  1. ok well once again thank you to everyone who wrote on this topic. i wish you all well and i hope your relationships go much better than mine. she and her daughter are boarding a plane from houston to colombia right now. yes she went home tonight. i took her to the airport, of course now i miss her alot. but it was just not going to work out. she will be home in bogota in the morning. thanks again all. i really appreciate you all writing. yes you too EAS and i really hope you have a great marriage.   2. i agree with most of your comments. i hope for the guy EAS who is dreaming of the wonderful life he will have when his fiance arrives is correct. what if she does not embrace your country? what if she is resentful about it all? what if she does not care to see your country. what if she is impatient and does not understand your words? what is she takes everything in the most negative way? what if she is a hothead? what if she disappears one day? what if she turns your own family against you? what if she says you are violent when she does not understand the meaning of the word, she can destroy you?

    it's easy to be excited when you have not lived it. what you described is what i expected also. it is not what i got. i spent thousands of hours with her online and i spent 2-3 months in her country before she came here. i just want her to go away so i can have my home, my life and my good reputation back. don't be naive. i realize i could have married someone local with the same outcome. i pray for you EAS that it goes well for you but don't be a fool like me. as you have done so far, do your homework and be as sure as possible before she comes. good luck to you EAS!

    himher comments are just not useful or necessary. you spend what i spent, sacrifice what i did then tell me its no big deal. this has cost me a small fortune for nothing. i hope it works for you. me? no mas!

    before i did this a friend of mine who married a russian woman told me "be sure this is what you want, plan to spend thousands of dollars and untold hours in paperwork, be prepared for years of struggle and then hope immigration works and hope the woman you pick is right for you". this is excellent advice for anyone. i would not recommend the k-1 process to anyone ever. divorce is rampant in us. somehow we think an immigrant will be different. NOT!

  3. I just want to say a huge THANK YOU! to everyone who took the time to reply to this post. Some really good advice and comments. As it stands now they are flying to their home country tonite. This is the 4th time I've bought tickets in 2013. I pray they go so we can end this. Neither of us are happy. We are both decent people but we have not been a good couple. I have been thru hell and back emotionally and financially trying to make this work. PLEASE be extremely careful if you bring ANYONE to this country on a K-1 Visa. Your life and your freedom hang in the balance. I'll post here tomorrow whether they went home or not. I pray they will go! God bless you all!!

    If they don't go tonight I am going to the authorities tomorrow (courts, immigration) and I am selling my house. Then who knows where I will go????? But I will go!

  4. do you want the domicile, or no ? YES MY RESIDENCE BEFORE THE MARRIAGE

    if no, simply remove yourself from it.

    if yes, go back to the court where you filed the divorce, and file an addendum of domicile, asking a judge for a removal order on the foreign spouse and child. Usually (in Texas) a county constable can enforce the removal order, if arrangements are made through the judge and the court. GOOD IDEA THANKS!

    re: financial obligations - study the I-864 that you signed. it remains in place regardless of divorce, until she becomes a citizen or has given up residency in USA or has amassed 40 quarters of income from working. OUCH! HAS NOT APPLIED FOR CITIZENSHIP, DOES NOT WORK

  5. Since you are divorced why are they still living with you? BECAUSE WE TRIED TO RECONCILE IN SPITE OF THE DIVORCE

    And do you know it is immigration fraud to file the ROC jointly since you are divorced. WE WERE COMPLETELY HONEST ABOUT THE SITUATION WHEN WE FILED FOR ROC, DOCUMENTS, DIVORCE DECREE, ETC.

    She should have filed with a waiver after the divorce. YES PROBABLY

    You are divorced, boot her out. What do the divorce papers say about the residence? DIVORCE PAPERS RELEASE ME FROM FINANCIAL RESPONSIBILITY AS TYPICAL, DOES NOT MENTION RESIDENCE. EASY TO SAY BOOT HER OUT BUT IF SHE REFUSES TO GO? SHE JUST REFUSES TO LEAVE! I CAN'T TAKE HER BY THE ARM AND PUSH HER OUT THE DOOR. THANKS FOR THE REPLY!

    However, since you no longer have a relationship with her, you will be within your rights if you refuse to support and ask her to move out. YES BUT SHE HAS NOWHERE TO GO IN USA, NO MONEY. I CAN'T THROW THEM TO THE STREET. You are not responsible for her and her child (although they do remain under your charge as per I-864). ARE YOU SURE? You can probably append this life change to her I-765 application just to make the USCIS aware of your situation. I WROTE AFFIDAVIT 2 WEEKS AGO ASKING THEM TO CANCEL RESIDENCE. But if they still opt to approve her the best option for you is to just kick her out of your house even if you can't get her kicked out of the country. I GUESS USCIS WILL FIGURE SOMETHING OUT IN TIME?

