  1. I am in the same boat. Forgot to include my adult, USC stepdaughter (from my USC spouse's previous marriage) on the N400. I have the info ready for the interview but I just realized that I never listed her on the AOS or 751 either. Hope I will be ok. The thing is that there was never any attempt to hide her existence on my AOS, 751 or N400. To the contrary, she is an integral part of all my relationship evidence - on our joint lease, on my health insurance plan, an authorized user on my credit card, a dependent on our taxes, etc. The IO at the AOS interview even asked me questions about her to test bonafide marriage. So USCIS has known her existence all along. But I just never listed her name wherever it asked for "my" children on USCIS forms because I never thought she met the definition of my child until I saw the instructions for the N400. Oh well...

  2. Once again, I am repeatedly surprised by how so many USCIS errors in previous applications get caught by USCIS at the N400 stage. It's almost as if they only do a thorough job when faced with the prospect of a "foreigner" becoming one of their own. When you apply for AOS through marriage, you have to provide divorce orders if anyone had a previous marriage. In my case, my spouse was previously married and the divorce order clearly shows the date on which the divorced parties are restored to the status of single persons. So, why did the officer doing the AOS approve when she/he could have clearly seen the discrepancy between dates?

    Or was this some odd case where the court changed its decision date after issuing the original order?

    Either way, its a sad situation for Maria to be in. My advice to the OP is for her to consult a lawyer (maybe borrow money to do this) - no one on VJ is qualified to really help here other than offer our rambling thoughts.

    Question for the 3 yr rule folks. Has anyone been asked for relationship evidence beyond just tax transcripts at the interview?

    I had my ROC approved without any RFE in December so I am trying to judge how much relationship evidence to load up with for this interview.

  4. In the N400 form, Part 2 it says the following:

    I have been an LPR for atleast 3 years AND I have been married to AND LIVING WITH the same US Citizen for the last 3 years

    The above statement seems to require a stronger condition to be fulfilled than just the bonafide marriage requirements for I-751. i.e. Legit marriages without cohabitation do not qualify for the 3 yr N400.

    Am I wrong in this interpretation? Do they just need proof of continued marital union or do they also require that you lived together for the full 3 years?

  5. My interview went OK and it took about 20 minutes. I passed the Englsh and US history test and was asked the following questions:

    • What is one right or freedom from the 1st Amendment?
    • There are 4 amendments to the Constitution about who can vote. Describe one of them.
    • What is one reason colonists came to America?
    • Who is in charge of the executive branch?
    • If the President can no longer serve, who becomes President?
    • Name one US territory.
    The officer was not very friendly...so be prepared! Now, waiting for the oath letter! happy.png

    Robo. Congrats and Thanks for the review! When you say the officer was not friendly, was it just the usual SF office surliness or was he/she actually being intimidating or harassing when there was no need?

    I have gone through all my USCIS stuff at SF, and I have encountered only rude people so I am really hoping that I get lucky at this last step smile.png

    Guys... i had very bitter experience with my Interview Yesterday... as follows

    I arrived at the buffalo Office at approx. 09.10 a.m. since my Appointment was at 9.40 a.m. Then I had to wait till 10.50 a.m., coz they are 3 IO are working and they pick their PPL before they start their day... one IO was very fast they are ppl came after me and went home before they called my name..

    Officer went through the application with me, name, address, any citations for speeding... then she asked me about my visit to India for 1 year 6 months, then I explained the situation y I had to leave the country...I think I am confusing u guys...

    this is what happened with my green card...I got my green card in Aug. 2004 but I left the country for 1 year 6 months in mid-2007 and came back march 2009 since my dad was not well... there is a Requirement that u have to have 5 years continues residence in USA before u apply u r Citizenship but I have stayed more than year out of the country and Absences from the US for one year or more: Generally, an absence of one year or more shall disrupt continuity of residence, but fortunately as per the USCIS Website its say

