I Was getting impatient because my check also didn't process for 10 days and finally on Saturday I got my whole packet back because I made a silly mistake, on the check I put 2012 instead of 2013. Well, put the correct check and send it back today.
-
Well if they repeat what happened 2 years ago with us, it doesn't sound good. At that time after waiting for almost 4 months (for some people 6+ months), CSC transferred 34000 cases to TSC (also known as a black hole) in Oct-Nov 2010. We at VJ who filed for CR1-IR1 were so happy that finally we can hope to get our NAO2 soon. CSC sent us letter that in order to speed up the processing, your case has been transferred to TSC. We only later found out that it was to speed up the processing of applications remained at CSC. People at CSC started getting their approvals in 3-4 months, in some cases 2 months. We were just bunch of forgotten applicants and TSC just didn't have enough manpower and experience to adjudicate these type of applications.. 3-4 months after this blunder and lots of complains by everyone our cases were moved back to CSC with a promise to expedite the process. Finally after 9-10 months from NAO1, people started receiving decisions.
Hope history doesn't repeat itself.

Thanks, Yurika and Jim but I am not sure. In his posting he said VSC but in their profile info to the left side of each posting they listed their service center as CSC.
If hindustani24 reads this could you please post the correct information. Is your service center CSC or VSC. Please update your profile to VSC if that is the correct service center.
Thanks
Well CSC was my service center for CR1 and now of I-751 it is VSC. I am going to update my profile to show the current process (I-751).
-
Sent my wife's I-751 today to VSC. This waiting game is not going to be that bad, as my wife is with me unlike the wait for CR1.
-
My brother filed for her wife under F2A. Her PD is sep 9, 2010. After paying AOS fee and IV fees online we have not heard anything from them. R we suppose to wait till her PD is current before submitting documents using the coversheets generated (simmilar to cr1) from online payment page or r we suppose to just wait for NVC to ask for the documents. Also my brother had a son last year and I am under the impression that we only need to add him in ds-230. Do we need to do anything else to make sure his wife and son come to US together. Thanks.
-
I have a question. My brother who is permanent resident is filing for an itin number for his wife who lives in India. They had a child born in India last year and still lives with his mom in India. Can my brother apply for itin number for his child also so that he can claim his son as dependent.

But to nototize your Wife's Birth Cert and Voters ID in US, wouldn't you need her(the real person) present in US where you got it notorized?
noop, i just walked into my bank and got them notarized for free. he didn't even ask who the documents belong to.
-
"Keep in mind that the regular notarized passport copy will not be enough, you will need apostille."
1) Can you please tell me where in Delhi, Can I get this Apostille notorized passport copy?
2) Are you speaking from your experience or by W-7 instruction? just curious
3)is Apostille Notarary same as Certified? My spouse found out about this When she was looking into getting Certified copy.
Please look here for picture i posted of a Certified, it has Apostille on it.
4) They guy mentioned to her that this has to be attached on the Original document which doesn't make sense since we want to put on the copy of the original doc (in this particular case: marriage cert)
5) Do you recommend us getting this Apostille/Certified for NVC (Birth certificate and Marriage cert)?
6) The guy quoted her around Rs.2000 per this Certified copy, is this correct? typical cost?
thank you !
Well i am not sure about the Apostille process in Delhi. I didn't send IRS my wife's passport copy. I had my wife's original birth certificate with me because i needed it for NVC stage so i had it with me at that time and i asked her to mail me her original voter ID. I got these two document notarized in US and attached them with W7 + return.
The picture you posted appears to be an apostille but i am not sure as i did not do it.
check this link: http://www.visajourney.com/forums/topic/307125-apostille-of-passport-copy-for-itin-application-spouse-in-india/
people had their W7 denied because they just sent foreign notarized copy without apostille.
-
Today I went back to my Local tax service place and filled out the 1040X amended (Married Filing Jointly) + W-7.
Today or tomorrow, i'll email all the documents to my NRA spouse so she can sign and snail mail back to me (1040X, W-7 + Notorised foreign passport + W-7 declaration letter). .
Then i'll mail it to all to
Internal Revenue Service
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342
ps: i don't mind getting my returns late as i would like to present the 1040X showing married filing jointly status to NVC.
In process i'll also get her to sign and mail DS-230 and DS-3032 to me
In anycase, i hope you guys don't come across any issues at the interview or any where else.
Best wishes!
Keep in mind that the regular notarized passport copy will not be enough, you will need apostille.
From w7 instructions: http://www.irs.gov/pub/irs-pdf/iw7.pdf
"Have the copies notarized by a foreign notary. However, foreign notaries are only acceptable as outlined by the Hague Convention. The Hague Convention provides for the simplified certification of public (including notarized) documents to be used in countries that have joined the Convention. A certification will be issued in the form of an “apostille,” which will be attached to the copy of the document."

