Well, I see it's been about 5 months for you now. I hope they give you an interview on time. Couldn't you have gotten your senate reps involved so it would be faster this time around?

Isn't it amazing that they can declare you married and you didn't know it. I don't find anywhere in the Nigerian marriage act that this constitutes a marriage. We all know that the marriage registry would issue a license to a goat if enough cash was involved. I wonder if they give the gift back are you divorced ?
Honestly, it beats me how they can be convinced that you are married by just giving gifts, yet they would want further proof if you filed a K-3.
Funny how a gift convinces them you are married but not enough as a proof for a K-3 visa... Ridiculous!

Thanks for the concern. I used two of my senate reps almost a week apart. The fist one told me late last week that the consulate replied him that we were married according to the Nigerian custom laws when my fiancée admitted I gave some gifts, hence they could not issue us a K-1 visa. I was hoping to get a positive feedback form the second one who told me she has not gotten any response from them yet and would resend the appeal today. I was still optimistic until I saw the next response to this topic after yours.
Hello Tero,Firstly I'm so sorry for what happened with ur petition.This is exactly what happened to me during my interview early this year,the CO said we were married cos we did introduction and also gave gifts.I later found out from the registrar of Ikoyi registry in Lagos that introduction/engagement are regarded as marriage in Nigeria's customary laws.We were left with no other choice than for my fiancee(now my wife) to come down and quickly went to a registry,collected a marriage certificate then file a spousal visa.
My advice therefore to u is to come down here and get married then apply for a spousal visa just like I did.Why?This is because it took a total of about six months for the embassy to send back our petition to USCIS and for them (USCIS) to reach a decision which they ultimately denied.So my brother,u have just got to be very fast about it,forget about the K1 and move on.

Thanks for the info. Up till now I was still hopeful, I guess I have to move on. Actually, one of the senate reps I am using got a reply from the embassy and was told that according to the Nigerian customary law we were married, hence they would not grant a K-1 visa. I was hoping the second senate representative would give me a better news ...I guess I should not expect anything different from her either. Thanks for the heads up, now I have to plan a trip. Could you please tell me how long it took you to get your interview the second time when you filed for the spousal visa?

What they would need to see to prove your intent to return are any of the following;
1. Any property you own e.g house, etc
2. A business that you run on your own.
3. A statement from your employer in your home country you intend to return to, stating that you are still employed with them and that they are willing to accept you back into the system when you complete your studies.
4. Your family e.g wife and children, that you intend to return to.

i'm really worry right now,my fiance received the i134 this gone thursday,i have notice that on the i134 number 11 i check the intend box and never put anything in the blank.it says that i intend to make specific contributions to the support of (s) name in item 3.will it be a problem if the embassy look at it?is it ok to check the intend box or the do not intend box?pls help me i'm worry.i want to do another i134 and send it before my fiance can take it to the embassy if there will be a problem with this one,i hope not.thank's.
To be on the safe side I would advise you fill the form again and specify in the space that you would be solely responsible for all financial and material needs of your fiance. The consulate officers can turn down your petition for the slightest reason possible, dont give them that chance. Correct it while you still can, scan and email it to your fiance for him to print out. Good luck

You can chose to buy a one-way ticket or a return ticket. One-way tickets are usually more expensive than return tickets, but the choice is yours. Like you have already been advised, do not buy a ticket until u have your visa. Good luck.

Before you buy here, I'd advice you do some research on how much you would pay for customs to clear it when it gets to the destination country. Know that you might have to add up the costs of the laptop+shipping+customs+etc, and compare to what it would cost you to just get thesame over there.

For my case, I sent them loose but organized. I put them in an envelope but had a label tab on top of each supporting documents e.g. tax returns, bank statement, phone records, emails, pics, affidavit, etc.