  6. question.. i am a us citizen who brought future bride to the usa on k-1 visa and we married in texas in july, 2010. while she was still on the initial 2 year conditional resident visa, my spouse (immigrant) disappeared one day after an argument. i, the us citizen immediately filed for and received a legal divorce in texas. we have since tried everything possible to reconcile numerous times over the next 2 years (from divorced 07/2011 to 07/2013) but the marriage is not supportable. we have filed an i-751 as a couple and await response from immigration after they requested additional documentation of the marriage relationship. again, these document were filed as a couple. the us citizen has purchased airline tickets four times in 2013 requesting immigrant spouse to go home. she refuses to leave citizen's physical residence. she also refers to citizen spouse as such things as abusive and violent which is not true. my immigrant spouse speaks english but she does not fully understand the english language and how damaging her words can be to a man in the us. i feel my reputation is threatened by her and i believe she is extremely verbally abusive to me.

    to complicate matters she has a 13 year old daughter living with us here in usa (attached to spouse's k1 visa). the daughter did return to her home country for over one year during the initial 2 year conditional resident visa. how did we get her back into the us? we just flew her back (with her mother) and hoped customs let her in. they did. the daughter now repeatedly refuses to leave the residence or the country. she just says "i won't go". i feel trapped. i feel i am being used to pay their expenses. we do not have a relationship. i do not know what i can legally do about this situation. their residence has been temporarily extended one year beyond the original two years while awaiting response to i-751.

    note; she (spouse left the usa from 05/2011 to 07/2011 and from 04/2012 to 07/2012 (breakups)

    the daughter left the usa with her from 05/2011 and did not return until 02/2013 (22 months).

    here are my questions..at

    what can the us citizen do to end this situation and get this woman to leave me?

    will immigration extend her residence for another 10 years under this circumstance?

    is the us citizen responsible for the immigrant ex-spouse's financial support forever in spite that we have not been married for two years now?

    do you know how to find a texas immigration attorney that will advise the citizen?

    final concern; it seems the immigrant has all the rights while the citizen does not have any???

  7. Why didn't you apply for a reentry permit at the time? That would have been good for two years. If they look at her passport closely at the U.S. entry point, they could send her back - it's been over a year.

    we did not plan for the stay to be over one year. do you think the child being a minor and her mother having been in the US all this time and has maintained her status correctly might help get the child back here? i know its been over a year and i know i have a problem. i'm trying to figure out what to do about it. thanks for the reply..

  8. My spouse has permanent resident status and has currently applied for removal of permanent resident conditions after 2 years residence. Immigration has automatically extended her residence/green card for one additional year while we wait for removal of conditions. My spouse lives here in US and has been here according to immigration laws since receiving her green card in 2010.

    My spouse has a 12 year old child who also has permanent resident status (granted the same day as her mom) BUT the child has been staying with family in her home country for the past 18 months. She has been in Colombia since 05/2011 but with permanent USA resident status since 2010. My wife is planning to go to Colombia soon to bring her minor child back here once again to live in the USA with us permanently.

    Will my wife and stepdaughter have any problems getting through customs in Colombia or USA because the minor child has been out of the country for 18 months? I believe that the time limit to stay outside the USA is 12 months with permanent resident status. My thought is that since both mother and child have permanent resident status and will be traveling back to the USA together that hopefully they will not have any trouble getting through customs. The only way customs can see she has been out of country for over one year is to look closely at the stamps in the child's passport. The mother's passort is fine. Otherwise everything is perfectly in order for the child's return.

    What do you think? Any suggestions and/or feedback is greatly appreciated.

  9. I am US citizen who married a Colombian citizen (female) 07/2010 in US on K-1 visa with 9 year old daughter on K-2 visa attached. Daughter returned to school in Colombian 05/2011 and has lived there since (over a year). Mother lives here in US with US citizen husband. Question; can the daughter return to US on current permanent resident status after staying out of the USA for over a year? What papers are required? She is now age 12.

  10. My spouse has been here in US on K-1 Visa since 06/10. We married 07/10. We have initial permanence interview coming up soon. We are arguing, considering divorce. She wants to stay here anyway. I don't want to be responsible for her financially for her lifetime. What will the interviewer say if we are honest, tell them we are having marital problems. Will they deny her permanent status? If we file for divorce will they make her return to her home country? Is there a possibility she can stay in US? I don't mind her staying but I don't want to be financially responsible for her either (sorry).

  11. I am a US citizen who has just filed the K-1 Visa Application to marry a woman from Bogota Colombia. I am searching for any tips that will make the process flow smoothly both here in USA and especially at the US Embassy in Bogota. She is very nervous about the interview. If you have been through this I would appreciate any information you will share with me. Any suggestions for needed immunizations, forms, expenses, problems at interview. Were the people friendly there? What will I forget to do or bring for her interview? Thanks & God bless! :wacko:
