    Well - since I have health insurance through my employer, I called my employer up, told them I was now married, provided them the required documents to prove that (English marriage certificate) and then added her to the health insurance. Told them she didn't have a SSN right now as she lives outside the US... that was 2 yrs ago - not had any problems - they take the extra out of my check each pay period - theyre happy...I get some more proof of the relationship...

    As for taxes - we actually filed for an ITIN - then filed married filing jointly - got relief on our taxes too.

    For the bank - they don't need a SSN to add a beneficiary - atleast not Chase Bank...

    Also keep copies of the itineraries for travel as well as itineraries of any family members that attended the wedding, etc.

    Phone records (calls made and received), and make her life insurance beneficiary, if they will let you, get a life insurance policy on her with you as the beneficiary.

    If you have a will, make sure it's updated for her to be your beneficiary there as well.

    When I put my wife on my accounts while she was still in Japan, they will ask for an SSN, however you simply tell them she doesn't have one yet and that you're applying for her residency. BofA will use a fake SSN that they default to for non-resident account holders.

    Also, if you're sending money to help support her, make sure you keep copies of all the money transfers along with her keeping copies of all the receipts when she got the money.

  3. We are coming up on the expiration of the NOA extension and want to travel home this summer.... they suggested we go to our nearest consulate and explain our situation and obtain a visa to travel home... this seems insane...

    Is this normal? Do I need to hire a lawyer?

    It's the government, abnormal is normal, but then, you're already aware of that since you said you're on government orders overseas. ;-)

    Also, hiring a lawyer won't get you answers any faster than you could get them yourself, so I wouldn't waste money on that, especially since you've submitted your wife's package and haven't been denied.

    Two things, first follow the instructions they gave you about you and your wife going to the nearest consulate, making sure to bring your copy of the submitted I-751 package and the received NOA extension letter. The consulate should be able to interact with USCIS and let them know that the consulate is going to issue a visa as your wife hasn't actually been denied (they'd tell you by now if she was), and it's quite possible that you'll get an extension letter from the consulate.

    Second, contact your elected representative explaining to them the same thing, letting them know that you've gone to the consulate along with the results and that you're concerned that your wife's package has somehow been misplaced. Make sure to give the elected official a copy of your wife's package NOA along with copies of anything you get from the consulate.

    In all honesty, the congressman won't actually be able to hold USCIS to a specific time line, but the more contacts USCIS has about the status of you wife's package, the more likely that you'll actually start to get some action.

  4. Seiko got her approval letter today, dated 4/15 and her new card has been ordered (letter says up to 60 days, assume it will come sooner). Updating the information below. Finally!

    By the way, for the RFE, I submitted more tax forms, travel itineraries for Seiko, myself, her kids from Japan, her niece from Japan, a ton of photos from those trips where they flew to Boston from Japan and spent the holidays with my family. Also, an affidavit from my father and mother (I recall reading here on VisaJourney that affidavits from family are not recommended, but when I called USCIS, they told me that affidavits from family are not only accepted but welcome).

  5. We just got an RFE dated 2/19/2013, and all the stuff they're asking for that we can actually provide was already submitted with the application. Things we can't provide would be a lease or mortage with her name because I bought the house before we met. We have no joint credit cards but we have joint bank accounts and we provided original letters from the credit unions (two of them) attesting to that fact. I provided medical, life and car insurance documents, I provided copies of actual tax forms, I provided affidavits. What the hell? <sigh>

    Anyone else have this experience? How did you handle it?

  6. Seiko had her biometrics appointment here in Seattle on Monday at 1pm. Wasn't a ten minute thing like others, we were there for almost an hour due to the number of folks scheduled at the same time for the same thing. I guess Seattle is a major hub?

    Anyway, lessons learned:

    1. Don't expect it to be quick.

    2. Expect that people will NOT follow the directions given to them by Homeland Security folks and instead will wander around, and then try to cut in line to be processed even though their number hasn't been called yet.

    3. Bring cash for parking. They don't have a free parking lot and the pay lot only takes cash. $7 is the current rate.

    4. People *will* bring their very young kids who need to be entertained. Why? Dunno, I guess they thought it would be an "in and out" thing too.

