  1. Just to clarify - are you trying to set him up with a separate apartment? Or are you trying to move somewhere new together? I ask because you mention being a co-signer, but typically a co-signer is someone with good credit who is NOT living there and just signs to prove things will get paid, etc. If you are living there, you aren't a co-signer, you are someone who lives there and chances are your credit will override his if it's very good, though not guaranteed. That said, some places don't really care, especially if his credit is just nonexistant vs bad.

    He may want to try to start building up his credit though, if possible.

  2. If you are only using her income, and not her spouses, you list her total income - so the amount on her W-2s, plus if she has any other source of income, but only what is HER income. You don't list the total income if it includes her spouse's income and he is not filling out an I-864A.

    So, it's usually broken down on the tax return, but you may have to do some math if she is getting income from multiple sources.

  3. Just to verify - did you put together all the paperwork yourself, or did your in-laws give you a sealed envelope? I ask because you said you were assured you had sent the latest tax return which makes it sound like you may not have been the responsible party in that.

    Otherwise, it sounds like something maybe got lost. I would resend exactly what they asked for. Your case is "paused" while they wait for your documents. It will "restart" when they have notified you they are received.

  4. I am sorry to discourage you, but walk in in Alexandria USCIS office does not work anymore. We went today Friday July the 12th at 11.30 am. A not very freindly officer at the entrance (a woman) asked me when was the appointment and she did not let me in. I pray and I told her that I will certainly will lose my job if I do not get a work permit ASAP, but obviously she does not care at all about people's life... My 5 years old son and I we travelled in public transportation for 2 hours to get there, and even when I asked her: "maybe later in the day" etc... she was very rude and not listening.... I don't know what I am going to do, everything it's so difficult, I am so tired. Last year, the same procedure in New York the downtown office was easy... no problem... Is this office? Is the particular officer? Someone knows if certain times of the day or certain officers or certain days could work better? Thank you!!!

    That's unfortunate! I would venture to guess it's either a) the officer or b) they're cracking down. I'd search around the board and see if anyone has gone there recently. We had no issues back in November as well as several years ago.

    Thanks! I know the numbers in South America don't go as high as Africa, Europa and Asia so I wasn't sure. :) Congrats to your sister in law too!! I hope she gets her interview quickly!

  6. VSC has actually suddenly sped up! Lots of Nov filers getting approved now (6 months). We got out approval today. Here is what we sent:

    - Copy of our lease from our house we moved into in 2011.

    - Copy of our health insurance cards as well as all the previous ones from during our marriage.

    - Bank statements for our joint account (full) from 2011 & 2012 (every 4 months)

    - Birth certificates from our 2 kids

    - Cell phone contract (my name only but shows family plan)

    - Car insurance showing both our names

    - Pictures from the last 2 years including our trip to Bolivia with my sister and his family, the day our son was born, holidays with my family and our trip to visit my grandparents in Boston

    - A copy of our travel confirmation and ticket stubs from our trip to Bolivia

    - Joint tax return from 2010 and 2011 (pretty sure I forgot to include the W-2s, but I guess they didn't care).

    Oops sorry my post was confusing!! My sister in law was also selected and I meant I am trying not to get too excited LOL!!! :) I am glad your SIL has a low number!! My SIL's is in the 900s (South America) which I don't think is too bad!

  8. I don't think it will necessarily be a problem, but most of the cases are people who applied and didn't win - he won and they know it. I've seen people mention having a problem with tourist visas in that case, don't know about student visas.

    Anyway, it's recommended winners file their applications with KCC ASAP - so while he isn't guaranteed a visa until an interview comes around (if at all), I don't think it's a given that USCIS won't look at him as having immigrant intent. It's not a problem to AOS or be here on another visa in terms of the DV visa but it IS a problem to have immigrant intent for the F-1.

    Anyway, not saying it WILL be a problem - just that it's possible and there aren't a ton of cases on these forums of this situation to go off of. By all means I would apply for the F-1 - just have a backup plan.

  9. You can apply for an F-1 visa anyway. You may not be granted one since you have immigrant intent. On your app, you'll have to admit you applied for DV - this is regardless of whether you have filed papers. USCIS can check and see you won.

    The number above is for this year. Next years (2014) won't start being interviewed and getting visas until October. There's no way to know how fast your number will come up, but it won't be by August.

    You can legally AOS if you are here in the country and didn't come here for that purpose. But it is a double-edged sword since you have immigrant intent.

    Any way you can delay your classes if your F-1 is denied?

  10. Yes, but she is going to have a 10-year ban and I don't think adult kids qualify to submit waivers for their parents (but I might have that backwards).

    I may be wrong but I THINK since the parents of USCs are considered immediate relatives, it is possible to submit a waiver. The I-601 instructions say the person must prove it would be a hardship to the qualifying relative and then lists son, daughter, parent, and spouse. BUT, the wording is kind of confusing so I may be wrong. :) Even if it is possible, it's pretty hard to convince the government that as an adult it is an extreme hardship not to have your parent there with you.

    OP, how long as your mom been out of the country?? After 10 years, she won't need the waiver.

  11. He still has to file as a sponsor even if he doesn't make any money. He will always be your primary sponsor, the other person will be a co-sponsor. If he is unemployed he probably isn't required to file taxes. Double check with IRS. If he wasn't required then no, he does not have to file in order to sponsor you, he needs to include a statement of why he didn't file (because he didn't have to, etc.)

  12. Thanks jhm3 - I actually spoke with them yesterday and worked this out and was hoping to post just what you you say in case anyone else is curious to know the response.

    Apparently no matter what the folks at the Social Security Administration say, SSN do not expire, so no matter how long ago it was, you have to have it for the form and for your taxes in the US, etc.

    The UK Embassy handles requests in 3 business days, so it's not even such a pain to deal with.

    :thumbs: Glad you got it sorted out. Also, interesting to know how to get the number if you are abroad and forgot it - didn't know it was possible! And nope, SSNs do not expire. In rare cases someone may be reassigned a new number but that is only in extenuating circumstances (think witness protection, etc.)

    I don't know how far the OP is from their local office but some people are very far - up to a day's worth drive (or longer) away, and some doctors do not want their patients to travel more than an hour or two away in the last weeks of pregnancy. Again, that may not be the OP's situation but it is one possibility.

    Either way, not a disability, just watch the mail closely and reschedule as soon as you know of a conflict (if there is one and if you even get an interview).
