  1. I just remembered, my husband was born in the US and that's how he became a US citizen. He then moved back to the Philippines and he would sometimes just go back to the US for short trips or to visit some of his relatives. I remember now that the reason we didn't file for CRBA is because before our daughter was born, he hasn't lived in the United States for at least 5 years. Probably only 3 years, 2 of which after age 14.

  2. We were also aware about filing for CRBA. But I think my husband and I decided to just go ahead with the visa because our daughter will automatically get it once I get mine. And at the time, he was in the US and I believe we read they might require blood work since the US citizen is the father. As I remember it, he just decided to do the visas since it seemed easier and just deal with the paperwork once we were all together again. Now we don't know what to do with her papers. Should we file for crba now?

  3. There is no guarantee you will be admitted using AP, but provided you have less than 180 days of overstay (or have no overstay at all) or any other issues which would render you inadmissible to the US then you will probably be ok.

    What do you mean by 180 days of overstay or none at all? I got here Nov. of 2011 but applied for my AOS only this year, 2013. Does that mean I overstayed in between that long gap from entering to finally applying for AOS?

  4. Hi! I just got my employment authorization card and underneath it's been printed "serves as I-512 advance parole" I applied for both employment authorization doc (I-765) and application for travel doc. (I-131).

    I was wondering if ever I go to Canada for my cousin's wedding, will I be admitted back to the USA? I have read that there is no guarantee you can re enter the US using that employment authorization card with the advance parole underneath.

    Thoughts? Card expires in 04/03/14

  5. I'm scheduled to have my biometrics this friday! Yay! This is for employment and travel while aos is still ongoing. Anyway, I just want to get an idea of what's going to happen on that day... Like they get my fingerprints? Do they also take my picture? And I hope you guys can enlighten me on what I need to bring. Just my passport? And the letter they sent me regarding my biometrics appointment? Is that all? Sorry. These might sound stupid but I really want to come prepared. Thanks guys! :)

  6. HI! So I finally sent my AOS package last Jan. 30 and I was wondering why I still haven't heard from USCIS since i've included a G-1145 E-Notification of Application/Petition Acceptance. I then tracked my package in USPS website and it says there, expected delivery was Feb 1 but up to this day, it's still being processed. Anyway, this is where i'm confused, on Feb 1, it was processed at Elk Grove Village, IL 60007, departed that same day and arrived at Chicago, IL 60607. AND THEN on FEB 5, it's being processed through USPS Sort Facility in Elk Grove Village, IL 60007 again. It says the same thing 'til this day, Feb 5 processed through USPS Sort Facility in Elk Grove, Feb 6 processed through USPS Sort Facility in Elk Grove, Feb 7 processed through USPS Sort Facility in Elk Grove, Feb 8 processed through USPS Sort Facility in Elk Grove.. WHAT? I'm confused! Sorry i'm not sure if anyone can help me or if they've experienced the same trouble with UPS sending their package but I would really appreciate any insight on this.

    Maybe somebody could also shed some light, does the AOS package end up in Chicago or in this Elk Grove Village in IL? I pray USPS didn't mess up / lose my package! huhuhu!!

  7. Hi! Thanks for taking time to read my post. I was wondering if I am allowed to continue my adjustment of status in the Philippines/abroad. Basically outside of the US. My husband (US citizen) will be with me if ever we do decide to leave. Do they allow this though? Or are they very strict that you remain in the country to be able to get a green card. Thanks in advance.

  8. It says on number 11 of the Step-by-Step Guide on How to File for Adjustment of Status for K1 and K3 Visa Holder that:

    11. I-693 , Medical Examination of Aliens Seeking Adjustment of Status I-693, Medical Examination of Aliens Seeking Adjustment of Satus. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. .........etc.

    My question is, what if we are filing my AOS just now (Sept. 16, 2012) and my last medical examination (which was done specifically for my US VISA and the med exam was held in the Philippines where I am originally from) anyway what if that medical exam was taken AUG. 16, 2011 meaning, it's been over a year already! What should I do next? Do I need to take another medical exam here in the US? I already got the nearest Civil Surgeon if I do need to take that step but I just need answers if another exam is really what I need to do now.

    I can't believe we crammed for this! I guess my husband and I are just real happy that we are finally together. And of course, we also needed to save money for the fees.

    you should be quiet fine, as long as you satisfy the requirement of the visa which is getting married within 90 days, your good. you do AOS as you like, you have people waiting longer due to the cost

    While i was filing for my K1, I worked on it fast cause I was badly missing my fiance (husband now). I arrived here, Oct 3, 2011. We got married Nov 11, 2011 (11-11-11). Anyway, as you can see, it's already almost a year since I arrived the US. I already have the documents I need to fill out for my AOS but I haven't been working on them! I know i've been such a slacker and that's because I am finally with my husband but of course I still want to fix my papers! Question is, am I going to get in trouble for filing an AOS this late??? I'm so scared!!! :( I don't want to be separated from him anymore.

  11. I looked at your profile and saw that you entered on a K1 visa. That changes things. You stated you came on a US visa, you should have stated K1. :)

    I thought that you got a visa on your own and entered the US. Your message was not clear. Ignore what I have written and clarify your status as K1 because vjers may respond based on what you have written and not on your situation. All the best!

    Oh shoot. Sorry about that. Yes, I did enter with a K1 (fiance) visa. My husband is really Asian, but he was born here (in the US) so he automatically became an american citizen. (by birth). And he grew up most of his years in the Philippines... He's only been living in the US for about 3 years... that's why our daughter was not eligible for a CRBA cause the requirement was that the US citizen must have lived in the USA for at least 5 years after the age of 14.

    Doesn't matter when you file as long as you got married within 90 days, the visa expired the minute you got in the US.

    If you entered on a K-1 your visa expired when you entered. Your I-94 would have been valid for 90 days, this is how long you have to get married. Once you get married there is no deadline for filing for AOS, but you should do so as soon as you can.
