  1. I am a Self-employed Consultant and file both an 1120-S for an S-Corporation and a 1040. I am not sure which amount to use for my 2009 Individual Income. I paid myself from the corporation $35,000 and this shows on 1040 Under Schedule C - Income: Gross Receipts/Sales of $35,000 and on the first page it shows Business Income or Loss of $25,690.

    There are 4 people in our household (me (sponsor), my husband (benificiary), and 2 children). 125% of the poverty Line for 4 people for 2010 is $27,562.

    It makes a difference which amount I use as to whether or not I will need to provide proof of additional income. Can you give some guidelines on which figure I should be using. 2008 and 2007 are pretty much the same thing.

    As per instruction on I 864 Question 25 says adjusted gross income is required which is line 37 on form 1040

    I have put N/A on this question actually

    I did some research i found this line by line instructions http://www.***removed***....n-relative.html that goes through each of these questions and supports my opinion but not trying to convince anyone with it though, i am just mentioning it and i am learning from the process.

    I agree with you the question is "complete if your relative is in us and will apply for adjust of status"

    if not in us then the answer should be N/A

    I also put N/A on all three lines.

    I feel like a part of this good community now.Filed 3 petitions for my spouse and 2 kids on Oct 4th at the Chicago Lock Box. Got email and text message 2 days later.then checks were cashed and received email and then hard copy of NOA1 dated 12th October.Now I have been trying to access my case online by putting in the receipt numbers but it keeps saying the number is incorrect. Called on Tuesday at the 800 number. Finally got a live person to talk to who was outright rude and nasty. He says since the case has been routed to California Service center I need to write to them for any queries or just sit and wait for 5 months which is the usual processing time. So you see the rock and roll begins.:bonk:

    I don't know if this is relevant or not but I filed I 130 in Oct and received NOA1 saying my case has been routed to California Service Centre for processing. I hope this is normal and by the way I can't access my case online cos it says the receipt number is incorrect. Talked to a live person on Tuesday who said I will have to write to CSC for any inquiries. So I don't know if they are sending all new cases to CSC .

  5. Hi folks

    I sent the i 130 packet for my spouse and 2 kids on 2nd Oct to the Chicago Lock Box and it was received by Uscis on 5th Oct and it has been forwarded to the California Service Center. I received a notice in mail with the receipt numbers dated 12th Oct. So now when I try to access the Uscis website to check for my status updates It says receipt number not found. I called the 800 number too and the machine says that the receipt number is wrong. So what do I do? Is the receipt number actually wrong or is it not in the system yet?

    I am sure I am using the correct 13 digit number starting with WAC with no spaces etc. Anyone can help.

  6. I didn't send a single sentence of chat or even a single picture of us. I didn't even send a cover letter like everyone else here seem to do. This is all I sent

    • I130 form
    • G325A for me
    • G325A for her
    • Copy of my citizenship certificate
    • Copy of my passport
    • Copy of our marriage certificate
    • Copies of our birth certificate
    • Her passport sized pictures

    I received my 130 approval in 158 days. The conversations between my wife and me are personal. No one, absolutely no one, has the right to see them. To want to see them is gross violation of our fundamental human rights. Marriage certificates are legal documents admissible in all courts of the world as proof of marriage. That is what's sufficient for USCIS.

    I understand it's different if you are applying for a fiance. The burden of proof lies on the person since there hasn't been a legal/civil marriage yet.

    My thoughts exactly Indigoskies! Thats what I have sent in the I130 package.I will show only the log and no chats when asked for it.

  7. Guys on my I-130 for my spouse and kids I have a query. On question 22.if my relative is not in the US do I still fill out the American Consular post abroad or do I write N/A?

    I have been around for a while absorbing all the good info you guys give.

    I am a naturalized USC since 2003 and want to bring my spouse of many years and my 2 kids here.I am thinking of going the K3/K4 route than the I 130.

    The income tax returns that i have to show are filed married filing single.But someone told me recently that the filing status should be single since my spouse is not with me.Which is correct?

    Secondly the birth certificates issued in India do not have the new born child's name on it, just the mother and father's name.I heard Immigration needs the child's name on the BC.How to resolve this issue?

    I would appreciate your replies.And you will see a lot of me around.
