  1. HI MIKE! I called the USCIS and i was able to talk to an immigration officer. He told me that I don't need the re-entry permit since I am travelling abroad on military orders. He just told me to always bring copy of my husband's orders all the time. But thank you for replying!

    I would call USCIS and explain the situation (about US husband in the military being stationed overseas accompanied) and ask if a "Travel Document" is necessary for you to not lose your LPR status.

    I should note that I just got done reading the PDF for the I-131 form and while it doesn't state that a re-entry permit is necessary for someone who is traveling overseas by order of the US Government, it does have a section on expiration dates for people who are traveling overseas by order of the US Government. So by inference, yes, a re-entry permit is necessary for you.

    That said, the PDF also indicates that you can file the form electronically, however these should be noted:

    I am a LPR and need to travel abroad. Can I file my Form I-131 to get a reentry permit while I am outside the United States?

    No. You cannot file a Form I-131 to obtain a reentry permit unless you are physically present in the United States when you file the form. You should file your Form I-131 no fewer than 60 days before you intend to travel abroad.

    If I file Form I-131 to get a reentry permit while I am in the United States, will USCIS deny the Form I-131 if I leave the United States while the form is still pending?

    We recommend that you file Form I-131 while you are in the United States. However, you do not have to be in the United States for USCIS to approve your Form I-131 and issue a reentry permit to you if your biometrics have been obtained. You can indicate on your Form I-131 that you want USCIS to send your reentry permit to a U.S. Embassy, or consulate, or a DHS office overseas, so you can pick it up from one of those facilities.

    If I file Form I-131 for a reentry permit while I am in the United States, can I submit my biometrics while I am outside the United States?

    No. When you file your Form I-131 to obtain a reentry permit, USCIS will notify you when to appear at a designated Application Support Center (ASC) to obtain your biometrics. You must provide your biometrics at the ASC while you are in the United States. If you leave the United States before you provide your biometrics, USCIS may deny your application.

    This means you may need to delay your departure and join your husband overseas if you don't want to do as mimimelo suggested and try for an expedited US citizenship while overseas with your husband.

  3. hi everyone! i have a problem. i got my green card weeks ago, and im going to travel outside of the country. my husband is stationed in italy (airforce), and i have the approved command sponsorship. we will be staying in italy for 2 years. my question is, do i need to apply for re-entry permit? isnt bein on military orders and on base considered US soil? i am leaving on thursday so i really need your help. if anyone knows please let me know thank you

    Always error on the side of "it's necessary" until you're told it's not, and always ask for a reference, something published by the US Government if you're told it's not necessary due to military orders.

    When in doubt, always check with the US Embassy website in the country where you want to attempt a DCF. I found this:

    I've been trying for weeks now to contact my embassy in Washington.

    Over the phone, over the e-mail- no way i can reach them.

    I need to get in touch with them somehow, because i got a question about my moldovan passport renewal.

    Are you actually here in the US? If so, then perhaps a physical visit to the embassy in Washington DC would be in order?

  6. I dont know what AFFIDAVOT OF SUPPORT to used on my daugther.. she is 1year and 7months

    Are you a USC and were you married when your daughter was born?

    If you were a USC when your daughter was born (I'm assuming that you were married to the mother when the daughter was born, yes? if so, that helps, but it's not necessary), you don't need to file for immigration for your daughter, you simply file for a CBRA and she's good to go.

  7. Mine went through the Texas Service Center (not California), however if you look at my sig below, it shows how long it took between NOA1 and NOA2. Just under two months, but I also made sure to do everything in the CR1 guide here:

    We are trying to go the "get ahead" route and send in our I-864 forms before getting our "official" barcoded cover sheet. We paid the AOS fee online today, but apparently it says you have to wait for the payment to clear before your coversheet is created. My hubby found this coversheet "cheat" example on "James's Shortcuts" (found here) and I'm trying to find out if this will be accepted by the NVC.

    Can anyone confirm that this is okay to use and we can go ahead and send everything for the I-864 in now? Or, if anyone has recently received their barcoded coversheet from the NVC and wouldn't mind posting it here, that would be FANTASTIC!

    It typically only takes three days to when the barcode cover sheet is available after the payment is made, HOWEVER, if you've got any other documents that already have your barcode, I'd use the barcode from that other document instead.

    Personally, I'd shy away from the free barcode generator referenced at that link as I just went through it using the steps provided in the cheatsheet and the barcode that's generated is kinda fuzzy (it's a low resolution image).

    But that's just me and since I actually waited to make sure that the payment was accepted, I didn't bother searching for other options.

  9. Hi! That is great news! I have also filed for I-130 but mine went to the California center. I'm interested in knowing how long did it take for you to get ur approval notice(NOA2)?

