If she wants to apply on her own once the two years are done and you are divorced, then she will have to prove that the marriage was entered in good faith; the burden of proof will be more heavily weighed in order to prove a legitimate marriage. There is nothing you can do to stop her from filing when the time comes. I am very sorry for your situation but you should divorce her and try, as best as you can, to move on with your life. Whether or not she will get her 10 year greencard will be up to USCIS. Best wishes!

How will I be notified about receiving my passport once the visa is issued?
I believe this is country specific, so other Jamaican members may have more accurate information. For us, we had to pick up the passport with the attached visa and the sealed envelope at a mail carrier service in Santo Domingo.

What is the process after the I-130 has been approved but the beneficiary has been banned from the USA?
You need to give more details. Why was the beneficiary banned? Depending on the reason this person may be ineligible to ever enter the USA again. Share more details of the case if you would like accurate answers.

Did you get married? If so, you should file for your adjustment of status. The visa was a one time visa used to enter the country with the purpose of marrying in the US. You should get married within 3 months of entering the country and you should file the AOS as soon as possible or before your visa expires.

A normal (non-life-threatening) pregnancy is also not a valid reason to receive a medical expedite. Why should you be able to jump the queue in front of others who have also had to wait, just by virtue of your sexual activity?
Not only by virtue of sexual activity but by virtue of poor planning. It always amazes me how women (petitioners and/or beneficiaries) would CHOOSE to put themselves in that position when it is still not certain whether the visa will be approved!

Since you don't have enough of an income with your SSI in order to sponsor an immigrant, then you need a co-sponsor. You would need to make sure that this person's income would be sufficient according to the guidelines and they would need to sign the affidavit.

I have never heard of such a thing. Since all other people are eagerly awaiting for their citas, I doubt there would be cancellations. There might be people who don't show up to the appointment, but that does not make a space for those who desperately want an earlier appointment. You can try calling the Santo Domingo consulate directly and ask, but I have to tell you that I did call and someone did answer me just to tell me they were closed...

Why would you be afraid of contacting them? The call doesn't cost you any money. So call! I can't stop telling Santo Domingo people that because I called is how we found out the interview date because my fiancé never received the "packet" or notice of the interview. Call!!!

Unless your condition is life-threatening then it's unlikely just being diabetic will be enough for a medical expedite.
I agree with the post above. Diabetes is a chronic medical condition that is common and manageable. Unless you are in the Intensive Care Unit right now because of it, I doubt that they would expedite your petition based on your condition.

Since you are the beneficiary he may feel "entitled," in a way, to you. He does have the power since he is the petitioner and he might feel as though you are being unreasonable. I do not fully understand the culture but I think it inappropriate for him to talk to his family about your issues as a couple. I would encourage you to really think about whether or not you can forgive his infidelity and whether or not you are ready to leave your country and your life in order to be with him. You could be losing a lot if you are not entirely sure of this journey...

I am so happy my fiance sent on june 7 only the check and the form i-129f , nothinh else.
I was waiting a deny.
But on september 17 my fiance got a noid, uscis asked him for all the papers missed.
He sent on october 10 his passport copy, form g325 , intent to marry letter, plane ticket, photos etc, all evidence.
today i saw on uscis page that they got everry thing and that they are cheking.
I hope every thing is going to be right.
God has blessed us with the noid, because many people got a deny when send incomplete petition.
I wish everybody that sent the petition like my fiance get the oportunity to send the missing papers and be lucky with the process.
You were lucky in that they did not flat out deny your petition but instead gave the petitioner the chance to submit all of the missing required papers and evidence.

im so frustrated my bf applied for k1 in march we have been in initial review for 8 month and now i go to check my case and i found they are asking me more evidence wow why they do that im pregnant i just want to be with my bf, get marry and raise our kid together. any body knows what kind of evidence they request.
At least they are looking at your case. What kind of evidence was submitted? You obviously need to gather and send more. For example, copies of boarding passes and hotel reservation to go see you, copies of remittance receipts, chat and message chat logs, phone and cell phone bills, pictures, etc. Anything and everything to prove that your relationship is legitimate!

I've never heard or read about a visa being granted in the DR without the petitioner present. Tu prometido tiene que estar presente porque sin el no te aprobaran. At best, you could hope for an open "cita" but they could also refuse the visa outright. I repeat HE HAS TO BE THERE to even hope to be approved!

Yes, they can refuse you outright without putting you un AP. Before you even get married I would make sure that you fix the reason why you were refused. Was the affidavit of support not sufficient to support your fiancé? After a K1 refusal it would make more sense to get married and go that route. Keep building evidence and a better case for next interview.

You can send a letter in your packet which explains your name change situation. You should include photocopies of your passport and the passport stamps as part of your proof of relationship. Is your passport going to expire soon? If yes, I would process the new one with maiden name. Otherwise, the early request of a passport doesn't seem necessary.

I am about to send off a petition for my fiancee K1 visa...and since I was recently divorced in Feb 2013 I have not changed the name on my passport from my married name back to my maiden name...I have changed my social security card and Drivers License but my passport I have not and wondeeing if I even should. ..bc all my 4 TRIPS to see my fiancee w the entry and exit stamps are in this current passport which has my married name on it....so if I xhange it to my maiden name the new book will not have this ooo so important information in it....so should I just lwave it thevway that it is bc I have my divorce papers showing the legal.name change or what should I do .. help meplease.

My then fiancé never received the letter or the packet. You have to be proactive! I called the NVC and that is how I found out about the interview date. I also had to request a "duplicate" packet because my fiancé never received his packet (he had to pick it up in person in Santo Domingo).
The consulate in santo domingo sent me an email saying that my case is ready for interview. And told me if 2 weeks pass to contact them...does that mean im getting packet 4 within 2 weeks?
