  1. You guys should be fine. Your hubby has a full-time job and the consul officer will see that he will make enough income in 2010 to qualify. He has his paycheck stubs and his employer's letter to back it up. I don't see a problem.

    Besides, I have not read anything here on VJ where the USEM denied a married couple a visa because they fell a few dollars short of the income requirement.

    And remember, during your interview the consul officer will be looking to see if love is in the air! :star:

    Will your hubby attend your interview? That would help too! :thumbs::)

  2. In the employment letter they should have his salary listed. So he didnt meet with the 2009 taxes? What about previous years? I know they do look at the tax return. If he had a joint sponsor, why did he decide to go the route on his own?

    yes he didnt meet the Income requirements last year...he decided to rid of the sponsor because the sponsor did file taxes for 2009 and some other years...and dont want to file for it...

    so this is depressing especially i want to be with him soon!!

    Last time I wrote about our problem here...Now Im asking again and hope you can have time to reply on this again..

    Last time I told here in VJ that we gonna get rid of joint sponsor and my husband gonna sponsor me alone. HE going to use his Income and employer letter.. my Question is If he meet Half of the income requirements in Half year is there a possibility that we can get approved??IN our computation he can meet the income requirements this year bcoz he gonna meet half of it on june..

  4. Well, my wife got her visa this year and is in the staes with me. I am currently doing ym stepdaughters. Do i have to include 2009 taxes for joint co sponsors? I will put 0.0 unde rmine because i study, but my parents have to submitt their income. For my wife i used 2006, 2007, and 2008. Can i still used the same ones? or do i need 2009.

    we both have in the same situation me and my husband send the 2009 but still we got rfe indicating we need the transcrift or letter 1075 from IRS and explanation why my husband didnt file taxes from 2007 2006 2005 if he didnt file for those years.so in other words we end up calling the IRS and ask for the transcrift of those years..so better include the latest 3 years...BTW we have co-sponsor too but they asking for the same taxes yeas! :blush:

    She was told by her lawyer (handling her recognition of foreign divorce)...

    The Manila Embassy has changed its policy regarding children of fiances for K1 visas. He had friend / client that had problems getting visa for child(ren). He advised that we get married in the Philippines and that I adopt her daughter (8 yrs. old, unmarried). Indicated the info was on the Embassy's website (which I can't find anything beyond my understanding below)...

    Has anyone had recent experience with fiance and children traveling with them to US? Anyone heard of issues / new policy? Is there any concern regarding illigitamate father (whom left at birth)?

    My understanding is...

    I included her daughter in my petition I-129F.

    She will file for K1 visa and a file for a K2 visa for her daughter (as a derivative).

    Her daughter will need to attend medical.

    Her daughter will need to attend interview at Embassy.

    If we are graced, she will receive a K1 visa and her daughter a K2 visa.

    They will both travel to US together.

    BTW, is ther any advise regarding obtaining a Philippine passport for her daughter?

    i have the sae situation with you I hae a daughter but when i talked to a lawyer theres no problem with it specially its a illegitimate child the sole custody goes to mother...

    about the passport: her child need BC from NSO and passport of mother

  6. Hey guys,

    After two years of waiting, my visa has been approved today. The CO was very very nice, she was answering her own questions and then laugh!!!!haha.. I didn't feel like i was on hot seat for she was making me feel at ease.

    I brought tons of supporting documents but she and the pre-screener did not even asked for one piece except the photo album which i gave to the pre-screener voluntarily.

  7. Air 21 delivered my visa more than an hour ago :) I want to thank everyone for the help and words of encouragement.

    We will be together soon, after a very long journey. So happy :dance:

    USEM told me to wait for 7-10 days for my visa to be delivered, but got it just 5 days after giving them the document they asked.

Do I have to get police certificates from places I have resided within the Philippines for more than 6 months? Or do I just need to submit my NBI clearance. Thanks in advance!

    yeah NBI and police clearance are different...you bought need it police clearance can get from where you reside before and until now....if the nvc is asking for your police clearance from the places you live since 16 you need to go to the municipality of those places.

    ex... if you live in pasay since 16 until now then you need to get police clearance in pasay

    if you live in pasay since 16 and move out to laguna in 20 then you need a police clearance in both municipality

    if you live in other country after you turn 16 and live there for more than 6 months then you need to get a police clearance from that country..

  9. If your husbands income for 2009 wasn't enough to meet the requirements but he WILL earn enough in 2010 to meet them, then you should be ok. Make sure that his employment letter clearly states that he earns "X" amount - My employment letter says "_______ is an employee in good standing with an annual salary of ______." Then make sure that you include all of his 2010 pay stubs and that they will match up to that amount for the rest of the year. My 2009 salary was enough but half of it was earned on unemployment.