    Mine went through the Texas Service Center (not California), however if you look at my sig below, it shows how long it took between NOA1 and NOA2. Just under two months, but I also made sure to do everything in the CR1 guide here:

    I also made sure that I provided the translations for any documents not in English (it's required for the I-130 package).

    I also provided about 12 pages of photos, everything from my wife and I on vacation to photos of me with her familiy members and her with my family members, all labeled with the occasion (and names/relationships), location and month/year.

    Go through every form with a fine tooth comb, as if you're the person at USCIS going through the form. Make sure that there are signatures and dates, supporting paperwork and a cover letter. The more work you do now, the less chances there are for errors and RFEs (request for evidence) that would delay the process.

    I received ma interview letter in the E-MAIL,(sheduled for Aug 12 at chennai US Emb)from NVC .

    Ma questions are

    1 , Do i receive another (or Original) interview appiontment latter from either NVC or from the chennai US Emb in post (MAIL)?

    2 , if NO can i take the print out of the one in the e-mail and go to VFS(fees) and alos to interview?

    3 , If YES how much time it will take to get this interview appiontment latter by post (MAIL)? (got e-mail on july 15th)

    1. No, you'll only get the digital copy, not a physical copy.

    2. Yes, print out the PDF they sent you that contains all the appropriate interview appointment information and take that with you. I'd take a few copies.

    3. Not applicable since the answer to #1 was "no".

    A spreadsheet is created with all available data for VSC filers in the year 2010, to forecast the moving trend graphically and is attached in this thread. I need your help and it would be mutually benefited to all others. Please reply to this thread if your information is incomplete or incorrect. Also, welcome to all petitioners who are missing here. I can periodically update this spreadsheet and post here.

    Again, this is just for the year 2010 I-130 filers (IR1/CR1) in VSC.

  13. I was living in states 10 years ago and i made a biggest mistake of my life. i was arrest shop lifting. I convicted this crime 10 years ago.

    Questions that I haven't seen answered:

    How old were you when the crime was committed?

    Since you state you were arrested, I'm assuming it was by the police and not a security guard, so if the police were called, did you go to court?

    If you went to court, what, exactly did the judge say?

    I ask this because if you were a juvenile, then the rules may be slightly different, especially if the judge said something to the effect of "if you attend these classes, this will be stricken from your record as long as you don't commit any other crimes while here/for the next five years, etc.".

    I say this because if the records were stricken or sealed because you were a juvenile, then it's possible that there may be some leniency, or even no issues at all.

    Just a thought, but still, your best bet is to talk to an immigration lawyer and present the full facts, including copies of all court papers if you have them.

  14. If you decide to go the US permenant resident route, you'd file the petition for a CR-1 visa.

    Actually it would be an IR1 visa since they've been married for almost four years, but everything else is accurate.

    Can't speak to Canadian income being sufficient for immigration to the US, this is one where I'd consult an immigration lawyer since there currently is no US income to speak of.

    Umm.... Okay... Seriously, what's there for me (or anyone for that matter) to respond about? Why are you directing this at me?

    The other question that I or anyone else would as kyou is is why would you waste time and money applying for a K3 visa when the CR1/IR1 is the much better deal finanically?

    Have you tried booking online? A lot of people, myself included, have had success booking a one way flight via expedia, hotwire, travelocity, etc

  17. that is too bad! you cannot even try to move the interview then!!!

    the NVC is way too super busy in the summer. so is tokyo. the embassy is probably all booked up... :wacko:

    Just spoke with NVC and the person I talked with said they *just* finished up doing the final scheduling for August today, so with any luck the packages will go out within the next few days and a few more people will get word of an August interview.

    Yes, I used the magic of following the directions of the folks on this board who wrote up some really great guides. :)

    That and I checked twice that that every "t" was crossed and every "i" was dotted on each form and that every form was included (along with some photos from our six year relationship and wedding), translated documents (so that they wouldn't have to get the documents translated, which takes up time) and all the correct number of copies of everything.

    BTW, NVC is sitting on mailing some packages. Seiko's interview was scheduled in late June and as of 8:30pm Pacific time, her package still hasn't left for the Embassy in Tokyo. The guy on the phone said "it'll get there in time for her interview". Not very helpful. <sigh>

  20. The divorce was in the US (supposedly) and I live in Canada. My ex maintains he did get it done but cannot produce papers, I have been in contact with the places it may have been filed but no luck yet.

    If your ex has told you where it was filed, then the county seat would have it on record. If you know the city he was living in when it was filed, it would be that city's county (or parish if it was Louisana for example). You would want the County/Parish Clerk's office and the approximate date of the divorce. Most counties now have that all digitized so can look online and then get the appropriate paper version and make a certified copy for you.

    If you cannot find one, you may have to go with the assumption that your ex really never did file, then you will have to get your marriage legally disolved before you can marry and immigrate to the US.
