  1. I strongly disagree with that statement. For K1/CR1 cases, decisions have been made PRIOR to the interview. But for Tourist Visa cases, the decision will be made by the interviewing officer AFTER the first question is answered.

And most of the times, that question will be "What is the reason for the visit?". And it better be a good one since everyone knows the people from the US can fly back to visit the other country.

Mom/Dad needs to visit the US because they miss their daughter/son probably won't fly in the CO's book!

People from the US can fly back to visit the other country is not the same as people from other countries visiting their relatives IN the U.S.

If your mom coming to the U.S. to visit your newborn child is a perfectly good reason, coming to visit their sons or daughters is not?

  2. What prevents your wife from applying for Citizenship and then sponsoring her Mom (according to your timeline, she should qualify to do that by now)? It'll take LESS than one year for her to come here living for as long as she cares (and she can still come back to Vietnam anytime she wants as long as she cares to remember coming back to the State once in a while to maintain her legal status.

Yes, I'm sure the CO would know this also.

Thanks for telling me what I already know.

  3. I would not recommend waiting for the interview to prove your case. If you can't prove strong reasons for her to return to her home country when submitting the petition you will most likely get denied. In almost all cases the decision is made long before you get to the interview stage. Most non immigrant visa interviews last 2 minutes or less.

  4. and you don't apply for her....she applies (and qualifies) on the strength of her own situation (which sounds fragile, at best).

I can apply on her behalf. Immigration lawyers do it.

In my personal opinion, in current circumstances she will be denied.. US wants people with money spending there... at 61 most ppl retire in some countries so not having job is fine but she must have ties back home... house, shop, any property, relatives... CO will think if she has no ties why will she come back...

does she have previous travel experience?

She has ties. She owns house, lands, and has many relatives.

  5. Hi, I'm applying for tourist visa on behalf of my wife's mother. Could someone tell me what she can expect at the interview? Is interview for seniors different or are they the same? She's 61 years old. Live in the country most her life. Not very educated. She can answer simple questions, but probably won't be able to answer questions such as what our address in the U.S.

She just a simple country woman. She has no job, bank account, etc..

Would she be denied base on this?

Also, what kind of documents should she bring besides the require documents?

  6. Hello, I'm trying to pay for my visa application fee so I can schedule interview. I've already printed the payment deposit slip, but I can't go to next step without filling in the receipt number.

I'm going to pay at Vietnam Post office. Could someone tell me where I can find this receipt number?

  7. Vietnamese are not any more virtuous than anyone else.

I know of plenty of Vietnamese familes willing tomarry off a daughter to any Viet Kieu. Even a Viet Kieu who is a scumbag.

When I was traveling through Vietnam, I had three different families approached me about marrying their daughters.

Once when I was walking through the local market with my aunt who lives in Vietnam, a woman approach my aunt and asked if I was from America. Without knowing my name or anything about me, she offered to let her 18 years old daughter marry me.

I know of another family who married off a daughter to a Viet Kieu who was already married. Knowing that he could never petition for her while he was already married, all they wanted was money to be sent to Vietnam

So just because someone is critical of some Vitnamese who will do anything to come to America, it doesn't mean he does not have respect for all Vietnamese women.

Some Vietnamese have no problem whoring out their daughters. Some Vietnamese have no problem marrying and having kids to get a green card.

Stop with the holier than thou attitude. Some Vietnamese families will do anything to get a green card. Not all Vietnamese are virtuous.

Really, what does that say about woman you married? I guess they're the exception? I lived in Vietnam for two years, I've never had anyone offer their daughters off the way you mentioned.

I never said all Vietnamese are virtuous. I said not many women would risk having a baby just to go to the U.S.

Anyway, we're getting off base, this discussion is about whether or not a CRBA would benefit....

  8. You can go in with her if you're a USC. Just bring your passport.

If you're serious about bringing her over here, you really need to do some research so you can navigate through all the paperworks.

Maybe I should've said IR-1. An I-130 is a petition you file with USCIS to apply for an IR-1 visa for your wife. Just like the I-129F you filed for the K-1.

I believe the K-3 allows your wife to come to the U.S. sooner while waiting for the IR-1 to be approve.

Research throughly, then decide what route you want to go. Don't file a petition and change path halfway through. That'll just create confusion for you, USCIS, and the consulate....

