  1. Hi all,

    I've a friend who is a US Citizen and is planning to marry a guy from Pakistan ... There's an issue though and I'm hoping if you guys could give some suggestions about it ...

    So my friends spouse is a doctor and lives in Pakistan ... He came to US in 2011 on visit visa and got married here and his American Citizen wife applied for his greencard (I-130 and I-485 Adjustment of Status) ... Because his Adjustment of Status was in process, he overstayed on his visa (technically there was no overstay as his I-485 was in process) ... But in the meanwhile, the marriage didn't work out, they got divorced and the girl's family stopped the process for greencard for the guy ... The guy received an email from USCIS informing him that he was out of status for greencard and that he should leave States as his ex wife had requested to stop the greencard process ... The guy then took 2 weeks to leave States and before leaving he sent a letter to USCIS and informed them that he is leaving and told them the details about his travel plans and flight ...

    After the guy had left States and reached back to Pakistan, he received a call for residency from one of the hospitals who had sponsored him for J1 visa. When he went to the embassy for a visa interview, he told the visa officer about what had happened with him in States and about his overstay (which is not overstay considering his I-485 was in process) ... The visa officer appreciated him but his visa was rejected ...

    Now, my friend, who's a US citizen, had married the guy and she wants to know before applying for greencard for his spouse, what are the chances the guy could get it? The guy has all the documentation of the previous greencard process, the divorce, the cancelation of greencard process and the overstay (2 weeks) justification and the letter he sent to USCIS before leaving for Pakistan ...

    I would really appreciate if you guys can suggest what should be done and how much are the chances that the guy will get greencard considering he is not telling a lie and he had a solid reason for a 2 weeks overstay in 2011 ... Or do you know anyone who had a similar case? Your help in this regard will be much appreciated.

The NADRA certificate has a water mark of Quaid E Azam's picture and it has a silver foil marking too. Would that be sufficient? Do I need to get it notarize before submitting it to USCIS (If, I've to get it notarize, where should I go)? Or sending a photocopy of this original document from NADRA should be sufficient?

    I believe the Registration certificate you are talking about was use to known as "B form", with your and your sibilings name with your parents, if that so ,its very easy to get birth certificate from NADRA.

    its better to get birth certificate now, because it will create checklist later, and additionally , they will ask your mother`s birth certificate.

    I filed for my mother few years back, they asked her to bring her birth certificate , my(petitioner) birth certificate and her nikahnama at the time of interview.

    My sister has contacted NADRA and they told, they do not do Birth Certificates and they said FRC is like a birth certificate and we could submit this to USCIS ... Secondly, my mom doesn't have a birth certificate ... And it seems to be really hard to get one for her now, any solutions? Should I submit my paperwork with FRC (this is what I submitted for my green card and they accepted it at that time) ... Your thoughts on this would be appreciated ... Thanks

    I'm becoming a US Citizen next week and would like to sponsor my mother for greencard.

    The instructions on USCIS asks for my birth certificate with my mom's name, which unfortunately I do not have ... But I do have a "Family Registration Certificate" (Original) from NADRA (National Database & Registration Authority of Pakistan)
    with my mom's name on it. My mom requested for this certificate when I was applying for my greencard and it shows my mom as an applicant and me as her daughter on the certificate. The NADRA certificate has a water mark of Quaid E Azam's picture and it has a silver foil marking too. Would that be sufficient?   4. I had my interview today in Fairfax, VA ... My interview time was 8:30 and I reached there around 8 AM ... An officer came out and called out my name at 8:28 and took me to his office. He went through my N-400 application first. The USCIS officer was very friendly and asked me if I'm still 5'11 or have grown more after filing the application :D ...
    He asked me to read the question from a paper "Which country is on the north of US?" and then asked me to write "Canada is on the north of US."
    He asked me the following civic questions:

    1. What group of people was taken to America and sold as slaves?
    2. What is the highest court in United States?
    3. How many amendments in the constitution?
    4. Who is the vice president of the United States?
    5. Who makes federal laws?
    6. Why did colonist fight the British?

    The officer told me in the end that he's recommending me for approval and that I will receive my oath letter in the mail.

    Now the wait for the oath letter begins. :)

  5. OK here some more details, adding to the above:

    Docs to bring. Very few!

    Bring greencard, N-445, any U.S. re-entry permits you might have, state issued driver's license or non-driver's license state ID.

