  1. We just received our 10 yr green card. And soon, this May, we'll be eligible to apply for US Citizenship for the 3 yrs based on the green card anniversary.

    My questions are : which is better to get the US Citizenship, the 3 yrs rule vs 5 yrs rule? What are the advantage and disadvantages? Which is easier? And what documents needed?

    Please enlighten us since this will be our last hurdle.

  2. Received actual green card yesterday 2/21/2013, residence since 8/27/2010. With this, we can apply N400 US Citizenship on 5/29/2013, right? But we've been out of the country last dec 2012 from Dec 16 - 25. I know that we have to follow the 3 year rule for applying US citizenship, right? What docs we need? Is it better to have the tax transcripts or tax returns for the last three years? If tax transcripts are better, how to avail them?

  3. First of all, I would like to thank my VJ family for all the help, answers to all my questions, inquiries and support.

    Recently, last 2/14/2013, our removal of conditions has been approved under K1 visa. Conditional Green Card has been issued on 8/27/2010 so third year anniversary will be this coming 8/27/2013. We've been out of the country last year from Dec. 17-25, 2012.

    When will we be eligible to apply for US citizenship? Is it May 27, 2013, even though we've been out from Dec 17-25, 2012? What are documents/papers needed to apply?

    I know that it's still too early to apply, but we have to be prepare with all the documents/paper needed. As all we know, it'll be time to do it.

  4. Congratulations! I was comparing your timeline to my wife's and I am amazed at how fast you have raced thru the process. Received visa 5/20/10, US entry 5/21/2010, Married 5/25/2010, filed AOS 6/1/2010. We were much slower at going thru the steps. My wife arrived 4/15/2010, but we did not get married until 5/29/2010 and did not file the AOS until 8/3/2010. We are currently preparing for our interview, which is scheduled for 10/22/2010. I read your review of the interview, but I wanted to ask you about how much evidence you had. When you had your interview on 8/16/2010 you had only been in the country for just over 10 weeks. That's not much time for comingling your financial lives. And let's face it, until you get your EAD, which you didnt get until the same day as your interview, you cant work and in California you can't even drive, so how much of a financial life can you have at that point anyway. :lol: For our interview, we are planning on taking pics of the wedding, honeymoon, parties, etc, copies of utility bills with her name on it, her health insurance card and some letters that were addressed to both of us, but at this point we dont have much else to bring. We are going to open a joint checking acct and bring a copy of that, but there won't be many transactions in it as of the interview. I am thinking of asking my landlady to add my wife's name to the apt lease. So my question to you is, how much evidence were you able to present at the interview after only 10 weeks of being in the US and was the IO cognizant of the fact that you had not been in the country long enough to acquire much evidence yet. Thanks for any light you can shed on the subject. Ingat :)

    I got the following evidences: joint bank account, included on my health insurance, dental insurance, cellphone bills, credit cards, wedding pics, with friends pics, engagement pics, tour pics, condo insurance, DMV address, new affidavit support, car insurance, and some greeting wish cards from friends and families. IO just picked three pictures from wedding pics, engagement pics and with friends/family pics. IO asked also for some join bank account, health/dental insurance and lease property (which i dont have joint lease account since I own the place but provided condo joint insurance). I think IO is looking for whatever joint account we have as a couple, the more, the merrier and more convincing!! Advise, flood the IO with all tons of co-mingling as a couple - evidences!!

  5. We did the medical test result last Aug 18, mailed the result Aug 20 and USCIS received Aug 23. But as of this writing, we havent heard from USCIS. My question is : Do I have to mail again the medical test result to them before Sept 16 - 30 days per their letter? It will cost us $30 to have the test result again and planning to mail next week Sept 10 just before Sept 16 - 30 days alloted time per their letter.

    I am seeking your intellectual advice. Did anybody have the same experience.

    Well, I guess I wouldnt be needing to send another medical test result SINCE we RECEIVED the WELCOME LETTER today through our mail!!! We'll be looking forward to receiving the green card within 3 weeks!! Thanks for everyone's help. :thumbs::star::star:

  6. We had our interview at San Francisco around 125PM. We got to the place at 1245pm, looking for parking and left our cell inside the car. But we were surprise that you can bring your cell, but you have to turn off.

    The place looks like empty. Officer Lee, a Chinese mid 50's, greeted us was we walk in to his office. He was such a great guy!! We told him how nervous we are, and he told not to since he wouldn't bite us. He asked how we met and when. We even told him our stories, where and when we met, proposed and engaged. Officer Lee asked for some pictures. We showed him our album and he asked for three pictures with three events. We gave him our wedding pic, friends visiting us, and other pics. He asked for rental/lease agreement which we dont since I own a place. So he asked for bank join account, health insurance with my fiancee's name, life/auto insurance, and even our joint phone bill. He got all the originals. We asked if he wants photocopies, and he told us that originals are fine with him and we could download originals later if we want (kinda weird). Finally, office asked if my fiancee is working. He asked also if my fiancee has SSN, and we showed to him.

    Finally, he said that AOS interview is approved and handed us the letter.

    When we got to my car, I had a blocked message from Officer Lee, that he doesnt have the medical result. So he has to mail the notice of action. He mentioned that it is nothing serious. So we decided to go back the bldg, which is good thing that we have the copy of our appt letter and medical from the Philippines. We went to the receptionist, told that we're back since Officer Lee needs our medical. The receptionist told us that Officer Lee might be having another interview and busy but not until we saw Officer Lee went out to call a couple, and waived our hands to him. Officer Lee let us walk in his room, and there we saw a sealed enveloped about to mail to us. Officer Lee opened the letter, handed to us and explained that most of the time, immigration from the POE SFO, forgot to route and include the medical result to our KI Visa approval package. Office Lee mentioned that it is not our fault, but we have to complete our medical again, which include TB test and syphyllis test. So we have to go USCIS medical/civil surgeon and pay again.