    For period in excess of one (1) year. Unless an applicant applies for benefits in accordance with § 316.5(d) , absences from the United States for a continuous period of one (1) year or more during the period for which continuous residence is required under § 316.2(a)(3) and (a)(5) shall disrupt the continuity of the applicant's residence. An applicant described in this paragraph who must satisfy a five-year statutory residence period may file an application for naturalization four years and one day following the date of the applicant's return to the United States to resume permanent residence. An applicant described in this paragraph who must satisfy a three-year statutory residence period may file an application for naturalization two years and one day following the da te of the applicant's return to the United States to resume permanent residence. (Amended 9/24/93; 58 FR 49913)

    I have returned to US march 2009, that means I am eligible to apply my Citizenship. So I try to explain her but she was no mood to listen what u say she was so dumb she doesnt no any laws with USCIS and she has been working with USCIS since 27 years. She said she is going to deny my application then I requested her to check their websiteguys I am not lying she doesnt know how to operate computer too any way I asked if I can open the page and show it to her she refused for that she was keep on saying that they is no rule that I can apply after 4 years 1 day once I disrupted my continuous residency then I tried all my ways to convince her but she was not then I shut my mouth for 5 minutes then she looked over other papers and asked me if I am ready for interview

    She explained me about English and civics test even there she screw me up she said I will ask 9 questions out of 9 I have answer 6. I was so frustrated coz I got IO doesnt know anything about what she has been doing for 27 years.lol. unbelievable

    Here are the interview Questios

    Who is the vice president?

    How many amendments does the Constitution have?

    What stops one branch of government from becoming too powerful?

    What is the highest court in the United States?

    Why did the colonists fight the British?

    What territory did the United States buy from France?

    Any way I was passed English and Civics Test then she has given me the N-652 its says that Decision Cannot be Made yet after the interview , I was very unlucky, I dont know what will happen if they deny my application I am going to court .what u guys say

    But there are ppl before me finished their interviews in 10 min mine was coz of the DUMB IO interview is very easy .

  7. Well.... after 6 weeks I called the 800 number and after a long speech, when I finally could ask my question, they told me to keep waiting, because there is no time frame to re schedule the biometrics appt.

    Second, I tried to send an e request, but I couldn't because my case is still within the time frame.

    Third, I tried to schedule an info pass (and hopes of getting the biometrics done at the same time), and I get it at a different office from the one the appt was scheduled. I live in the middle of WI, I had to go to Milwaukee for the biometrics, now for the infopass they send me to St Paul, MN. Travel time to Milwaukee 3 1/2 hrs. to St Paul about the same.

    Getting tired and frustrated. I am going to call once more, to see if I can get someone more helpful on the phone. If not, I see I will have to wait till the 5 months (time frame for the case) is over, then I can do the service request.

    USCIS is very regimented and formulaic. Everything goes well when things follow prescribed procedures. Any exceptions, even very minor ones like rescheduling biometrics and they can't handle it.

    Sorry to see what you are going through. Was there a good reason that you didn't just try to do a walk-in early biometric?

  8. Well today I got the dreaded yellow letter (which I can upload if people are interested in seeing what it looks like).

    It says "You indicated in your application that you have been arrested. For these arrests and any other incidents in which you may have been involved, bring originals or certified copies of all arrest records and court dispositions showing how each incident was resolved".

    I about had a heart attack! I have NEVER been arrested. So I panicked and thought maybe I accidentally ticked a box and worried how to explain to them that I didn't mean to tick that box/prove I haven't been arrested. But in the midst of my panic I checked the form...

    Qn 16 states: "Have you ever been arrested, cited, or detained by an law enforcement officer (including USCIS or former INS and military officers) for any reason?" and I ticked yes, because I received a traffic citation (long shitty story). I also explained on the form that it was a traffic SO i need to take (which I had already planned on) my citation notice (which I have) and my court disposition (which I have). I'm also going to ask the court to send me proof I've paid the fine, maybe even a transcript... we'll see smile.png

    So there you go. My husband and i think it's an automatic thing, that if you ticked yes to that qn, even if you explained it in the explanation part as "just" a traffic citation, expect a yellow letter! No drama.

    Uh oh. I checked yes for 16 too and for the same reason, a speeding ticket. However, unlike you I don't have the citation. All I have is a letter from the court saying that they received my money. I guess this should be enough? By the way, this ticket was in 2004. I thought they didn't care about anything more than 5 years old?