    Not required: foreign passport (doesnt make sense anyways for this event)

    Do bring a pen (no pencil)

    Attire: No jeans, t-shirts, flip flops. It's a court room.

    Oath ceremony at the Los Angeles Convention Center (Feb 23, 2016):

    My requested door time was 8:03 am (9:00 start of ceremony). They give people different times to stagger arrivals, avoid crowding. I arrived by car at 7:20, skipped the loooong wait of cars entering the underground parking structure (signs "citizenship parking") by driving around the Center to the W side (following "to West Hall" signage), and entered the same garage from the West entrance without any wait. Paid $15 cash at entry. Parked, walked up - all is well covered with signs directing you. Ushers are very friendly.

    I had brought a binder to keep my stuff together, which helped a lot - you get an envelope with things like a copy of the two oaths to read from (and the words of The Star Spangled Banner). Good idea to go to the restroom before the ceremony. The entrance to the event hall is from the outside, west side of the building (the West Hall).

    1. Separate lanes: One for candidates and one for guests (family, friends) at entry to building. Guests don't need to show for who they are there for - it seems pretty open access.

    2. security checkpoint (like TSA @ airport, no water)

    3. After security, frantically filling out backside of N-445 (oath notice / invite), many dont have pens - sign and date. CAREFUL which lines on the form you fill out. Do bring a pen. I lent mine to two others.

    4. Then waiting a few minutes in a crowd - they crowd control. Finally my batch gets let through to the check-in tables, lined up alongside the side of the hall.

    5. Pick ANY table to check in (short or no lines are farther back).

    6. At check-in, most people get asked about the questions on the back of the N-445. They may reverse how they ask questions. For example, the N-445 asks under No. 7: "Since your interview, has there been any change in your willingness to bear arms on behalf of the United States (...)". Answer has to be an honest "No" to be admitted ('No' means you are still willing to bear arms). They might instead ask you directly: "Are you willing to bear arms in defense of the United States" or similar. The honest answer has to be "Yes" then. It's the same questions as on the back of the N-445.

    The officer then staples greencard (and if appliccable, re-entry permit) to the form, punches a hole through them, then rubber stamps the front of the form, and hand writes a large number on it - that's the table number where you pick up your certificate after the ceremony. The people asking at check-in are immigration officers in civilian clothing. The one who had interviewed me sat one desk over, recognized me, and greeted me by hand shake. I was only asked if anything had changed, nothing more.

    7. Receive an envelope with content, and a small flag, and go to the seating area and get ushered in. Last chance for bathroom. Candidates sit in the front of the hall, the guests are physically separated and sit in the back. From now on, do NOT go to the bathroom to not miss the ceremony. Once the judge is there and the court in session, you will not be allowed in or out.

    Envelope: An info sheet for what to do next, voting information, a passport application form, a carton cover for the certificate, and a printout of the two oaths and the Star Spangled Banner.

    8. 8:45 ceremony starts, many consecutive steps from now on. Just follow instructions and meet your fellow candidates.

    The following is roughly in order of events.

    General announcements are in English and then Spanish. Mostly people having lost documents and are invited to pick them up at the podium. Voter registration forms are handed out. Fill it out but do not sign it yet (you need to be a citizen to sign it). A lot of people are very challenged in English.

    When they start speaking, you better sit. Someone at the podium knocks with a hammer three times - court!

    A delegate of the Federal Government speaks and authorizes the judge to act.

    The hall gets declared a court of law of the local federal circuit court.

    A USCIS person speaks, then the judge. The pledge of allegiance (standing, right hand up) gets administered (see envelope contents), then the judge gave a speech. Speeches by others, then the oath of allegiance to the flag (shorter than the pledge, right hand up, standing).

    At the end, the Star Spangled Banner is sung, welcome to sing along (standing, right hand to heart, face the flag).

    Congratulations, new citizens!!

    Countries of origin are honoured by top 5 (1. Mexico, 2. Philippines, 3. Iran, 4. Vietnam, 5. China). Military members naturalizing are honoured by name. Two videos are shown (one is Obama speaking), then instructions - sign the voter registration form now, and hand it over (that part is voluntary).

    The guests are now dismissed:

    Certificates are only handed out once all guests have left the hall.

