blank

    7. Once you enter the info, press "Track"

    8. After a while you will see a list of all of the packages that left the NVC today. You need to search for the specific consulate.

    9. When you find the shipment the corresponds to your consulate, you will see the tracking number that you can record.

    10. You can then track the shipment from the NVC to your specific Consulate

    YESSSS!!!! The NVC said they sent it out Friday, I see a package left Thursday night. I was questioning that and if they gave me the correct information...but YESSSS. Moscow Embassy here we come!!!

  10. I have to say, right now I feel like I have been punched in the stomach. I left Russia thinking that in around 60 days I would be back for the interview. Now I am told by the NVC they have no idea when my case will clear Additional Processing. Now I have no idea when the interview will be, and likely her children will not be here in time for school to start. For such a great country, the US government seems to find a way to disappoint me time and time again.

  11. Have you asked if you're in AP? After over a week it might be legitimate to ask...I heard they don't tell you that until you specifically ask.

    I confirmed, we are in "Additional Processing". I have decided to enroll the help of my congressman's office once again. Tired of this ####### of big black holes that no one can tell you what is going on, other than we are delaying things. I am so upset right now!!!

  12. we received a letter RFE... I'm in shock .. we are all sent for the first time :wacko:

    Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition.

    They have been know for "Misplacing" things. This time when you send it, make sure you highlight dates like on airplane tickets, copy of passport pages that have stamps of entry and exit. Any pictures you send, put where this was and the date. I included 6 I think in my packet of different poses from different days. Pictures are just supporting evidence you were together, the plane stubs and passport stamps are primary evidence. All together this should satisfy what they are looking for.

  13. Yes agree totally. I know my fiancée is on another forum. Good thing is most of them consult with their men in the US and most of us are on this forum. Best thing is a close communication with your fiancée on what is next, what to expect, and be proactive in removing any roadblocks for her. Remember guys, Russian women are traditional and expect the man to lead..so this is an opportunity to do just that. Show them you care enough to keep them informed and look out for their best interest and that of the relationship and it will all be very well!!

  14. On another note....it's not bad enough we had to wait all this time to get approved now i am waiting for the NVC to receive the stupid packet and everytime I call they tell me to wait the 15 business days. These people are seriously gonna give me a nervous break down.

    Do not stress. From what I hear they say that to everyone, yet the minute they get a K1, it is pretty much out the door the next day. Perhaps emailing them and ask them when they get it, to reply with the case number. This is what I have did, and nicely asked them if they did not have it yet, to just inform me when they did. I included our receipt number, her name and DOB, and mine as well to confirm I was the person. I assume sometime next week I will learn what my case number is.

    Remember, this is only a very small step, and quick. It will hit the Embassy soon. Just be prepared for this, additional evidence, affidavit of support, tax transcripts, letter from employer with salary information, bank account statements and anything to support the affidavit. Also make sure you are prepared for arranging the medical and have a complete copy of everything to your beneficiary. Focus on this and it will go fast and you will be prepared to avoid any hurdles.
