We already know it would be an uphill battle for her to take the child back to Australia when his father is a USC. My question was about whether SHE is likely to be deported, which, according to present policy, she isn't (as long as she has no criminal charges against her). Even if she is out of status, if she doesn't voluntarily leave on her own it's very unlikely the ICE would forcibly remove her. The other cases mentioned really aren't even relevant here because they all deal with parents who had CRIMINAL charges against them which the OP doesn't.

    I wondered why you were asking again, lol. In my defense, you asked "Does this mean that the OP doesn't really have to worry about being removed without her child if she fails to adjust status or remove conditions". As such, it sure appeared the question was relating to the status of the child. IMHO, she should always be concerned. Yes, there is an initiative by the present administration to remove low priority immigration cases from current court dockets, but this does not mean she couldn't still be charged, especially when you factor in a potentially vindictive ex, who is on the hook by virtue of a signed sponsorship. If he makes enough noise to his local immigration/ICE, one never knows. Living an existence constantly looking over one's shoulder is not an ideal one. Perhaps if you had concerns regarding a specific case outside of the OP's, a new thread may be in order.

    No, not at all. Some huge differences from the quoted cases, and the OP's, the most important being the child's father is a USC who the OP is married to. Am assuming the father is listed on the birth certificate and that the child has been processes thru the US as a citizen born abroad to US citizen father. And the father is involved and invested in the child's life.

    As such, without a custody agreement allowing the OP to remove the child from the United States, the OP CANNOT do so, as the biological USC father has certain rights. I have a twelve year old son and cannot take him on holiday overseas without a notarized letter from his birth father who hasn't been in his life for ten years allowing me to take him. I have been asked for the letter both by the airlines and the border control in several European countries. You can and will be turned back if you cannot present either this letter or court document that specifies you may remove the child from the United States.

    Yes, the OP can try to remove the child from the United States using his Australian passport, but if she does this against any court-ordered custody agreement, or without explicit written permission from his father, this will be seen by the US government as INTERNATIONAL CHILD ABDUCTION.... something you really don't want to mess around with.

    If the OP does divorce and chooses to leave the US, she MUST argue for the right to leave the United States WITH the child, and will likely be a large uphill battle, as once she leaves, any other visitation agreement made by the court is unenforceable. Without the father's consent, it may get very ugly and expensive.

    ETA: You questioned what would happen if OP were deported or removed for being out of status; again, that father would be able to file motions to keep the child with him, if there wasn't a custody agreement, and the above info in this post would apply. Those other deportation cases involve children who were citizens by virtue of their birth but don't mention how involved their father is, or if the fathers were in fact US citizens. At the end of the day, if the father wants to keep the child here, the child must stay unless the OP "wins" in a custody battle. It's not an immigration issue here, it's a family law issue.

    Actually, "Singed" confirms he is the same after another user mentioned it in this thread, see Singed's post above, July 30, 12:35 am:

  4. As for the OP, you can marry now. If you can file the AOS before your 90 days, you will avoid the new denial issue. Intent won't be an issue; you've already paid to start the K1. Your INTENT was to complete THAT.

    HOWEVER, the BIGGEST drawback, in my opinion, is you are unable to leave the country to tie up loose ends for much longer than you may want. If you have a lot of things to close up at home, it will take some time to request what is called Advanced Parole. If you DON'T request this, you either need to wait until the entire AOS process is complete to leave the country or will for a certainty, be denied entry back into the country, THEN need to file the CR-1 application (which adds much more expense and time away from your spouse) and wait it out in France.

  5. I would be very careful about marrying whilst in the states under the VWP. My fiance was here (in the US) with me two times under the VWP in the past 6 months, first visit 28 days and second 87 days....

    He has never been here more than the 90 days, always had a return ticket, but still was refused entry. So be careful when using the VWP! We are devestated over this whole thing. I'm now going through treatment and he was to have been with me but the US government wouldn't allow that...to them it is abusing the VWP!!! If one is refused entry under the VWP there is no appeal either. So be careful what you do when usijng VWP... :(

    I'm sorry you are dealing with so much, but I can clearly understand the officer's concern that your fiance may have had intent to immigrate... he himself stated he did. The fact that he didn't have a job to return to, and that he spent the majority of the past six months in the United States clearly sealed the deal. When my ex-husband came over here (often) on VWP, I made sure he had recent paystubs, letter from his boss indicating his expected date back to work, his lease for his flat, return ticket, and printed bank balance statement from the day he left showing his accounts were still open in his home country, and a letter from the person who was taking care of his cat, indicating the date he was supposed to pick the animal back up. He was pulled into secondary interview one time, and was pretty intensely interrogated. However, because he had the correct paperwork and answered the questions honestly (it's a visit and we aren't getting married), they allowed him through. We did, after this episode, consider applying for a visa for his next visit. Keep in mind, though, he still could have been denied under the exact same "intent to immigrate"... only difference is he could sit in a cell for a few days and appeal it. We decided IF he was denied entry, the appeal process would not be worth it, and tried our luck with VWP again, armed with our documentation. He got a stare down going through the booth, but was not called to the back.