  10. Why risk doing something that will cause a potential red flag for fraud? Just be honest and get a substitute joint sponsor.

    we dont have someone to be joint sponsor.. he already ask for the transcrift from IRS and it will take 7-10 days to get it..we gonna send it together with the employer letter and pay stub...Does NVC and consulate consider pays stub and IRS transcript?? on my understanding on what I've read on I-864 #23 they gonna count my husband income for past 6 months and they gonna assume that my husband gonna earn that income in remaining 6 months. because if that will happen my husband gonna meet the income and we dont need to have joint sponsor.

    we plan to drop the joint sponsor. But just send a letter from his employment and send the previous 6 months pay stub... is there chance for getting approved??we read in I-1864 that:

    23. Current Individual Annual Income

    Enter your current individual earned or retirement annual income that you are using to meet the requirements of this form and indicate the total on this line.

    You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income.

    no he dont want to file it..my husband told me that our co-sponsor didnt tell us that he is married before and dont want to file for it..

    our joint sponsor dont want to file because he have issues before like he told my husband that he is married before...im losing hope!!!

    well i think we are stuck in this situation that make me feel depressed...we have I-130 approved.. my husband send the I-864 already together with the joint sponsor..last April 16, we received a letter from the NVC saying that my joint sponsor didn't include the IRS for 2009 my husband call my joint sponsor and he said that he didn't file for 2009. Now my husband is thinking to give up the joint sponsor and let him sponsor me unfortunately he didnt meet the income requirements...he gonna ask for a letter from his job and gonna send to the nvc.. IS there a posibility of denial on our petition eventhough he have a job?

    we dont have anyone to help to sponsor me what should we do now??

    we are already 2 years married.. i love him so much

    any advice??

    We just got married today! I have a very quick question...

    Is a certified true copy of marriage license, the same with marriage certificate? We are confused because we paid for an extra amount to have our marriage certificate immediately... but we have are two copies of certified true copy of marriage license...

    If they are not the same, can we use this certified true copy of marriage license when applying for AOS?

    marriage license is paper you need in order to get married...marriage certificate is given to you after your marriage so its different!!! marriage certificate is the one you will get in NSO if youre husband is filing for CR1 for your petition...you need to get CERTIFIED TRUE COPY OF MARRIAGE CERTIFICATE make sure you have at least 3 copies in case you need it in future...

    My wife is going for her CR-1 visa interview on May 6, 2010 at New Delhi embassy. Her passport was issued when she was unmarried and does not have my name on it. She has not changed her last name after marriage.

    Do CO will question about it and put her in AP for not having updated biographic information on her passport?

    We are so stressed about it because we do not have enough time to go to passport office and have it corrected because just few days left for interview.

    Anyone dealing similar issue please give your input "what we need to do."

    she need to update her biographic information on her passport...if you file your I-130 with her married name then its supposed to be the same with the passport... passport update can be done in a week so try to go to passport office and ask them how can you update her passport as soon as possible...you can make it!!

  16. followed info here and with advice of a couple helpers from here

    Sent in visa app in december it was a christmas present for her, i did everything myself now middle men

    think i sent in far to much info but it worked then helped her with her forms

    I had been there twice to meet her once last may then again in october

    Yesterday she had her visa approved

    Cost me time and about a thousand dollars and some months of waiting nothing much happens at first. Then medical two trips to manila She passed her interview no problems now we wait for her to have visa delivered

    Hope to have her here this month so less than four months from start to finish

    ####### i am excited now that our time is near

  17. So they didnt have her pay inside the embassy? I dont know how that would work..didnt think they did the COD thing there in the PI...I'm thinking that she misunderstood them. My wife paid inside the embassy after her interview. So I am guessing the embassy has her passport already? they took it from her during the interview last month?

    she need to pay inside the embassy maybe just misunderstood!!

    you can rebook her flight and go back to embassy again!

    Under the statement "Do you want the SSA to assign....", I checked "NO" and on 43b, I checked "NO". All these checks are ok if I wanna apply Social Security Card for my wife when she get here?? Or I have to check "YES" to all these, and apply for her SS card later when she get here?

  19. The g-325a requires your spouse to sign and date her name at the bottom of the page what method did everyone use for there spouse to send the document back to the usa as quick as possible? how long did it take? my wife is from phil

    I send mine thru post office here in Manila but its just a regular mail....if you want a real quick you can tell to your spouse to send it to you thru LBC, FEDEX, EMS

    LBC/fedex-- P1000-2000 3 working days

    EMS--------P800 5 days

    K-1 visas are required for 6 month as per the guide off the US Embassy Site Manila:

    So for the spouse visa, you only need to get a police clearance for anyplace you have been for 1 year or longer.