    9. From seating to tables: Follow instructions by the ushers. People are admitted to the tables in batches. Line up ONLY at the one you have indicated by a hand written number on your N-445. You hand in the form (with greencard attached) and in return receive the certificate.

    10 SCRUTINIZE spelling of your name, date of birth, and ensure it's embossed. Then walk off. If something is not right, let them know right at the table. There is also a resolution table to your right, to get things fixed. Photos can be taken with the flag in the background, from behind the flag. Restrooms along the way. Tables where you can sign the certificate (can also do at home).

    There are lots of businesses out there selling flowers, photo ops, lapel pins (US flag, $8), certificate holders ($10). At exit from the building (East side), friends/family can welcome you. Wave your little flag.

    That day, 3,146 people became American during the 9am ceremony at this location (there is one afternoon ceremony too, 1day/month for L.A.), from 100+ countries. 11 servicemen/-women who naturalized were honored.

    Recommended after the ceremony:

    - scan your certificate after signing it with ink (!), e.g. ball point pen, or a real ink pen.

    - show the original to HR at your employer, so they can update your status. They might make a copy of it.

    - apply for a passport (need to send original of certificate, so go see your employer first) (find an application location here: https://iafdb.travel.state.gov/ )

    - after 30 days, go to the local social security administration office, bring original certificate. (find it here: https://secure.ssa.gov/ICON/main.jsp )

    - Post your status here

    - party in red, white and blue!

  6. Yay!! I am a citizen as of today!!

    Strangely, the USCIS officer checking me in asked me only "has anything changed since the interview", while he asked others very detailed questions.

    All in all a very well choreographed, and moving ceremony.

    Congrats on becoming a citizen.

    Can you elaborate a little bit about the detailed questions they asked? And what are the documents that you believe we should be taking with us on the USCIS interview day? Thanks

  7. My interview was today, and I was approved!

    It was scheduled for 1:45 PM (PT), and I arrived at the Santa Clara building 1 hour and 30 minutes earlier. We never know if the traffic is bad in this area. Better be early than later. I entered the building at 1:15, passed security, and at the reception, was told to wait until 1:30 to have my name in the system. The same thing was told to the person behind me. At 1:30 sharp I went to the receptionist again. she entered my name and alien number in the system and I was told to put my letter in a box at the "window 1".

    After a little while (10 to 15 minutes) I was called and entered the room. I was told to raise my hand and swear to tell the truth. I did.

    The officer asked about my full name, address, mailing address, my DOB and other things in the form N-400. She asked if I still married to the same person, I said yes.

    The she asked the whole "no" and "yes" questions in the form.

    After that, she told me to read "Who elects Congress?"

    to write "People elect Congress"

    and finally, asked the questions:

    - Who is the Commander in Chief of the military?

    - What is his political party? (she asked me this way)

    - Name one state that borders Mexico.

    - Who makes federal laws?

    - Who wrote the Declaration of Independence?

    - Name 13 of the original states. (this way too)

    She then revised my whole file ( a lot of pages), since my first interview in Rio de Janeiro, I believe. I saw our photos (my husband and me) that we sent a long ago, saw the copy of his drivers license, copy of income taxes... everything we sent.... After that, she marked "Congratulations" in the N-652 paper and said to me to wait for my Oath letter.

    I'm so happy that this part is over!

  8. Placed in line on your 5th green card anniversary. I wonder if that's just a coincidence or if it's intentional. A lot of people are placed in line 1 month before the anniversary. Who knows how USCIS works! :-)

  9. sad to hear that ... But, hey this is the last chunk in this journey and you'll be done with USCIS after that (Y) :)

    Removing myself from the list. I was wondering why USCIS has not cashed the check and I just received my paperwork back, according to them I am not eligible to apply for citizenship, based on three years of marriage to a US citizen in the 90 days window prior to becoming a lawful resident. I know I am because I filed to the day of eligibility and even today after their rejection mail I have managed to talk to two separate USCIS IO that confirmed my eligibility and had no explanation as to why I have received the rejection notice. The two IO over the phone confirmed my eligibility with their supervisors as well, and they also had no explanation as to why it says I am not eligible to apply according to the rejection letter. Anyway I just printed N-400 form again with the same information as I have provided before with the explanation of my eligibility and a simple calendar that explains to them my eligibility with the request that in case I am again not eligible I would like for them to provide me with exact date as to when I will be eligible. Frustration, frustration, frustration....