  7. Walked in and did biometrics today (USCIS Sugar Land). Got there shortly after noon, was in and out in maybe 10 minutes, if that. Now for the waiting...

    This question goes to pretty much anyone. Everyone has to do Biometrics, I understand that, but when doing the removal of conditions, how often does an interview NOT happen? My thinking is that the interview is the rule rather than the exception, do I have it backwarkds?

    I ask because the I751 instructions uses the word "may", not "will":

    Page 4, section 'Requests for more information' -> "We may request more information or evidence, or we may request that you appear at a USCIS office for an interview."

Filed on behalf of my wife, and the application actually got there on 6/7/2012 with her card anniversary date of 9/7/2012. I put the envelope in on the evening of the 6th and the postoffice was super efficient. They got it there the next morning (I was figuring it wouldn't get there until the evening) so they sent the entire package back. Resubmitted the next day with an updated cover letter and got the NOA1 on the date below.

    Then I got a letter that said it shouldn't have gotten there before 6/7/2012 (three calendar months before the expiration of her card). Yes, that's right, it got there on the "not before" date and they sent it back. No, I wasn't a happy camper, but be taht as it may, they accepted it the second time and were down-right speedy with the processing.

    Anyway, here's my "June Filer" data...

  10. The only thing I would be worried about is when the medical will expire - but I do not think it will lose its validity after 30 days - more like 6 months or 1 year. Also for some reason I have noticed most VJers get the medical within 15-20 days of the interview.

    Please let me know any thoughts on this and potential problems with our appointment schedule.

    Medical exam results are generally good for 6 months, so you're fine there. My guess on the timing of medical exam scheduling is that the hospital sets specific dates and times for exams and applicants have to fit within that narrow window. Just make sure that the exam results remain unopened and that those unopened results and xrays make it to the Visa interview.

    Can you please chill out? Darnell gave perfectly valid advice, that being to call NVC to find out the *VERY LATEST* status. Your beating a dead horse about whatever point you're trying to make does not disabuse the very good advice that Darnell gave on this question.

    As for finding out if the case review has been completed, that can happen at any time. From reading your posts, you are presuming that a case review as approved is a foregone conclusion, it's not.

    Just because NVC has indicated they have all the documents to MAKE A DETERMINATION does not mean the determination has been completed.

    The only time that the OP will know that a determination has been made is when NVC tells them that they are simply waiting to schedule an appointment with the embassy.

    So please, chill out and stop fighting with Darnell. The rest of us readers/members will appreciate it greatly. :)

  12. Interesting, I tried posting and it seems to have failed, so let me try again.

    My wife's interview was on Monday (Sunday night for me) and she was in and out really quickly. They asked her about her kids (and their plans, they're both in college) and my kids and a few other questions but nothing that didn't seem like general conversation.

    She passed her interview on Monday and now has her visa in hand as of yesterday. She'll be arriving here in Seattle on Tuesday, the day after Labor day... :)

    answers to your questions......

    i was 22 years old when i committed a crime...

    i was only arrested by the police and was not taken to the court.

    my arrest record has been destoryed due to its been 10 years..

    So then it went something like this:

    • You stole something and got caught (aka "committed" a crime and the police were called).
      Note: Anyone can charge you with a crime, but only a court of law can convict you of any crime in the US.
    • The police arrested you.
    • The store owner/manager worked out an agreement where in exchange for you attending some form of classes and never doing that again, the charges would be dropped.
    • You attended the classes and never did any crimes of this nature again.
    • The charges were dropped.

    Is this accurate?

  14. I agree with Darnell!talk to a human!only he can tell you the real event :)

    But keep in mind that even humans don't have the full information and you could be given a canned answer unless you manage to find a human who's willing to go the extra few inches to seek out a superviser and get a bit more useful data. Also understand that the "useful data" may not be what you hope to hear.