    Denied entry doesn't automatically require a waiver - he wasn't deported. He simply will have to get a visa like the vast majority of non-citizens entering the country.

  6. If you are going Android, Motorola Xoom smokes the Samsung Galaxy. I work with these devices daily, as well as ipad, and ipad2,and I always, always recommend the Xoom. The Honeycomb OS is incredible, the touchscreen responsiveness is almost enough to get a keyboard fan like me to want one. If you have a droid phone, the learning curve is almost non-existent. The ONLY downside to this over Ipad is that the google based android system likes to cap ALL email attachments, regardless of provider at 10mb. So if you are getting giant powerpoints, etc., go ipad.

    Verizon Communications, and Verizon Wireless, although affiliated, are TWO separate companies. Verizon Communications and Verizon Wireless do not share ANY customer service representatives/call centers/ tech support.

    Yes, there is a shared "one bill", but behind the scenes it isn't. The Wireless bill is simply billed to Verizon communications, who then bills the customer. It is conceivable to have a zero balance with verizon wireless even if you haven't paid your "one bill" that comes from Verizon communications, as Verizon communications will have paid it for you.

    Further, Verizon Communications will internationally outsource its care and tech support. Verizon Wireless does not.

    Verizon Wireless has an under 5 minute hold time year to date, and this includes some LONG holds on release dates of certain new phones. Most days there is NO calls in queue, except for during a few "dinnertime" hours, and even then, average hold time is minimal.

    I won't get into the ATT mobile vs. Verizon Wireless debate (too much). Is ATT mobile 3G faster? Yep, where you can find it... that's why they're buying TMobile, they don't have enough bandwidth to support all their data devices ( hhttp://www.cnn.com/2011/TECH/mobile/03/22/verizon.att.spectrum/index.html ). It's also why they got rid of unlimited data plans. However, Verizon Wireless's 4G service was just independently tested to be 14 times faster than any competitor's 4G ( http://www.huliq.com/10177/verizon-4g-lte-data-network-4-times-faster-competition-study-shows l ). And Verizon Wireless also just released a new map showing all of its 4G coverage by year end 2011 ( http://news.vzw.com/news/2011/03/pr2011-03-21a.html ).

    indeed i was expecting alot of happiness, i loved my husband so much and he loved me too, but when i came his love started be just words, i cried the second day i landed in the us. when i went with him for shopping and he runs with the cart he scared i m going to buy everything in the store, what happened, is everything is new to me and i need to buy the things i m used to buy in my country, but he didnt answer me when i ask hm what is this, what is that, he runs and he leaves me talking to my self, all he bought i dont know how to use, it is not my confort food, i felt embarrassed and really not respected at all!since then we had problems with everything.he wanted i suspect someone like dough , make anything with it, not a human with diffrent opinion and different traditions!if i knew that would happen iwould never think to get married!oh wow but i have this cute baby, without this marriage i wouldnt have him now!     after i posted the topic, i started to search on google for local organizations who pays rent and help with bills and stuff, the next day my husband called me crying and saying that he is in the hospital, they found him burried in the snow only his hand was exposed,(i think he did too much drugs and he had heart attack, it is just another sign from GOD "repent or you going to die on a SIN!!!")luckily his old muslim friend saw them taking him in the ambulance and he followed him and stayed with him until he woke up, my husband told him everything he did to me, and the guy told him thats why we pray 5 times a day , you repent eveytime you pray, and this way prayer will prevent you from being volnurnable to fall in the sin, he took him from the hospital to the mosque and he stayed friday prayer, he came saying to me "i wish i could stay in the mosque and live there i felt my heart is coming out from my chest and i want to go there everyfriday", he said" i m crawling to get drugs instead of crawling to the mosque ,and i m not working!!!" anyway i seen him started to pray and he wants to buy islamic outfits so the people he knows doing drugs when they see him wearing it they will not approch him as he serves his lord as he said on his words!

    actualy her brother gave me a big gold chain in our wedding, and when my husband started to do drugs she came to my house and took it saying to protect it from being sold! she had the intention to keep it! my husband always told me she played me and i m dam trusted her and i should never let anybody take anything without his consent! he was right but i didnt want to lose the chaine i thought i put it in good hands!! i went one day to her house and i just asked to see it and she showed it to me from far and when i stretched my hand for her to give it to me( my intention was just to see it), she hided it behind her saying no no no!!! :blink: and she went to her bedroom hided it somewhere!i said keep it , it is just the dirt of this life , in the paradize i m going to find much better one,and i left.

    i sent my resume to many companies, stores, and hiresource.com. i m waiting for their call, i m going tomorrow with my husband to a nearby cosmetic factory, he met our neigboor who works there and he told my husband that they need female workers.

    so my plan is call organizations for rent and bills, work, get drivers licence, car, put the baby in day care!and i ll be ok with the help of GOD!!

    i m not considering divorce right now until i make sure my status is fixed, i m scared they deport me and my son stays here as he is us citizen.

