  1. My wife filled out the G-325A form wherein the Revision date is 06/12/09, located at the bottom right corner. I see now at the USCIS website that there is a newer revised version dated 08/08/11.

    Is the previous document that my wife filled out still valid for submission?

    Oh gesh, I just finished our packet, I'm taking no chances, uploading new form. I see how I'm spending the evening........

    I would use the new one, don't give them a reason to refuse your petition packet........ (filing out hubbys and mine now)....

    Be happy & dont be depressed because she is lucky to have another chance. This same case happened to someone I heard of. She got to the embassy another time and the same consular officer that interviewed her said why she brought new evidences ..... ? Imagine that ! :blush: And the consular later said the evidences she brought the first day was enough to get visa... At last, he gave her the visa.

    So, prepare all the requested evidences and try again... YOU ARE NOT YET DENIED.

  3. Don't let it stop you and him from having a life together. I've known of couples who were denied the K1, and they got married and applied for a CR1 visa, and visa was issued.

    I suggest you talk with him, and find all what was said at interview. Was there enough evidence presented? Was there enough time lapse since first chatting to meeting face to face? All these can be factors, and why they said he did not know you enough.

    Morocco is a hard embassy. But don't give up.

    If you do marry and apply for CR1, I strongly suggest your there for the interview.

  4. Hello. I applied for the K-1 visa for my fiance 3 weeks ago, and already received the NOA1. However, we are now thinking to cancel the K-1, as we are planning on getting married in his country (India) in November. Although we hate to start the process over, it is really important to him for his family to be at his wedding. We were initially thinking that we would get married in the US after he arrives on K-1, and then later on we could go back to India to have a traditional marriage there. But I see that this won't work for me, as there is no way for me to go to India at all next year (not until Dec 2012) as I am a medical student and don't have any vacations at all next year until December.

    So now we are thinking the only way to make things work would be for me to come during my vacation this November, and have us just get married there. Although it would be nice to have an unofficial marriage while keeping the K-1 application alive, we can't do that as we aren't willing to lie under oath if they ask him during the K-1 visa interview about his marriage status. Although we plan on canceling the K-1 visa, we will keep it alive as long as possible, just to make sure the wedding in India goes through first (as it would be terrible to cancel the K-1 now only to find out some issue with marriage in India and then have to re-start the K-1 again in 3 months). So we will keep the K-1 until we are 100% sure of the marriage going through in India (i.e. being registered). Then we'll go for the marriage visa instead. The idea of spending another 3-5 months apart is painful, but I don't know what else to do. :(

    My question is... how do we go about dropping the K-1 visa and applying for CR-1 in November? Do we need to first send a letter to the CSC canceling the K-1, or could we just include the K-1 cancellation letter in our CR-1 application? I tried to call the USCIS number listed on the NOA1 to answer these questions, but it's completely automated as there is no human being to pick up the phone. So I'd appreciate any advice from anyone who has changed their visa application mid-process. Thanks!! :hehe:

    You need to withdraw your K1 petition first, and wait for them to respond saying it has been withdrew by the petitioner.

    Send it to where your K1 is being processed. It should not take long, mine took a month to receive the confirmation of the petition being withdrew by my request.

Thanks for the clarification, we do have our marriage certificate to show our marriage did occur legally in Ethiopia, the facebook comments and replys I wanted to add just to show awareness of our marriage from family and friends (just to show co mingling), but since we got married on 9/1/11, we haven't opened up a bank account together yet, is this going to hurt us? I've sent my husband money via western union, but thats it...we intend on getting a joint bank account in the future but for now, we wanted to submit our I-130 with wht we currently have to get it going...any other tips? we appreciate the help, thanks!!

    You should have at least ONE of the items mentioned here:

    Note: Evidence of a Bonifide Marriage

    The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

    1. Documentation showing joint ownership or property; or

    2. A lease showing joint tenancy of a common residence; or

    3. Documentation showing co-mingling of financialresources; or

    4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

    5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

    6. Any other relevant documentation to establish that thereis an ongoing marital union.

    Yes that is a good idea, we did that also, and showed printed screen shots of out congrats from friends. We also took pics to show that his family was on my FB page as my family, aunts, nieces, nephews, etc to show his family knows of marriage. I also enclosed chats with his family to show we communicate, as Egypt can be a tough place to interview, and with the closeness of family there, We do have pics of our wedding reception with some family and friends. It cant hurt....... We also enclosed a copy of out joint bank account in Egypt.

    Always keep this in mind, every case is different then the one the A.O. just processed before yours. Some cases are clear cut, and some are not. Some need more time, some are a slam dunk....................

