    seriously who would have thought that the N400 interview and the final processing stages could be so prone to complete f#ckups by USCIS? Files that have gone missing, put aside, delayed, half of a file in a service center while the other half is in the field office, issuing RFE's and then saying they received the information when the applicant didn't even send stuff in! and finally an online system that is notoriously inaccurate lol...

    going through the US visa process is akin to walking through a minefield

    any news Sharky? ... Fourth week coming pretty soon. At the end of the 5th I'll get Infopass to see what's going on, at least that's my plan.

    Thanks for the advice (Helpful or not).

    @NickD, I am not sure why Al Franken is not helping! I sent an email inquiry! The first time around, his staff said that I should hear something by Mid August. When mid August passed and I still heard nothing, I called them once more time and never got a response back. Does that answer your question?

    This whole thing is confusing to me...I am curious to WHY this is taking all that time, more than anything else.

    @Shakil, thanks for the advice...I knew it wasn't going to cost millions of dollars to take this thing to court. I must have used the wrong word when I said "sue". At that point, I know the process quite well, but apparently the wording REALLY upset Brother! One correction for him though, it is DHS and not DoS!!!

    I had encountered one strange problem. I had an interview on 19th of Oct at Santa Ana. It was at 11 AM. I got there on time, checked in. Got called in at 11:30. The officer was nice and pleasant. He went through my application, checked some stamps on my passport as I have traveled quite a bit for work. He asked me what do I do etc. Went on asking me civic questions and written and reading test. After he was done, he said your I-130's approval was not in the file but you certainly have a green card so your I-485 was approved. He said until that I-130 is not approved, I cannot approve your N-400. He said, it would take a few weeks as the officer who adjudicated your application for I-485 should have approved I-130 before approving I-485 but he did not. He said wait for a few weeks before contacting us again. Later that day, my case status updated to "RFE issued" and today "RFE received and being reviewed. I called USCIS at 5:55 pm and by the time I got to the second level and explained her the problem it was 6:05 pm and she said your N-400 got approved at 6:03 pm which was two minutes ago :) She said it would take atleast a day for the online status to update and you should expect an oath letter in the mail in the next 14 days.

    You almost at the end of the tunnel....Congrats!

    Thanks to all the responds.

    I sent in copies of what they already have including a letter from my ex wife explaining our difficulties living together and a copy of an apartment lease on both our name. This was our last attempt to try to work out things between us. Since she earned much more then me we never filed togheter.

    If you are in good terms with your ex-wife, maybe she can go with you to the INFOPASS appointment.

    N-400 Returned HELP!

    Hello everyone,

    I sent in my N-400 package on Oct, 10, 2011, and it arrived in the AZ lockbox on Oct. 22nd. I became a permanent resident on Jan,16, 2009, and married for 3 years and 3 months.

    USCIS returned my package today and said I filed before I am eligible?! My package arrived only 4 days before the 3 months prior to 3 years benchmark.(based on 3 years' marriage to U.S citizen)

    What should I do now?

    Wow, nice scenario...not very helpful though. I suggest you keep your sarcasm to less important things Brother. If you have anything useful to say, I will be grateful, otherwise silence can be a virtue.

    I really don't think you will be "suing" the government for not giving you a decision. To my understanding, it means that you are requesting the Judicial system to make a decision about your case from scratch, instead of the Executive Branch (DOH). You are not benefiting from anything because they can still deny your application. Nobody is going to jail or paying big fines out of this process, I'd assume that it would only look bad in USCIS monthly statistics. It looks bad on the supervisors for not using resources efficiently.

    I'd assume that if send a letter to your IO (which you are allowed, if you read the interview results) and mention that 120 days have passed and that you are intending to solve the case through judicial system within a period of time, they will act on your case. And USCIS knows this, otherwise they would not print it in small letters on the interview results. You are not wasting taxpayer's money, it's a right given to you to chose getting a decision through the judicial system.

    3 weeks tomorrow Boilermaker. This poster was ADAMANT in his view and said that is what happens when you get processed TOO quickly :blink:

    I really find it hard to believe that they would go back in to digging through details at the very END of the whole process, if they had something to question they should have done it before now, surely?

    I would think they would study the case before any interview for sure....unless that's what second interviews are for. Today was week 3 for me. I remember the IO said I would get a response within 6-10 weeks but usually comes sooner.....just for approval / denial letter i guess. Doesn't count waiting for OC.

    I need to ask the July filers a question about their N400 interviews..... did ANYONE have their N400 interview before their anniversary date (3 or 5yr) and have already had an oath ceremony scheduled or taken?

    I had some advice on a different post from a well knowledged poster that THIS is the reason for some filers having delays between interview times and oath date updates and ceremonies...

    I heard that's one of the reasons. During my interview I was asked a lot of questions about current relationship, I could not remember some of details about it. So my guess is that they are digging my background or something. How long has it been since your interview?

    CONGRATS Aminesbaby!!! :D so happy for you as you have been waiting a long time. I hope you are right with the making an infopass appointment, I had to change my password on the online updates hoping that would also "do" something but nothing yet lol

    I'm not sure how quickly address details are updated, can you not go round to the old address box and check it anyway? anyhow good to hear things are moving again for you :thumbs:

    Or you could just to to Infopass and make sure they got your address right......Can you cancel at any time? ..If you get your letter right before appointment then cancel then; otherwise, I would just go and make sure they got the right address....assuming it is not a big hassle with work / family schedule.

    lol maybe WE all are :wacko: I hate checking my mailbox when I get home after work, everyday I say to myself "don't check it, that oath letter won't be there and you'll just get pissed" and everyday I go and check it and get pissed :rofl:

    Oh yeah, same here.....especially when I only get coupons that I never use.

    still no news Boilermaker? I've totally lost all hope of seeing anything change with the online status update system now :whistle:

    No news today Sharky. My file is probably forgotten in a corner. We will see what happens within now and next week. Hopefully will get a 'response'. Can't believe the last 'touch' on my file was two months ago according to their system. Seems like counting the days make days go fast. Feels like yesterday when I was counting days to submit my application. Hopefully you'll get something more than : wait 120 days, LOL.