So,what would you do if you are one of the spouses waiting for quite sometime now in USA for your other half to be given visa and she or he gets denied? The question came from stories I read here about visa denial after 6+ months of waiting..some people even longer,even over a yr and 2... So? WHAT WOULD YOU DO? Re-do it? Move to your spouse's country and live there(because you love each other) or something third? Or you never thought of that?
I'm on that crossroad now myself. I will not quit until I have given it all I've got. You know they really want to get rid of immigrants. If you quit, you would have made them win. Continue fighting and being patient for your better half if you believe you both can live a better life here. If you are sure you'd live a better life in your spouse's country, then relocate. I had posted last week that my husband had gotten a denial on his AOS. We were not sure why.We had only received the email notification and not the official letter. Well, we got a letter today. When David moved here and came over on his K-1, he bought a round trip ticket as a lot of people have done on VJ. He flew here on the 31st of December and the return flight was for February 24th. Of course, he did not fly on the 24th of February. We had just bought it as a round trip ticket to save money as many VJ members have. Well....the letter states that he was denied because he left the country on the 24th of February without having advanced parole when if fact he has not left the U.S. since he arrived here.
Wow! that is very unfortunate. You should appeal to them clarifying that your husband is still in the country. Explain the reason you bought the return ticket. Also, it might help to show up with your husband at the nearest DHS office to you and talk to someone. Good luck.

I've heard some mixed information about whether or not the US Citizen petition for their fiance to come to the US is, in every case, requested to come for fingerprinting? Does anyone know whether they do this in every case, or just in some instances when they find a criminal record?
It is not in every case, and I am hearing this for the first time. I'm a citizen and when I filed for my fiancée, I was not required to come for any fingerprint. Although I don't know if they'll do that once they find any criminal case against the petitioner.

They expire 120 days after their initial approval. Usually Lagos interviews after that so in theory it expires sometime about 120 days after the interview. They sit on it about 3 months then a month in return processing time and it is expired when USCIS gets it. Vermont can choose to reaffirm it CSC usually expires it.
What options do you have to make them send it earlier? If they refuse to reconsider your case can u have your representative make them send it back on time?

You don't have to wait for a decision to file again. If you know you are going K1 again just assume the first petition is expired, state that in your cover letter and then submit a new one, heavily front loaded
For my case, I can't tell if the USCIS would require me to file a K-3 or reapprove my K-1. How long does an original filing take before it expires? If I my petition is reapproved, it is anew right?

Looks like yours took less than a month from the denial date to the date it was received at VSC. How is that 3 months? With the look at your timelines and stuff I don't think you went through the Lagos Consulate.

Our denied K1 took 3 months to the day to return from Lagos to the DHS.
Wow! this is really frustrating! Sending a mail should only take a max of 3 weeks. I guess with your confirmation of the first responder's transit time, I'll have to wait about 3 months as well...really hope there are folks out there that had a much shorter time, to give me hope.

So, they didn't give my wife her CR-1 on her first interview. My father went all the way down there and took off work because I am in school, the return tickets were bought, and they said that they need my original birth certificate and divorce decree. #######? On the NVC packet 3 document, it says that it is not needed for this application. Did the embassy mess up? Or do they really need my original birth certificate and divorce decree? I'm absolutely at a loss for words. No wonder people come here illegally.

Ok so, I got a reply to my email from the Lagos Consulate today. In spite of my whole clarification and appeal and explanation, they said the case is already closed as far as they are concerned, and that they are going to send back my petition to DHS/USCIS. They told me to direct all inquiries about the case to the DHS/USCIS. So cold!!! I called the DHS and explained the misunderstanding, and the DHS told me to wait for my petition to get to them first, so they can review and decide. My representative also said he sent them a note today to reconsider, but he has no guarantee that they'll listen. Told me it could take 2 to 3 weeks to hear anything. At this point, it's a waiting game. Anybody have any experience as to how long it took for their petition to be returned, reviewed and reapproved? It feels so helpless and frustrating to be so powerless!

I was so hot about the rejection I contacted more than my representative. The original CO wanted him to tell her details of what I do at a classified job. Not the name of the company , not the job title, not the general type of thing I do, she wanted details. I ended up filing an attempted espionage report which probably didn't speed the process up but I was required to report such attempts to extract information.
Jeez! This does not inspire my confidence in my representatives at all. So I guess the COs can still be hard headed with the representatives as well.

Lagos is hard to deal with. Our first petition the interview was early August and they claimed immediately after that it had been returned to USCIS and couldn't be reviewed there and it wasn't back in the US for 3 months. We may be the extreme case.
Snap!!! That is troubling. Did you contact your senate representative for that while it took that long?

Wow! you know I feel your pain too! I have given up hope on my appeal. My fiancée wants me to relocate back to Nigeria and leave this country for them, but I know that is what they want. I don't want to let them win ...I'll start all over again. I am currently planning to take a trip down there and get married. Do you think this second filing process will go quicker if I get my reps involved?