    This is going to be one of the most important journeys of your married life................ its not a application to adopt a puppy............ and don't believe everything you hear in any immigration site..........

  8. I know a lot of people that are related and got their visa, So relax don't worry at all...

    You will be fine, I have a friend that married her 3rd cousin also, they knew each other all their life, etc., and they now live happily in California. He was from a middle eastern country, they went through the USCIS process in about 10 months, never was a issue, and they marked the related box also, they told the truth. Not even brought up the question at the interview.

  9. Aloe: i used the wrong term, civil marriage, actually what im trying to find out is not exactly this. I meant legal marriage in the courthouse/town hall registered and performed with the help of justice of the peace. After The Justice of the peace marries us we obtain a marriege certificate that we can use to apply for my adjustment of status(green card). Normally if the spouse was christian it would work, but since my fiance is muslim, he keeps telling me that, this marriage wont be "completely" valid without his religion recognizing it, like you mentioned in your answer. Im very confused.

    His religion recognizing the marriage or not, DOES NOT effect your process with USCIS. A valid marriage to USCIS is a registered / legal marriage on file with the courts in USA or any other country. That is what is valid.

    Keep calm, don't show your upset, cause the interviewers will try to provoke you. Its how they are trained.

  11. The USA has no vital statistics re: marriage records.

    In California you can marry in one county, and none of the other counties know you were ever married. A dishonest person could marry 58 times and nobody would ever know.

    If the United States has no centralized vital statistics or "Person Registry" than how can we expect immigration to check a beneficiary's status other than what is stated on the forms?

    Sadly, some of those stories are true, I know a lady , it happened to her.

    Like as mentioned, the USA don't have any true way of checking, so how would the embassy or USCIS check overseas on the beneficiary. That's why it is so important to know who you are marrying, know their family, friends.

    New to this forum, wanting to say hello to everyone as we plan to file or I-130 petition in october 2011.

    So far, this is what I have gained from reading James' shortcut and Lingche;s shortcuts please correct me if I have understood it wrong.

    First step, gather all the documents for me and beneficiary at this time, get the ones that signing from beneficiary out of the way also.

    Next send documents to Chicago lockbox (although i am not sure if we are still sending to VSC or if lockbox is the new thing)

    await NOA1, then NOA2- I assume this is the time it is sent to NVC and we e-mail DS3032, await IV bill and AOS bill

    so far that is my understanding, but i am open to any more suggestions and how we can get thru this process fast.

    Firstly, welcome, and good luck on your journey

    Secondly, I suggest you read the CR-1 guides here on VJ , BEFORE you start reading for the next step.

    Take all 1 step at a time. The short cuts you read are for NVC, and you will have plenty of time preparing for NVC while waiting for NOA 2.

    Thirdly , there is not short cut for a fast processing, just stay patient, and stay focus. At times this process can be trying on the nerves,and hard on a couple, being apart is hard enough, and this process dont make it easier. Start reading here: http://www.visajourney.com/content/i130guide1

    I got married here in the US at the end of July, and on my tourist visa. Long story short, I met my husband online, we visited each other a few times where he came to Jordan and I came to the US, he reverted to Islam about a year ago. We have plenty of proof, pictures, family sworn statements from his side here since they were our witnesses and I've met them and see them regularly, joint bank account, we have a pet, etc. What kind of issues did you all face during the process? Please keep in mind I am adjusting from a tourist visa and my interview will be conducted here.

    I don't fore see a problem with your AOS, now not to sound anti MENA, "keep in mind, Im married to a MENA man" as I said I don't see you having a problem, you have strong evidence, and also your a woman. I'm sure I will get slammed for that comment, but understand please, Now if it was other way around, he was here on visitors visa, from Jordan, and married, etc etc, then maybe you would have a bit of a hard time, but with situation as it is, I see a good, easy process for you.

    Please dont think I was being snobby, or mean, I truly was not.

  14. Thank you for the link. I just looked at the website and OMG!!! most the people scheduled are from Sudan!!!! What about the Egyptians???!!!! There are only few Egyptians. What the hell is this???? Why are they processing Sudanes over Egypitans aps? At this pace, it will take forever for them to get to our file...I'm feeling sick from looking at this. The usa immigration and gov really has a very slow process...I'm so upset after seeing this...

    Could the Sudan be the lottery winners? Ive seen that before, in 2008, they took place of Egyptian interviews.

    Wendy, do you know why it took 5 months for your case to leave NVC after it was completed, to reach the embassy?

    Im shocked, its usually just several days, or maybe 2 weeks, Now Im wondering how long for us to complete this process.