If you filing your Tax with your spouse ITIN then how you do with State Tax, what you tell them that you applied for ITIN? do you send same ITIN application with State return?
This is confusing to me, please help.
For state tax, i just filed for extension and filed state tax when my wife came and got her SSN.
-
Filing as single is common because it involve less paper work for the tax preparer and also for someone who is doing their own taxes. However, I was on the same boat last year and filing for ITIN (W7) was so easy that I wonder why do it any other way (I got around $5600 return because of that, instead of paying IRS couple hundred bucks had I filed single).
In my opinion filing as a single would not negatively impact the visa case because I never heard anyone denied just because of that. People in the embassy knows that this is common route people that because they don't want to do the paperwork to file for W7/ their tax preparer does not know any better.
All in all it could help your case if you file as a married/joint but I can't see it being negatively affecting the case if you do single. In my opinion, if you have already filed as a single then no need to amend it right away, wait till your spouse is in US.

here is what i did last year:
resulted in a big fat check from IRS.

Yes they do say that all the time but it is not true. You can pick the passport and visa the next day from VFS office. We had a interview of May 17th and was able to pick the passport and visa the next day from VFS. VFS office will send you SMS when the passport is ready to pick up. You can pick it up between 4-5PM but try to go early to avoid the waiting.

Hey all- I finally got our interview date! It's the last week of August but it's all good- just glad we actually have a date!
So, what steps do I take now? Any advice would be much appreciated
Congrats Celldoc!!! hope everything goes smoothly from now on.
-
WOW... I really didn't post this message that many times... I think my computer has the hiccups
-
Congrats on the recent approvals!!!
I did not post for a long time now because i was in India with my wife for her interview and now my wife is with me in US . Finally we are done with this crazy process thanks to TSC blackhole . Apart from TSC blackhole our visajourney was very smooth.
Updates from the Medical till POE.
1) Medical at MaxMed Center: May 3rd 9AM. It was very smooth experience. Everything was done in order and very professionally and it only took about 2 hours for all the checkups and immunization and x-rays. We collected the reports on May 11th.
2) VFS visit to pay the courier fee: On May 4th we went to VFS office to pay the courier fees and confirmed with them that the visa (if granted) can be picked up from them the day after the interview.
3) Interview at Delhi embassy: We prepared about 10 pounds of paperwork in one briefcase type paper organizer including lods of stuff. We reached there at 7:00 AM for 7:45 AM interview. Around 7:30 they started taking people with 7:45 and 8:00 slots in. I was allowed into the interview area with my wife because i had a US passport. We got a number and then we waited for our number to be displayed on the screen. At first window they took the fingerprints. We waited for some time before we were called again at a different window and at this time they collected the medical report and checked all the paperwork. All of our paperwork was in order and my wife did not have any problem there (A lot of people had to fill some missing stuff and take new photographs at that stage). Finally after some more time our number displayed on screen for one last time and it was for the actual interview. My wife was very nervous and told me not to come to the interview window with her (i also think it should be avoided because then the CO may start interviewing the petitioner as well or petitioner may start answering on behalf of beneficiary which would raise some suspicion). However, she was asked about me and she said that he is here with me but I was not called to the window. She was asked some routine questions like: how did you meet, what does your husband do, where does he work and what do you do etc. Nothing tricky. She did not even have to pull out a single piece of paper from the big pile she was carrying (not even the 2010 tax transcript). At last, my wife heard the words she wanted to hear "you are approved and you should get you visa in two week with your passport". She came to me and told me the happy news (I actually heard it from CO's mouth but i pretended to not know). We asked at the embassy we we can pickup the visa next day from VFS but they said that next day pick up is not available for immigration visa. But we confirmed with VFS earlier and we knew that we can pick it up next day. We were both very happy and left the embassy around 10 AM.
4)VFS office visit to pick up the visa: May 18th: I called VFS at 2:30 PM to see if they have received my wife's passport + Visa packet. They said not yet but they would inform us as soon as they do. After about 15 min. we got a SMS that passport + visa packet is ready to be picked up so we went to VFS around 4 and she had to wait for almost 45 min. to pick up her passport + Visa packet.
5)POE (JFK on May 31): Again very smooth process, i asked the guy responsible for sending people to the immigration counters about which like should we go as i am citizen and she is here for the first time. He told us to go to visitors line. We has to wait for about 15 min. in line and then we were called at the counter. The officer was very nice and commented that your wife has been in India for long now. of which i replied "yaaap ever since she is born" then he clarified that i meant to say "your wife has been in India for long after the marriage". I said yes i told him about the TSC blackhole thing. Then he opened the brown envelope and went through all the document (it had everything we submitted till date) and commented on our wedding pictures and said it looks like a very colorful wedding, a lot of people must have attended it to which i replied yes. He asked me about where i live and about the work and finally asked if my wife could speak English to which i replied that she can but it will take some time to pick the accent. So basically he didn't even ask my wife anything directly. he then just stamp her passport and wrote down the A number and made comment that this A number is so nice there is no way you can forget this. Then he told us to go to area 4 for the green card fingerprinting which only took about 5 min and we were out at the baggage area and i told my wife that now you are officially in US . The only bad part on that day happened when we could not find one of my wife's luggage (someone prob. took it accidentally as we saw couple of similar looking unclaimed luggage). we filed a claim and walked out of the airport. Our luggage has been located and will arrive on Monday.
So that's about it and we are very happy to be together after all this mess and we are also happy that she at least made it before our anniversary. She is adjusting well here and liking it. Now we are just waiting for her green card and SS number to come