    Everytime my cellphone rings with new email I get a heart jump...maybe I'm going insane...

    Do you guys have a box checked.....'to contact about application, contact officer (last name)" in the Interview Results document? ...... I was also given the "can't make decision at this point". I guess that since i have that box checked, I could just mail questions to IO. It doesn't specify anything regarding what can/cannot be asked.

    I agree Lili, sometimes I wonder why they even have status updates when a lot of people describe how their updates never get updated lol :wacko:

    still it doesn't stop me checking my online account every bloody day :crying:

    I guess a more reliable method would be to check my post box but it would just be nice to KNOW something was coming...

    It is torture not knowing what's coming or when it will be coming....

    Are you talking about form N-652? He checked option A "Congratulations, you have been recommended for approval...". But I may not be a good person to ask as the IO wanted me to do the oath the same day.

    What about you, Boilermaker?

    I got a check saying that "could not make a decision" , the IO said needed to 'review' my file. When i asked whether it was because my 3yr LPR anniversary, the IO said.... oh yeah, that too. wacko.gif. So i'm just waiting. The IO also said to wait between 6-10 weeks for a decision, but that usually comes earlier. They just don't want people approaching their offices every week asking for status, haha...My 3yr LPR was on Oct. 15 so I'm just waiting and waiting..whistling.gif.

    I think my interview was rough. I was in the office for about an hour. Asked me all sorts of questions. The IO went all the way back to the I-130 submitted 3.5yrs ago.

    I hear you on the waiting. Today is my three years anniversary and I am obsessively checking my phone for an update. Did the io tell you what the further review was for?

    Haha...I'm on the same boat. My 3YR LPR was last Saturday. My heart beat goes up every time I get a new email on my phone. My interview was on the 15th (almost two weeks past).

    So I had my interview today and it was not what I expected at all.I was well prepared for Govmt. and US history but i was not that well prepared to discuss my history. I'm applying based on marriage with USC. The officer started by asking the 10 questions, then read the sentence and write it on piece of paper. Then the IO started by asking me questions regarding my relationship with my wife and details about marriage (where I live, why this, why that, when did, when that...etc). I felt like I was going through Removal of Conditions rather than Naturalization.

    Then finally we went through the N-400 and some Yes/No questions. I think i was in the office for a about an hour. At the end of the interview I signed three documents: one that states that a decision could not be made but that I passed the exam (interesting enough, a check is next to a sentence that I can ask any questions by writing to the IO, all i need to do is attach a copy of that paper - I guess there is a thread going on about contacting IO after interview) ; another document stated that I presented my GC; and last document with 6 questions verifying that the info was correct (ie. I'm still married to my spouse, we are not separated and have not filed for divorce and that we live at the present address - I had to write Yes/No).

    Any of you guys based on USC marriage went through something like this? or at least sign those documents i explained?

    Now I'll have to wait for whatever decision. Still I'm days away from my 3 LPR anniv.

    Congratulations on your smooth interview. If you don't mind I ask, when is your LPR anniversary? I'm on the same boat. I have my interview 10 days before my anniv. I'll follow closely your case

    I had a very easy interview today. The actual interview lasted about 10 minutes. The total time I was in the building was 32 minutes including the waiting time. The IO was very friendly. After swearing in I asked him to update my application since I answered 'no' to the question if I ever received citation. I had couple of traffic tickets in the past. He let me updated and said it's not a big deal. He didn't ask for proof of payment for the citations.

    He didn't asked to see any of the documents I brought. He said the evidence I sent with my application was more than enough. He went through the application package and asked some of the yes/no questions. After I signed the application he did the reading/writing tests. I read "How many senators do we have?" and write "We have one hundred senators."

    These are the civic test questions I was asked:

    - What's the name of the national anthem?

    - Why there are 13 stripes on the flag?

    - What happened on 9/11/2001?

    - What's the name of the ocean on west coast of the US?

    - What's the rule of law?

    - How old do you have to be to vote for president?

    He said everything was well but he couldn't approve me today because my three year anniversary is not up yet. but, I should expect the approval letter in the mail soon after the anniversary. I assume my oath date will be either November 9th or 30th. I would prefer October 25th but probably there is not enough time to receive the oath letter in time for that day.

    I will join that boat as well. My interview is on Oct 5th and my LPR anniversary is not until Oct 15th. I'll follow your case closely. I heard some people saying that received approval through status update online a day after LPR anniversary.

    So we just got back home from the interview. It took less than 10 minutes for the entire interview, the guy that interviewed me was pretty nice and friendly. I took the oath and started the civics part of the test, he asked 6 questions and I answered them no problem. Then we did the english part of the test and went over the N400 application. He asked me some questions about my wife and my trip out of the country, etc. After that he told me that they can't make a decision right now because my 3 years isn't until October 4th, but that everything was fine. He gave me the paper that said I passed the tests but couldn't make a decision.

    DavidandMae-I know they pretty much tell everybody in KC office that no decision can be made right now but have you heard of them not making a decision until your 3 or 5 year (whatever you filed for) time had come up? Was just hoping to be looking for the approval in a few days and then the long wait for the oath. Now it seems like the approval will still be a month away and the oath another two months! Any ideas?