    As for the ROC, how much it cost to send the application?

    if my husband is in jail will that affect my application because we re not living with each other!

    my husband was my sponsor , he was a supervisor on brakes factory, he got injured and he got fired, since then we ve been living from the savings we had on the bank after that, he sold $2000 HDTV, blueray, PC, gold chains, my engagement ring( he pawn it and we didnt have money to get it back), everything is gone,we seeked the help of the state and we got food stamps and cash assistance and Husky A .

    i was a public charge will that affect my ROC application?

    Hi, I have been following this thread and I wish you all the best in getting you and your son to a safer situation. I too am in Connecticut, and would be willing to locate charitable organizations, etc., that may help you. I'm sure you know the Newington/Berlin area has a large Muslim community; I'd look in that area first. I also have a close friend who was in a very similar situation (had to flee an abusive spouse - she herself was a police officer, it can happen to anyone), so I can probably get some good resources for you. Feel free to PM me.

  9. So is the battery life an issue pertaining to the OS or the hardware?

    I am not looking just for something "like the iPhone." My wife had to have one as a fashion accessory.

    I figure it's time to step up and am wanting to figure out the best choice available. I've got "guy fingers" and do a decent amount of email and text communication. My BB has no memory and will just do a hard reset randomly if I am simply listening to something Flycast. Also, I want a camera occasionally and my 8830 doesn't have one.

    Little of both. Android OS keeps all apps open, and without downloading a free app called task killer/app killer (and using it), it will suck the life out of your battery. That being said, the newer Motorola Droids are better than the original in that respect, but still lesser than that of your global BB.

    Droid 2 is the only one with a "real" (vs. virtual) keyboard.... right now. But there IS a new "Motorola Droid Pro" (google it, it's been leaked to all the tech blogs, etc) that is coming out soonish, that is the firs Droid that's global, as well as designed (in form and function) similarly to a blackberry, with all the "cool bits" of Android.

    There's also an "HTC Merge" that's rumored online to be coming out this quarter that is also a global android with a full physical keyboard (also google that one). If I were moving from a BB device and wanted to eliminate as much learning curve as possible, I'd seriously look at the Droid Pro.

  10. If you want an interface VERY close to the iphone on an android OS on Verizon Wireless, your best option is the Samsung Fascinate. Motorola's Droid line is good, but battery life is a big issue with them.

    I am a technician for the big red checkmark (a real one, not one of the store "rent a techs"), and play with test devices daily.

One thing I included that I think was a really good idea was a copy of both mine and my husband's credit reports from annualcreditreport.com. It gives all known addresses, and also showed where he was an authorized user on some of my cards, and the accounts noted were shown on our joint bank account.

    I sent my original forms in the week of the fee change, in the end of July, and had our biometrics in Hartford, CT, in early September. So all told, it was about 6 1/2 months in total.

    So to you VSC'rs, don't lose too much hope about the TSC transfers - maybe it's a different "team" who handles the transfers or something!!

    Congrats, but the old TSC cases (those with February to June 2007 NOA1s) actually did not arrive at VSC until yestereday -- so it remains to be seen how much/if those older cases will push VSC approvals back.

    Wow, you're good! I guess the good news for everyone is that VSC appears to be way ahead of the posted processing dates....

    First, Verizon Wirless will not be on that GSM page, because Verizon Wireless isn't a GSM network, it is a CDMA network....

    Verizon Wireless is partially owned by Vodafone, so there is going to be an agreement. HOWEVER, that being said:

    per the verizon wireless website: http://mobileoptions.vzw.com/international...ries/Egypt.html

    Texting is only partnered w/ Vodafone.

    If there is a problem, and your texts are reaching him, then the problem is on the other end...

    This is because every country code and area code must be programmed into the text server. If yours are getting to him, then your service is programmed correctly - there isnt any special programming to RECEIVE international text. If his aren't going, then his carrier does not have your country/area code programmed correctly into their text server.

    Thanks! Unfortunately it must be a different issue though because for the past year and a half or so he has been able to text/call me no problem while I was with ATT/Cingular and my number is a speeddial number on his phone and hasn't changed. I ported my number over to verizon wireless so it should be exactly the same. He's contacting vodafone tomorrow so hopefully he can straighten it out then. Just sucks that I can't hear from him on our anniversary. :( I can call him of course but it's not the same as receiving lil kisses via his phone. :blush:

    Okay, then I am completely stumped... I have a few guesses, but I don't know for sure.... either way, I can imagine how frustrating it must be... My hubby and I lived on texting while we were waiting on him to get here.
