  1. My husband (USC) just mailed our I-130 this morning. Will post again when we get our NOA1.

    Congrats on your two for the first step in this immigration process!!!! Start looking into the following steps and procedures that come after NOA 2, this being prepared and educationed for NVC will make for a fast ride throughh NVC. There are many great guides on NVC here on VJ. The better prepared you are, the smoother the ride. Ive been there and done that.

  2. usually, when an I-129F is submitted for any K-3 visa, to USCIS,

    the 'place in queue' for the I-130 is reset, and the I-130 is 'yanked' out of it's current queue, and placed into a new queue based on I-129F submittal date.

    I'm surprised that a USCIS staffer, face to face, told you to file for a K-3 visa in MAY 2010 - this smells like that USCIS local office is not aware of the fact that approved I-129Fs are administratively closed at NVC, when the two casefiles travel together into NVC (see http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/ )

    Usually, the I-130 and I-129F get 'joined up' at USCIS, so any speed you might hope for, is really dashed because you filed the I-129F 2 months after the I-130 receipt notice date.

    I wish I had other, better news for you, but for this particular instance, I don't.

    Good luck, however it turns out. My prediction is that you'll be doing NVC processing for a CR-1 visa, starting in late October or early November.

    Darnell is exacly correct, with I-129F you go back to bottom of pile, so not worth it for many other reasons also.

    If you have not done so yet, sign up for a account with USCIS to watch the process of your petitions to see when they were "touched worked on, when you see they are "touched" it helps with the heavy heart of this process. A seen "touch" can make a person dance a jig. Hang in there, approvals will come, they come.

  3. Ghani just interviewed. I guess we are on AP. They told him they would review our documents and call him. They gave him a green paper. What does the green paper mean? Anyone know?

    He said they asked him MANY MANY MANY questions. About me and our relationship... of course... and about my friends and family... of course... but also about if he's ever seen me naked, if we have sex, when we started having sex and why he wants to marry a fat woman. I'm humiliated.

    NOBODY, NOBODY has the right to make such discusting comments, I dont care if they are friggin government, I would report her to the director of USCIS in Washington. Its humuliating!!! Im so sorry Mandy, so sorry Hon.

    I have applied CR1 visa for my husband in April 2010, received NOA1, waiting on NOA2. I am currently in USA, my husband is in India and planning on staying with my husband in India.

    Can someone please let me know if I plan on staying with my spouse, will it affect or delay in visa processing?

    Can I change the address of Visa process to India?

    What is the form that I need to fill out for the change of address?

    Can someone please suggest, if it is possible.

    Any additional information is helpful.

    It wont effect the processing with NVC, but keep in mind there are things you will need for NVC, so read what is required for NVC. Also you will have to mail your packet to NVC from India, so use a good carrier, Fed-X , UPS one of those.

    Changing address may not be a good thing now, so have someone monitor your mail to your USA home.

  5. I understand your concern, but pregnancy is a natural thing, many pregnate applying for marriage visas and even K1's, and are approved at interview

    You need to do as all the others, pregnate or not, PROVE a true marriage, a on-going relationship. But they may require a DNA test to show you are indeed the father of the child in this immigration nightmare process since you petitioned for her.

    If you did not petition for them, no worries on a RFE.

    Wait. Scratch my reply. YES list them on I-130 They have to be "declared" I hate that word.

    Sorry, this is sometimes a trick question. Even if they are not your "blood" they are your husbands true children, you must include them on form.

    In reading the various posts, on how people filled out the Form I-130, and what items are missing or what should have been answered; and comparing to my form, I realized on the above question, I (USC citizen)answered with my name but left off my children, which would be my husband's (beneficiary) stepchildren. :bonk::angry::blush:

    My question is...should I worry about this, try to fix it (if possible), will this cause a RFE once I have to fill out the I-864? Any suggestions?

  8. Yeah, I remember our olden days in Apr/May 2008. We started this online NVC process, after their introduction. 19 days of yours is SUPER DUPER fast!!! I took less than a month.

    Some people here still follow the regular and paper correspondence. They would complete NVC process in 3+ months then, rather than just 1 month.

    3 months plus??? Geezzzzzzzzzzzzzzz Wow, I did not know that, I thought all did NVC like we all did . I think I flew thru NVC on my broom stick in 19 days.

    Act everything online and by email as much as possible to avoid NVC delay.

    Loto is so right!!! Act via email with NVC to cut down on wasted time, YOUR TIME, NVC and the other agencies have no preception of time, especially YOUR time.