    Example: Last time I called NVC to find out when my wife's DS-230 package was going to be mailed to the embassy, I was told "it will get there in time for the interview". I explained how that wasn't a helpful answer because we were hoping to request a possible earlier interview date (interview date is August 30th and was scheduled in the second half of June) but cannot until the package is physically at the embassy in Tokyo and could I please find out why the package is sitting around collecting dust when I can tell from the DHL website that there have been at least three packages of documents sent to Japan from the NVC since her date was scheduled.

    The guy took pity on my poor soul and asked a supervisor and was told "about 30 days before the interview the package is made ready for shipping", which isn't until the end of this week. You may want to take notice of the phrasing as "made ready for shipping" isn't the same as "shipped" as I'm sure you've seen others who've posted that their package was *finally* shipped about two weeks before the interview (if I recall correctly, it was shipped on July 20th for an August 3rd interview date).

    Anyway, like I said, even humans can't always tell you what you want to hear, so expect the worst and hope for the best and generally you'll get something somewhere in the middle. :)

  15. Are there really only 15 interviews scheduled for next month?!?!?! There were sooooooo many in July and now....:(

    I would expect more as well, however this isn't the only "visa support" site, so it's possible that other sites have a larger number of members with August interviews. What makes me think this is that I'm told US Embassy in Japan is *very* busy with immigration interviews during July, August and September and my wife is the only Japan interview on the list for August.

    Just a thought.

    My recommendation is that once she gets the certified copy of the DD Form 214, that she take that form down to the local city hall and get them to add a scan of it to their records so that she won't have to go through all the hoops of requesting a copy from the military records depot in the future.

    Just make sure that the local city hall doesn't allow public access to those records because the form will have her SSN on it and she doesn't want to have that become "public records".

  17. She was basically in her training (physical and job related) with the U.S Army and didn't complete her training, so got discharged.

    So if I understand this correctly, she was in the US Army doing basic training (aka boot camp) and quite possibly MOS (Miltary Occupational Specialty) training, which is considered active duty. So if she was on active duty for training and she got "discharged" or "released" then there were papers (including a DD Form 214), and that form (the 214) is what they will want.

    My suggestion is send a copy of page 4 (that's the long one) with your application and make sure she brings the originals (She would have gotten page 1 [a short page] and page 4 [a long page] at separation) to her interviews.

    It would look like something like this but have all of her data in all the blocks:

    DD Form 214 page 1 (Short form)

    DD Form 214 page 4 (Long form)

    Keep in mind that if she was not on active duty for training, instead she was working in a civilian capacity, she would not have recieved a DD Form 214. Only she can answer that question and provide the paperwork.

    If she did get the paperwork and has since lost it, you can request copies from here: http://www.archives.gov/veterans.

    They will send a certified copy of page 2, which looks just like page 4, from the military records depot. Chances are, if she did serve in the US Military, she would already have had an SSN, so she would use that as a basis for the records search. And yes, she must request them as she's still alive.

  18. When my wife was in the U.S, she had worked in the U.S Military for few weeks.

    I read as part of NVC original/certified copies, military records are also needed.

    Is this the military record from all other countries? Should we submit U.S military record to NVC?

    In what capacity did your wife work in the US military, did she enlist and go to bootcamp? Did she go to officer candidate school? Was she ROTC while in college? Knowing the capacity would let us answer the question better.

    Example: If she was a civilian contractor or employee working on a military base, then no, there are no military records that would need to be submitted, however if she got a DD Form 214 (herein referred to as a "214") for any service she did as an active member of the US Military, then a copy of the 214 is what's required (officers and enlist folk alike get one when getting discharged from the US Military).

  19. I'm filing I-130 for my parents based on naturalized U.S. citizen and I noticed that the date of marriage of my parents in my birth certificate was the date of their church wedding. My parents were first married in civil wedding and I have a copy of their marriage certificate on their civil wedding for the I-130. Will their be problems in USCIS due to the conflict dates of their marriage? I don't have the their church marriage certificate and I have only the certified civil marriage certificate. Thank you.....

    I would include a letter indicating the reason for the date discrepancy (church vs. civil ceremony) so that if someone actually sees the difference, they already have a written explanation from you.