    Really, Officer Lee was really such a great guy. Our interview went well, calm and pleasant except for the screwed medical result done in POE SFO. But well, we have to do this anytime soon.

    Yay!! I did receive an interview letter - Aug 16th Mon - today Jul 17. But it's kinda strange that the Interview Letter was dated July 13, but USCIS received my RFE docs last July 14, it was resumed July 15, wierd ha? So which, mean USCIS have already the interview letter/date all in awhile. Interesting!!

    Anyways, I have a dilemna now. I have an important class for my work on Aug 16. So which mean, I have to postpone this class and look other class for my work. I heard that you dont have to postpone the schedule interview date, or else, later on, you might be in trouble.

    Second any guidelines on AOS interview, specially in San Francisco?

  9. Yay for you! I HOPE they resume our case tomorrow.

    But the NBC is in Lee's Summit, MO. That's the place they mentioned on your NOA ("Your USCIS application/petition has been received and routed to the National Benefits Center for processing").

    Thanks for your quick response. I didnt realized that it was in Lee's Summit. I am at work and I dont have the copy of the RFE letter. But thanks a lot for your immediate response.

    Dont worry, your case will be resumed anytime soon like ours. Hope our case will be transferred to CSC soon.. THNKS

  10. Our RFE was received yesterday. A touched was received today via text/email, stating that that AOS process was resumed after receving the RFE documents and it is the National Benefits Center. My question is : "what is National Benefits Center?" what is transfer to that center? Does anyone have the same situation, when USCIS received the REF docs? Thanks.. and good luck to everyone

    Clarification: Per USCIS website, checked status online, AOS process was resumed and it is in the National Benefits Center. What is the National Benefits Center? Where is this center? Did they transger to this center? Does anyone have the same situation? Thanks

    We're thrilled to report that our RFE was delivered today at 4:59 PM :dance:. It was signed for by C Buchholz (I guess it doesn't matter if you waive the signature? lol)

    We're praying that they get back our case PRONTO!

    Our RFE was received yesterday. A touched was received today via text/email, stating that that AOS process was resumed after receving the RFE documents and it is the National Benefits Center. My question is : "what is National Benefits Center?" what is transfer to that center? Does anyone have the same situation, when USCIS received the REF docs? Thanks.. and good luck to everyone

  12. RFE.... Well, I just received a letter today, dated 070710, that USCIS need the latest (2010) income tax of the petitioner/sponsor. When I check my duplicate AOS file, I found out that it was not included. Damn it!! :bonk::bonk:

    So I need to send ASAP, which mean it will delay the process. But the good thing about it, it is in the process, and USCIS is handling the case properlu.

    I have noticed that the USCIS website where you check the case status, is still under "Initial Review."

    Oh well, I have send the RFEs documents tomorrow for them to have it early next week.

    Yes i do have the interview letter and it says at the bottom that if for any reason you cannot go to the interview you can ask for another date. It says too that it can delay your case and you can be ask for more documentation and and evidence.

    Biometric earlier will not change anything. If his bio is in July second he might get the Letter for the interview two weeks after they receive the bios.. And after that you have between three and five weeks (four in more cases) for the interview date. So all the way you have like maybe a month an a half from bios to interview. I dont know which one is your case... If he is a K1 you have a LOT of chances not to have an interview... So that would be a point to relax:)

    hope it helps.. And again every case is different and Im talking about my particular case...

    To Alkimiya, our case is a K1 visa. I am just wondering why you mentioned that K1 cases have a lot of chance not to have interview. Is this based on others? Thanks

  14. For those VJ who has/had their AOS Appointment Interview letter, is there anywhere in the letter states that you can reschedule the appointment date if you cant ablt to keep the said date.

    My fiancee and I are planning to do to walk-in Biometric early than the appt on Jul 2. But if we do the walk-in Bio early, the AOS appt interview might fall within Jul 26- Aug 9 which I, US spouse, will be of the the country. But if we do the Bio on the appt date - Jul 2, based on others timeline, it might fall from 8/5 - 8/15, which the chance is I will be in the US.

    I had the same problem... my husband will not ba here for the interview because of work and out of the country. I did a Infopass today and I asked if the interview could be move to an earlier point as he will be here for a week at the end on june and then gone probably until December :(

    They did not give me any answer at the moment. They asked my husband to write a letter about the case and the dates he will be able to do the interview (two days in July and 5 days in August is when hubby will be in USA). We did the letter and the Section chief CANCELED our original appointment and just gave me a letter saying that I will get further information on the mail. Walk in biometrics will not change a thing. I did my Bios three weeks earlier than original appointment.

    So you can cancel and they will give you a new date...

    My Advice: FAITH!! :) everything is going to be alright and you will be here for the interview to go smooth :)

    Thanks for your info/advise. But I have a question. I would assume that you have your AOS Appt Interview Letter on hand or you receive the AOS Appt letter. My questions is: In the letter, is there any phrase or stated that you can reschedule your appoinment date if you cant able to attent the set date?

    I am holding back to do a walk-in Biometric since I do have a Biometric appt on July 2. And I will do a walk-in Biometric early, the AOS appt interview might fall from July 26-Aug 9, which I will be out of the country.
