  1. Just updating on this thread.

    My wife had her interview today and was approved. They barely asked any questions.

    Her visa will be ready in about a month.

    I will update once I go back and travel with her to the US.

  2. A tax transcript won't be ready until the IRS has processed and accepted the return. If you don't include transcripts, then you need to include the ENTIRE tax return. This means the 1040, W2s, 1099s, schedules, worksheets, etc. Basically, everything that was sent to the IRS has to be sent to NVC. You'll need to include a letter as to why he did not file in 2010 and 2011 (NVC doesn't care about the earlier dates as there's no questions on the I-864 about those years; only the last 3 years).

  3. Hello everyone! NVC received our papers at last after 55 days from approval. We waited so long for this and thank God finally. We got already our case number the other day and now waiting for AOS bill. I already sent the DS-3032 via email. I am the beneficiary. I also sent an expedite request due to my husband's health condition and it is still under review. I have questions to ask. My husband filed his income tax return last month via snail mail and he called the IRS today to order for a recent transcript and they don't have his record yet. Is it okay to send the AOS packet without the transcript yet? but he has w2, form 1040,recent pay stubs and letter of employment. We will have a co-sponsor and he can provide the ITR for the past 3 yrs and other reqts. My husband didnot file ITR since 2007-2011 for he was unemployed. Do you think, we will have problems on him not filing? but he has a permanent job since aug 2012. Thank you very much for your answers.

    I felt your sentiments guys..Though I am not waiting for approval from our I-130, we got approved last Feb 12(thank God) and now waiting on NVC. We requested an expedite for our papers but was approved last Feb.. My hubby (USC) has cancer and next month will be his surgery. It is very hard for me too because I wanted to be there for my hubby during his surgery but it is very impossible for now for our papers haven't reached the NVC yet. I couldn't understand things but I'm doing my best to simply trust God's will. There were many times I cried and told my hubby to call to follow-up but it is too early yet for we need to wait for 15 business days to call. There were times I lost my patience and trying to push things the way I wanted but later I realized that there are things here on earth that are beyond our control and all you can do is sit back, relax, pray and trust God.     I am a USC and my husband is from Argentina.

    We both are in living in Argentina and filed the I 130 petition at the chicago lock box.

    The USCIS recieved our petition on Nov. 15th 2012.

    On Dec. 14th 2012, we recieved an I-797 NOA "Notice Type: Approval Notice Section: Husband or wife of U.S. Citizen, 201 (b) INA"

    I'm confused and think they may have made a mistake, because it reads:

    "The above petition has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain form I-485, Application for Permanent Residence. A copy of this notice should be submitted with the application.

    If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file form I-824, Application for Action on an Approved Application or Petition, to request that we send the petition to the Department of State National Visa Center (NVC)."

    He is not in the US, both of us are in Argentina. Is this what the NOA normally says? Should we just follow the second part of the instructions and filled form I-824 Application for Action on an Approved Application or Petition?

    Any help you can give me would be great, I'm really confused!

    Hello.. How's your papers now? My husband also receives the same letter you got that the beneficiary is in the US and will apply for adjustment of status. May I ask what did you do to correct this? Thank You

  6. this makes me wonder as to why some of you guys are going for interviews at your respective local field offices.

    are some of you been married for less than two years? did you present other evidence besides the basic requirements USCIS has asked?

    my wife and i have been married over two years (it will be three this august 8) and the US Veterans Affairs (another US government agency) recognizes her as my wife which is probably why i didn't get called in for a interview.

    honestly, i just gave a certified copy of our marriage certificate, paperworks from the US Veterans Affairs stating they recognize her as my wife, and a copy of our US Dollar bank account in the Philippines. nothing else...I even lived in the Philippines from March 2011 'til October of last year.

    please chime in cause like i said, i am curious as to how many of you have been married within the last two years have been told you have an interview at your respective local field offices. also if you've been married for more than two years and told you have to go in for an interview.

    Me and my hubby have been married for 5 years. My hubby was interviewed in the local field office and was approved on the same day.

  7. So, my expedite request is in front of an adjudicator and the deadline for making the decision is today. Unfortunately, it is 4:21 pm EST on a holiday weekend and no decision has yet been made. :whistle:

    I am hoping to hear a good news from you. I just found out from my hubby that the officer told him "this ends your expedite here". I was surprised because our case was expedite but after 3 months.. We will do also our best to ask for an expedite in the NVC, hoping it will be granted too, God willing.

    Would you mind sharing what they asked him?

    It seems that there are some who are being interviewed and some who are not (meaning the USC).

    Sorry for my late reply. The officer asked my hubby about our marriage like if it is fraud or not ( he asked this question for 3x), how long you've been married, did you live in the Philippines and for how long and were your parents aware of this marriage. those were the questions asked. By the way, congratulations on your approval. God bless
