  1. Hi,

my wife is a US LPR and will hopefully be naturalized later next year. I will be leaving the US to fulfill whatever is left on my 2 year home residency requirement (J-1). Fingers crossed, I will have fulfilled the requirement by the time she becomes US citizen.

My wife was advised by an attorney to submit an I130 while she is a LPR. We know that the case will be given priority and the petition will no longer be subject to numerical limit when she becomes a citizen. Granted, she does petition now, does she have to submit additional papers and/or call once she becomes naturalized? Will this shift cause a delay?

Lastly, what is your take on petitioning while a LPR who will become a citizen before a visa number becomes available?

    Thank You

  2. After reading a LOT posts under different categories and reading the timelines of different people, it appears that IR-1/CR-1 takes about the same time as K-1, maybe 1 month longer on average.

A big plus of IR-1/CR-1 is being given a Green Card upon entry, which is a HUGE plus in my opinion for someone that has established professional relations in the US and may have a job lined up and waiting.

OTHER THAN getting to know your fiance(e) before marrying AND/OR more convenient/cost effective to get married in the US, can you think of few solid reasons that one should choose K-1 over IR-1/CR-1?

    Thank you all

  4. Hello all,

    * I entered the US for the first time on a J-1 Visa

    * 1997-1998 I was on J-1 Visa with 2 year home residency requirement

    * Since 1998 - now, I have fulfilled only 6 months

    * 1998 - now, I have been on F-1 visa studying (undergrad, grad)

    * I have been engaged to a US LPR (green card holder) since July 2007

    * She will be eligible for citizenship Spring of 2011

    * January 2010 - I will go to my home country and I will terminate my Student status

    * I plan to stay there to fulfill the remaining 18 months

    * My fiancee and I plan to get married in the summer 2010 in my home country

    * After she becomes a citizen of the US, she will start the process of getting an IR-1/CR-1

    * At that time, I will have fulfilled my 2 year residency requirement

    Questons:

    1. Should I include copies of my F-1 and J-1 visas and related documents in the application?

    2. Which forms do these documents accompany?

    3. How will I prove that I have fulfilled the 2 year requirement?

    Thank you

  5. Hi everyone,

I can't express how sad, disappointed and frustrated I am. We submitted our application I-130 Aug 2008 and we are still not done with the whole process. In April 2009, we submitted two PCC from Australia and Malaysia to NVC but received RFE because of the expiration dates. Took a lot of difficulties to apply again and finally submitted to NVC in Aug. Called them today hoping for a case complete and was told that I need to show proof of eligibility when I went to Chicago as a student exchange in 2005 for seven months under J1 visa. NVC is asking for form IAP 66. The problem is i dont have the form. The form was submitted to get my visa. How can I have the form in hand? And the I-94 card was returned to the officer at the exit point when I left US. Can anyone please help? We submitted all they wanted in the RFE and now another RFE?

When are we gona be together that way?

I participated in a an exchange program from 1997-1998 and was issued a J-1. The program was sponsored by US Department of State (DOS) / educational....(I don't remember the specifics). I had lost my IAP-66, but was able to get an official letter from DOS stating the specifics of the program. I was told that they couldn't send me a copy of the actual IAP-66 because they keep those for only so long (I think they said 3 years) but the data is saved in a database.

Your best bet is find out who the sponsors are for the program. If it is the DOS, go to the DOS site for the program and they have a phone number in the bottom of the page. When you call, they will give you an e-mail for the person that is involved with the program. You contact them (be patent, I heard back after 3 professional e=mails) and they will forward it to another person and that person will send you this letter (FED EX, 2-3 days). Will take you about 1 month, depending how quickly they respond to you e-mails.
