Many people are talking about it today on forum. And mine changed too. It looks like USCIS cut status category down to just 4 because they never used other category
As I remember, nobody who got RFE saw "RFE" on status, nobody who had interview saw "Interview" on status at least at ROC ...Make sense! Thanks for the update.
-
From this morning, my case status is displaying only 4 steps (Acceptance, Initial Review, Decision, and Post Decision Activity). However, yesterday it had RFE and Testing and Interview steps too. I am wondering does it mean anything or just a technical glitch? Anybody has more information??

Attached is a fact sheet regarding "USCIS Background" checks. Interesting information.

Well, at least you know what is going on with your case, I really do not why they are taking forever with background check, they were supposed to do it when whe fill out for I-130, not for removing conditions.
What my understanding is that by regulations--USCIS has to run an IBIS query, if previous IBIS query was older than 90 days, before making any decision the case.
-
Yes, good point. I guess if the name is common, there could be a delay. I'm hoping for a speedy decision in the affirmative for you!
It's not like my name is common also doesn't resemble with any so-called "high risk group of people".
-
Hmm. Sheesh, I do hope that they will make it a speedy decision for your sake. I've never received a letter like this during AOS and ROC. The letter is at least very clear which isn't really much comfort because the window limit is 6-months; not very convenient at all!
I would just revel right now that you are still a permanent resident and wait it out. I know it's easier to say that than anything, especially since mine went smoothly. But, with respect to the timeline, there isn't much you can do to speed it up. I' praying it hastens for you! Be positive and we're here for you.My guess is that it's not only the background check but they also evaluating the facts of my case.
Thanks for your best wishes.
Will keep you updated.

Hi All:
I received following response to my service request
“The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is complete, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefits you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.”
I have following questions, if you have some more info about these
1) Does that mean that USCIS has not examined the facts of my case?
2) Is this purely a criminal background check like—finger print, name check, Interagency Border Inspection Services (IBIS) check?
Also wondering if someone has received a similar kind of response to their service request? My understanding is that USCIS sent all these responses based on typical templates, but not based on individual case.

That is really really weird. That is the first I have heard.
What is your current country of citizenship?
India

You have two options at the moment.
1. You can get an infopass since the 6 month requirement has been met and see if they can investigate what is taking so long...
2. Contact your local congressman and get them to inquire on your behalf.
HTH
Also you can open an service request by calling 1800 number. I already have opened it last week. So let's see if that moves anything on.
-
As my case is still in "Initial Review" phase and outside of USCIS's target window(6 months), today I called 1800 number and opened a service request. I was told over phone that I would hear a response from USCIS in next 30 days based on today's service request. Hence, I would encourage to the people who are outside of target window to give try on 1800 number.
Mr.2100: Have you heard anything on your case?

WHAT IS WAIVER FILER??
“I-751 Waiver” is an application that you file if your marriage to USC is ended in a divorce or your USC spouse is not alive. It is a good-faith waiver application. Looks like you are still married to USC??
-
WHAT CAN I DO IF I FILL OUT IN JAN 21, MY LAST UPDATE WAS ON JUN 26, AND IT STILLS ON INITIAL REVIEW, ALSO I WAS TRYING TO MAKE AN INFOPASS APPOINTMENT, BUT MY NEAREST OFFICE IS NOT TAKING APPOINTS.
IM SO STRESSED, I DONT KNOW WHAT TO DO, EVERYBODY IS GETTING THEIR GC IN LESS THAN 5 MONTHS .
I would say that you should wait for one more month. Today I have completed 6 months (NOA--01/13), and I am too still in the initial review. Mr.2100 is waiting from December, 2009. Every case is very different, so you can not apply 6 month rule to each one. At this point you or I cannot do much (it is out of our control). By being stressed out the outcome of the case will not change. I am too going to wait until the end of July and will then make an infopass appointment if I don't hear anything back from them.
Can you make an advanced infopass appointment for September in the office nearby you?
-
Hello,
I think the evidence seems quite sufficient.
I am also waiting for the I-751 waiver which was sumbitted in Feb 2010. Could anyone tell me how to see/find "touch" on the USCIS website ? I havenot seen any status change in a while.
Thanks
@ ARRYGOLD: There is "touch" option on USCIS website. But if you have opened your portfolio on thier website, you can see the "last updated" date on it. So what people are talking about "touching case", means their "last updated" date was updated. Hope this helps. What is your timeline?
Also I guess you are not included in our list. So can anyoneplease add ARRYGOLD is the list?
@ MR2100: I guess, you should now make an infopass appoitment/ service request to see what is happenening? You can always make a call on 1800 number.

Any word from you guys?

Nothing from my side. No action sicne 06/26. Looks like many people's files were touched on 06/26. My guess is that they will take more 3-4 weeks to convey a word on the case.
-
Case touched on 06/26. Hoping for a decision soon. God help me.
They have touched my and Mr.2100's case on 6/26. My guess is it may be an automatic action, doesn't necessary mean any actual progress. I may be wrong. Does anybody have more knowledge about "touching case"?

Oh ok - Thanks 'iamwhatiam80' -- Did the officer asked you for your NOA when you came back into the US? I just want to ensure that i would be ok to travel.
I travelled to Canada by car on the weekend after filling I-751. My physical Green Card was expired by then. I had kept NOA (1 year extension) with me on a safer side. However, the officer wasn't cared for expired date on the card. On the way out to Canada, the officer pointed that my card is expired, I explained him that I have a notice of 1 year extension with me. He did not bother to see the notice (they don't care while you are going out of the US).On the way in to the US, I showed the GC and NOA to the officer. However, he told me that I was kind of 3-4 guys that day that travelled on the expired Green Card. He also said to me that those guys were not carrying NOA with them. So it looks like if you have a Green Card, they are okay with it. Also when the officer was reviewing my documents, the other officer asked to the reviewer officer if I need AOS (adjustment of Status), but the reviewer officer told him--"No, he has Green Card with him". So my guess is that that can also adjust ones status on the border too.
This was my personal experience, doesn't mean that they will handle every case like mine. But just to be on a safer side, carry all necessary paperwork with you (I would carry the copy of whole I-751 application with me, so they know that your application is under review).

p.s Luck doesn't exist. Fate does

Thank you, OKALIAN...This is helpful. My pakcage has almost all things what you had. However, every case is diiferent. Let's see what happenes.
-
Welcome to the waiver thread I751. I see that its been 6 months since you applied. I dont know why they are so slow on the waiver cases... All the joint ones are getting approved so fast.
By the way oklaian's case looks like an exception. He was just lucky. Hang in there... Our turn will come soon.
Looks like USCIS want to scrutinize "Waiver I-751" thoroughly. I guess we are presumed fraudsters in their view. However, looks like CA service center has higher rate of approvals than VSC.
I was wondering if OKAIAN is willing to share his story, so we can benchmark ourselves against his case.
Thanks Much.

Hi I751,
You need the Receipt Date on your NOA letter for the list. Once you give us the date, we can add you here and "Waiver filers" list

Hi Yurika & Jim: Sorry--Receipt date was 01/13/2010