  9. I got a second update today that my interview has been scheduled. Wow! No updates for a long time and then two steps in one day! I better start studying.

  10. Thank you Otta. As you can see from my previous post, I am now suddenly in line smile.png The stark differences in different parts of NYC shows poor organizing by USCIS. They could easily distribute the workload. I hope you get scheduled soon.

    On your background check question, I honestly don't know what they do and when they look into your background. A few years ago when thousands of cases where in limbo in the FBI Name Check step, USCIS would not schedule interviews until that was resolved. But I have heard that those name check delays are now history. So, I am not sure what the new procedure is.

    Nimaan and Indomex:

    Hang tight! If you think about it, being "in line" doesn't mean much. Some people get put in line and then get an appointment very soon after; hopefully this will be the case with you! Others, like me, couldn't care less about being in line, because it still takes approx. 4-5 months to get an interview appointment after that (sadly, this is the timeline for parts of NYC).

    Out of curiosity, do we know when background checks take place? Is it before you are put in line, or just before you actually get an interview date? I'm curious what some immigrations people will think about the organizations I belong to, hehe. I hope USCIS employees are under enough supervision not to let their personal beliefs interfere with the process.

  12. Boy it's no fun being last. Still no in-line notification. I guess USCIS knows that I don't like standing in lines tongue.png . It looks like they always wait until you are 30 days or less away from being eligible to naturalize before they put you in line. And since the gap between interview letter date and the interview is almost always 30 days or more, no one gets interviewed prior to full eligibility.

    Either that or I am just stuck in the infamous background check... crying.gif

  13. I recall being asking by the DMV employee if i wanted to register (Iowa). I said no thank you so I don't know whether it was just a tick box at her end or what.

    If it was just a tick box on her end, that's scary from an immigrant perspective and the main reason motor voter worries me. I've been to the DMV to get or renew a license 3 times in 2 states (TX and CA) and for the life of me I cannot recall what documents were asked for and what forms I filled out when I was there. I vaguely remember showing my passport in TX but I cannot recall what they asked me for in CA.

    I am usually pretty scrupulous about reading stuff before I sign so I don't think I would have signed any voter registration form since I always knew from day 1 in the US that only citizens can vote. And my AOS was almost 5 years after those visits and I was approved. And I don't recall receiving any voter registration cards from the county at any of the places I have lived.

    I assume they check voter registration rolls for AOS applications?

  14. Just got a Yellow letter - says " This is not and Interview Notice " it has recommendations on what to bring ....So does this mean we are in line ??? I never got notified of anything ...

    I would think they would just send a regular checklist like that along with the interview letter. In your case, are they asking for something in addition to the normal doc requirements like additional evidence of marriage etc? If not, I wonder why they sent you that before placing you in line.

  15. Completely agree! It's definitely helped me feel less "behind the ball" when other people are getting stuff before me but filed after me.

    Thanks to you for coming up with the idea. Hopefully subsequent months will make that a standard column.

    I feel like we can actually eliminate the Check Cashed and Sent Date columns and lose no useful information. But reasonable people may disagree smile.png

    @Nimaan: You, lidotomato and I are the only active topic members who are yet to get in line so we are definitely likely to be one of the last of April filers to finish up sad.png

    But I am not too worried yet, since I am still within my 90 day early period.

  16. Thanks for the info all. For anyone else who wants to know about this.. It looks like the implementation does vary substantially by State. In my state, California, DMV does not send any voter registration electronically, although individuals can e-register from their own computers. At the DMV, you have to fill out a form and sign it, so less chance of immigrants getting into any trouble. However, some other states apparently do have their DMVs participate in electronic voter registration. For immigrants visiting the DMV in those states.. don't do it with a hangover. Be alert :)

    And finally, if you are mistakenly e-registered by a DMV employee, the county elections office is required to send you a voter registration card by mail. So, if something like that shows up in the mail, you will know that you've been registered and you can immediately contact the county to get yourself unregistered. And then, if applying for citizenship later, have a lawyer on hand and a detailed explanation of how this was not your fault...

    Boy, so many pitfalls to watch out for...