  11. I only have the issue with number 6 - No family memebers attended wedding. My family was in USA and couldn't come because of money issues and her family couldn't make it because 1 (sad...) they didn't want to go because other things to do...(yeah...right) but mainly 2, They aren't members of our church and hold a temple recommend to be a part of the marriage sealing ceremony so it sounds more like if they can't see the actual wedding, why go...

    Other than that, we have no issues... maybe age but it's exactly 6years and she being elder (yet i am elder in mentality haha, she knows it too)

    I've seen most of these kinds of concerns addressed either before or during the interview is taken place. No worries about those amazing facts about why they don't want your spouse come in. Just provide evidence and it will be fine =)

    6 YEARS IS NOTHING. You not no kid in your 20's and she is not "cougar" dont worry about the age. Thats the small stuff.

    For the family not attending, well, sometimes things happen, did any friends attend? Have pics of friends at wedding will do nicely.

    Like I said, its easy to get a petition passed, its the interview where there are no hold bar. Just be prepared for interview, start now collecting date, and materials, proof of a TRUE on going marriage.

  12. 4- The period between the date of marriage and the date of divorce was very short ( if any of them were married before ).

    This one worried me a little because there is a one month difference. My ex and I separated over two years ago though and were just kind of dragging our feet. I was just planning to have my wife mention this if it comes up.

    The shortness of time of the date of marriage and the date of divorce is no big deal, just be prepared to answer questions of this at interview, maybe.

    Just show a true and strong realtionship is what is needed.

    On a note: Many have sent petition to USCIS day after Divorce Decree was signed and were approved with no problems.

  13. Yes you are right but the way the USCIS looks at it is, when certain clues are there, they process the petition slower than if u had none of these on your case

    So the advice is if you had any of these, you have to provide more evidence to prove that your relationship is legit not to game the system and after all people on this forum want their petitions to be approved and having an advice from each others cases and scenarios is a good thing to avoid delays.

    USICS when processing wants some sort of evidence to approve the petiton, The real proof lays at the interview. There you MUST show strong ties in the relationship.

    Usually a few emails, dated from beginning of relatioship , to the middle , right up to when petition was sent , phone bills, just a few, pictures, boarding tickets , luggage tags, copies of stamps in passport, wedding certificate, these items is enough to get a petition approved.

  14. Hi, I have my interview in Paris and I'm a French citizen. I didn't do any military service either. I just did 1 day called "journée de préparation et d'appel à la défense". At the end of that day I received a certificate stating I participated in this day that replaced the military service. My plan is to bring that certificate for the interview. I can tell you if it works or not.

    Yes take that certificate, that is what you need.

    Proof of military service and or exemption is also necessary if the Beneficiary is a foreign national living in France, such as Algeria, Egypt. Embassy wants proof to make sure beneficiary is not a deserter or dodge their military service. Embassy will not issue a visa to such a person.

  15. LOL mine has been *touched* twice in the last two days...it's kinda frustrating in a way because it make me get my hopes up that something exciting is fixin to happen. So I end up checking like waaaaaaay more than I need to.

    The first "touch" in your account with USCIS is them in-putting your case into their system, so it dont really count . Its the ones after that.

  16. I-130 petitions are sent to a lock box in Chicago, from there they are distributed to VSC or CSC for processing. You will know which one when you receive your NOA1. Where did you send your petition? I hope not to the Texas Service Center

    One last thing, was your check cashed ? If it was, then you know petition was received. But you will need to call the customer service center "good luck there" and see if they can give you the reciept number. Then you can track your processing of petition on the USCIS website.

  17. oh - they are confused NOW - as you did not include the barcoded letter from the RFE postal packet that you were SUPPOSED to include.

    Sending it in, again, with the barcoded bit from the POSTAL LETTER / RFE is useful, always.

    Also to add: The RFE letter states to return the RFE with your eveidence, or it did 2 years ago when I got mine. Dont take chances, do it right, it avoids future RFE's.

  18. i payed the last step ($400) and i send to NVC all the document that they asked about (police and court record-birthday certificate-photography -a copy of my passport- affidavid of support and other documents...)

    NVC get my letter in jully/1/2010 and untel now i didnt get any news i keep calling the answear machine and the lsg its te same (wait betwine 6 to 8 weeks)

    i want to know about peoples that they are still waiting like me and if all that time that im waiting its normal

    because some friends said that they get the interview date after one week and some after two weeks

    It is perfectly normal the recording of {wait 6-8 weeks for processing.....}

    Interviews are assigned the 2nd week of the month with most embassys, UNLESS is congested, such as Cairo, Canada, and few others. All you can do is just wait, sorry to say. Nothing is quick in this process. No need to worry, unless recoding at NVC says the dreaded RFE, and then sometimes that too is a false RFE.