Your mom? Aren't you 47? LOL

  9. Hello everybody .. I am currently waiting for the I-130 to be approved and i just need to know wich AOS forms to file .. I am tryig to get one step ahaed of my self and get ready for the next step .. I filed for my wife .. I am a us citizen , i make well over 45k a year . And the other questuon is can you file thoese forms via email ? Thank you all .!

I believe you have to file form I-864. No, you cannot do it via email...

  10. Let me visualize this love story in my head. A middle life (whether still functional with or without the assistance of ED medicine or not is still questionable in the air) man falls in love with a PROFESSIONAL doing well on her own lady in a VERY POOR country with ALMOST ALL of her family members already in the US.

ALMOST ALL of her family members already in the US???

  11. It's a popular misconception in Viet Nam that having a US citizen child makes it easier for the mother to get an immigration visa. Lots of Vietnamese who have never even been inside the US consulate will attest that it is true without any real knowledge.

The US government realizes that love is not required to make a baby; only a few minutes of sex.

Yes, but in order for those few minuted to happen, there has to be some type of relationship. Not too many women will go to that length just to come to the U.S.

The government's position is that a couple with child tends to stay together longer than couple without.

  12. Oh and my sister said she would sponser her if do have to go the K-3 route! So that takes some strain off us if we have to go that route.

so far you've gone from K-1 to I-130 to K-3.

  13. If there were a war between the USA and China, who would manufacture our happy meals?

They make toys for the Happy Meals....and I'm sure Vietnam would be happy to pick up the slack...McDonalds already have 2 companies in Vietnam manufacturing Happy Meals toys.....

  14. She said it doesn't matter to her where we live as long as its together.

Trust me, she wants to come to the U.S. Are you in your 20s by any chance?

  15. has anyone experienced where you already obtained a child;s social security and american passport and your spouse is still waiing to be interviewed for their visa? the child is both the petitioner and beneficiary's child after succesful CRBA, would this make Interview alot easier. has there ever been visa denials, altough both parents have succesfully obtained the child's social security card and american passport

Our daughter had a CRBA. They didn't even look at the pile of evidence we provided. They already had pink waiting. My wife was asked four simple questions. However, her visa wasn't issued until we straighten out a few problems with my Affidavit of Support. I don't think her interview would be that easy without the CRBA.

I don't agree that it doesn't help. It's not your ticket home, but it's definitely a plus to have.

  16. Thank you vyx.

Minutes ago I called NVC at 603-334-0700 and they said they just received my package from UCIS and they issued me the HCM xxxx xxx xxx number. Wow, things are moving very fast now. They said they will send my petition to the Ho Chi Minh Consulate shortly like in the next few days.

Things are moving so fast now.

Now that I have the HCM case number, I'll go update my Timeline now.

Everything should be pretty straight forward until the interview at consulate. that's where your fiancee might encounter difficulties.....

  17. Again you are bringing up battles from the past, which have NOTHING to do with modern warfare. I've stated before I have no doubt in the commitment by VN people to defend their homeland. You mention the US can't defeat Iraq or Afghanistan alone, which is certainly not the case. The US could easily level those places and kill everyone in sight, but we choose to follow international law and human rights. It is how we "are". We fight for freedom, but thinking we can't do it unilaterally is not being realistic. We certainly can, but wisely choose not to. Can the same be said for China?

Consider this very viable scenario: China places an embargo on VN, stops selling electrical power to you, stops all incoming shipments(which include the arms you are getting), claims rights to open seas in the area and enforces it. They have not invaded VN at all, but now have a stranglehold on your country and economy. You don't have the navy to fight it, and the world will certainly complain, but that doesn't mean they will send troops! After a year or two of this, which devastates your economy, they have built up a sizable ground force on your northern border.....and they find an "excuse" to invade, such as to keep the peace since the starving viets are protesting. They petition the world court saying they don't want a fight and only want to restore peace. They have no intention of permanently occupying VN and will leave once peace is restored. The world hopes for the best and does nothing. NOW China has control of VN without firing a shot and the likelyhood of the US having to invade a well entrenched Chinese army makes the proposition extremely expensive in both money and lives. Do you think in this economy and political climate the US gov would take on such a challenge, just to free one communist country from the grasp of another communist country? Do you think the US public would back such an ordeal into a country we already tried to save before, but were fought by the very people we tried to free?

Well, if it's this simple why haven't they done so already? Cuz they nice guys?
