  1. I applied on Wednesday (13th)... they took my naturalization cert and said they will mail it back to me post processing. Soooo strange wow.gif

Are you travelling soon? We are leaving to JA December 31st

They took mine too and also stapled it! This is such an important document to have two holes now!

I don't have any plans to travel soon, that's why I applied for routine service.

  2. lol yes, really. Shorts. Like over-sized basketball shorts and a super long over-sized white tee.. Too bad I still don't have the pic. I know that makes me a dink, but I got so bored waiting 2 hours for my interview lol I sent my hubs a couple pics from inside the waiting area.. I don't know.. another lady was wearing a tank top that was way too small and skin tight jeans... well you get the pic lol It's probably an LA thing *shrugs* tomorrow is your big day! dancin5hr.gif

Poline - How was your oath ceremony?

I was expecting a 2-3 hour ceremony, but it was like 1:30hrs, not bad at all!

It was a nice ceremony, the Judge was kinda funny, asking "please, take a picture with me!" LOL

    read upon this.

Were you in the U.S. 3 months prior of submitting the app?

I think you'll be fine but you are very close to the limits. I am sure the officer will have to get approval from its supervisor before giving you the final approval.

Now, maybe the question is why were you out of the country for such a long time? was your husband with you? Maybe that is what is giving them a red flag.

The IO was trying to scare me :)

I already got the Oath letter. The letter was actually mailed 1 day after my interview. :)

  4. All,

I received NOA for interview, N400- Application for Naturalization, dated 11/4/13.

In the letter it states I MUST bring, among other documents, the spouse’s birth certificate. I do not know where the official document is, and I am afraid by the time 11/4 comes, we will not have in hands. We did receive the yellow letter from USCIS to bring previous divorces, and we have that, yet birth certificate, I am afraid I will not have time to obtain.

So, my question is: is this necessary? Or, in this interview, I will be doing the citizenship test, and some verification questions only? Also, will I be able to do the oath in the same day?

    Thank you in advance.

PS: Trying to update time line in this forum but having a hard time. Update: Completed biometrics, and going to interview.

You must have all the documents in order to avoid headaches. Since you guys were previously married, the IO will probably focus on your current and previous marriage.

My interview: I filed the N-400 based on marriage, got an yellow letter asking for my driver's license, but the IO didn't care to see any document, the only thing she asked for was my Green Card, I had everything with me.

You still have time, try to find it or ask for a replacement.

  5. My interview was yesterday, I passed the test but was not approved yet. According to the officer, she has to double check my travel records. Means I can be denied even tho none of my trips exceeded 6 months.

So she said I should expect a denial letter or an oath letter.

The form I got in the end of the interview stated that: "a decision cannot yet be made about your application"

  6. I was always under the impression that we're allowed 6 months per calendar year only. It doesn't reset once you come back to the US, where you'd be able to stay for x amount of months and go again for another 2, which would make your visit 7 months out of the year. I don't know if that's even correct, but if it is, you'd be over in that year, and that would be an issue? You're almost at the very end, I hope it all gets sorted out soon for you.

"3 years as a Permanent Resident without leaving the United States for trips of 6 months or longer."

They are definitely not clear about this...

6 months per year? Per trip? They say it's per trip, so it doesn't make sense for me...

I consulted 3 immigration attorneys, they all said there is no reason for a denial, because my longest trip had a 5 month duration, so this is extremely confusing...

I couldn't find the explanation for that 6 month trips, they only say : "6 months or longer"

    Let's wait and see :/

  7. Asked in Ithaca, NY - about 2 hours

Today I passed my citizenship test, but the IO said she has to check "the law" to find out if my case is going to be approved or not. Reason: too many trips to my birth country. I am applying under marriage, and according to my math, stayed outside the USA for less than 18 months. I became a resident on sep 8th 2010, applied for the citizenship on June 20th 2013.

    My international trips:

    09/09/2010 - 02/15/2011 159 days

    05/15/2011 - 07/03/2011 49 days

    02/11/2012 - 04/07/2012 56 days

    08/08/2012 - 10/14/2012 68 days

    01/27/2013 - 03/05/2013 36 days

Not even a single trip over 6 months, but the officer said my 2 firsts trips were "too close". Will my case be denied?

  8. Ok. I don't get what the IO means. Is she interpreting it as you can't stay out of the US for more than 6 months a year? That's not what the eligability instructions say. It says you must be in for 18 months and no trip longer than 6 months. So when she checks it out you should be ok. Everything will work out fine for you. Stay positive!

She kept saying that she had to check "the law", but apparently she was interpreting that you cannot stay outside the country for over 6 months per year. I got really frustrated because I thought I was doing everything right.

I hope they don't take ages to decide it :(

    Thanks for the positive words!!

  9. I'm sorry to hear you didn't get your approval on the spot. Did you apply under the 3 or 5 year rule? And did you stay out for more than 6 months at any time? Based on either one you should be alright if you didn't stay more than 6 months for any single trip. Maybe she just wants to double check your dates to make sure everything is correct.

I applied under the 3 years. My longest trip: 5 months.

According to what she said, it doesn't matter if you travel for 5 months and return to the USA, then 3 months later you travel again to Brazil for 2 months (my case).

Well, according to the uscis website, applying under marriage you have to stay in the USA for at least 18 months and no single trips over 6 months. I made sure I followed their rules, but nothing else I can do... :(

  10. So they've decided to scare us today because I've got one too. ohmy.pngunsure.png

    Yeah lol

When I got the envelope I was like: "Ok, what now?!" I thought they had changed the interview's date or something like that, and got pissed instantly, because we have made hotel reservations... but when I finally opened it, I was like: "huh? Of course I will have my DL with me!" LOL

  11. On August 8, 2013, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling. When scheduling is complete, you will receive a notice with a time and place for your interview.

    Finally!!!

I realized something... Jay2Pnoy's 5yrs LPR is September 5th (she is applying under 5 years). Her status changed August 5th.

My 3yrs LPR is September 8th, and my status changed today, August 8th.

So, for those applying for citizenship before meeting the "continuous residence" requirement (90 days rule), your case will be updated one month before your 3 or 5yrs being a LPR,
