  1. I am sponsoring my wife (principal immigrant), a 20 year old, and a minor 15 year old. I am filing an I-864W form for the 15-year old meaning he is exempt from Affidavit of support.

    Including myself the family size is 4.

    In the I-864 form, do I have to mention my 15 year old in question#9?

    If not, then do I have to mention him in question#21, part d, as a dependent child?

    Having filed I-864W for a minor, does the sponsor's income requirements change from 4 to 3 people?

    Jaan I had a RFE for the birth certificates for my two children because they were not made at the time of birth. So they wanted to see more proof of biological relationship from their childhood years to make sure I am the father.I think this is a standard procedure for them to ask for this for any BC that has been made recently. I had tons of evidence to provide so I breezed through the RFE. Hopefully they won't ask for any evidence at any later stage cos they have plenty of documents and pictures.

    Hey Novella Many Congratz. We will rock the NVC together. We need to get a case number by calling in at 603-334-0700 (takes about 1-2 weeks I guess) and once we get that go ahead and give the email addresses to the operator next and get an IIN (invoice identification number).

    Lets get here first and discuss the rest later on. Good Luck :)

  5. Ok folks here I am . Back from India:) collected all the documents for more evidence.Sent the RFE on 7th March...was received by them on 8th and today I check my receipt number on USCIS website it says PETITION APPROVED on March 9th.:star::D:dance:.I could not believe my eyes. So I get to meet my family and then my petitions get approved. Can it get any better than this??? Except of course bringing them all here.

    So all October filers and the rest of you keep those torches burning, you will see approvals soon.

  6. reeman , I would like to know how your case is going since my case is a little similar to yours as I have 2 children for whom I filed IR-1 with my wife. One of my kids is 15 and the other 20 so I know I need to add I-864W for the younger one.

    Can you guide me a little through the AOS procedure? Number of people in my household remains 4 including myself so even if I file for a waiver for I-864 for my younger one do I have to show income for 4 people in the household according to the poverty guidelines or does the number of people change to 3? thanks in advance.

  7. thank you everyone for all the replies. Yes pushbrk I did file separate petitions for the 2 children. One is 15 and the other one is 20 yrs old. So I am looking to file N600 for my younger one only after he arrives here, but I guess my 20 year old gets a green card right?

    Yes I do have lots of pictures with my family from their childhood and recent years. I also have an old "Rashan card" ( a govt. issued id for low cost ration and fuel purchases) from their childhood address on it. I can provide some school records, copies of biographic information pages of the passports. Is this enough?

    I want to make the trip to get affidavits from 2 relatives , the mid-wife and the "pundit"( priest who did the children religious ceremonies. I hope to expedite things by going there myself and collecting all evidence in person.

    I have been given until March 10 to respond with the RFE evidence. I know I will cut it tight but I rather have a complete package to send so that more time is not wasted.

    What do you guys think? Should I send just what I have or add all these affidavits too?

  8. Well to be exact it says that the petitioner has submitted a birth certificate of child that has a delayed registration of 15 years ,

    the petitioner is required to submit secondary evidence to establish the claimed biological relationship.and then they list some examples of evidence like

    midwife/ doctor/ hospital certificates

    church/priest certificate

    documentation showing parent's and child's primary residence during child's childhood

    school records showing both child and parent's name.

    old family photos taken with the person with whom the petitioner wants to establish relationship

    old correspondence

    Insurance policies etc

    miscellaneous like ID's, census records, passports, income tax returns records of family events etc

    Evidence submitted is not limited to these type of documents. The only persuasive documentation will be documentation that indicates child's parentage.

    Evidence that originated back when the child was young will be more persuasive than evidence that was created as the result of this RFE.

    If secondary evidence is not available then we need to submit evidence of non- existence. After this tertiary evidence like Affidavits in form of written statements

    from at least 2 persons living at the time of the event with their names and relationship to petitioner and / or beneficiary can be submitted.

    The petitioner also has the option of having a DNA test done by any AABB- accredited lab authorized by USCIS.

    I have paraphrased most of the stuff in my RFE so hope everyone can understand. Has anyone been in a situation like this? Any advice would be greatly appreciated.

  10. Since you are planning a trip to India, apply for Consular Report of Birth Abroad (CRBA) for your children at the American Citizen Services section of the U.S. Embassy.. They will be issued U.S. Passports, and will not have to obtain visas.

    I don't think this would apply to me since both my children were born before my naturalization. Therefore they need to be issued a visa to come here.

  11. Folks I did not get any NOA2 yet but I got an RFE for my two children.That's the bad news but the good news is that they are working on my case...so cheer up October filers.

    Since my wife had the two child births at home we never bothered to register the births. So we recently got their birth certificates and now the USCIS wants secondary evidence to prove that I am the father of my two children. Out of the list of all acceptable documents I think I can get the mid-wife's certificate, our priest's certificate, school records, photographs and copies of their passport's pages. Also affidavits from relatives etc.

    Do you think this is enough? Do we need to send anything else? I am even ready to for any DNA testing. Do I need to tell this to them? Although its a little scary but I am finally happy that something is happening.

    I am thinking of planning a trip to India soon to personally gather all this"secondary evidence" and also bringing back the PCC to get ready for the next stage. You think I am missing something Please advise me.

    By the way I heard no request for anything for my wife so I am assuming all is good there. After I send my RFE's in I get all 3 approvals together, right?:bonk:

  12. Check out my time line.I am an October filer and it still says "case not found". I have stopped worrying about all that according to the advice of some wise guys here B-). I suggest you do the same and start focusing on the Pre NVC preparation. Good Luck.

    Anyone active here who filed in October / early November and the case transferred to CSC and receipt number not in the case status system?

    I filed I-130 10/29/2010 at Chicago Lockbox; case transferred to CSC and not in the USCIS Case Status System till todate. Trying to identify fellow VJers in the same plight, so we can keep us informed if there is any progress.

Well guys, I was doing some research of my own on this forum and found out that I need to file I-864W for one of my children who is under 18(15 years to be exact) so my question now is that do I need to change the the total no. of people I am sponsoring in my I-864 for my wife and my other son who is older than 18 years, that would be question # 21 part a and b as shown under:

    I know my household size would remain the same but if I file a waiverfor I-864 for one child who is a minor and would be covered under the Child Citizenship Act do I have to show the income for 2 other people I am providing an Affidavit of Support for or it would be 3 people in all?

    It seems so confusing to me.Any help would be greatly appreciated.
