  1. hello. I'm petitioning for my wife and our baby who, as of today, is 17 months old. When he was born I was a LPR; however, 6 months latter I become a USC.

    I filed both I-130 after I become a USC and we are now waiting for the embassy interview. My question is: will my son be able to apply for citizenship right after he enters to the U.S? OR Does he have to wait for 3 or even 5 years in order to apply?

  3. My fiance has her I-601 Waiver interview in Rio on the 27th of January. We have just about all the documentation together, but aren't sure the best way to actually assemble all of it to make a good presentation. Can anyone give good hints or suggestions for their successful I-601 Waiver packages...like what kind of binder, how many different sections you had, etc. I read an article that said the "marketing" of your packet to whoever will be making the decision is very important.

    Hello everyone,

    I received a call from 603.334.9400 this afternoon and they asked if I had a spousal visa petition and I said, "No, I have a fiance visa petition." He then proceeded to ask about my fiances name / DOB and which service center our case was at. I asked him if our case was approved at the SC and its at the NVC. He said, that is what he is trying to figure out but thinks there maybe a mistake with the spelling in the name. I proceeded to provide my fiances info to him along with my e-mail address at his request.

    I later on thought (WTH....this doesn't happen and I didn't get his name and he said if I had further questions I can call the 1-800 #). When I asked what he was trying to do, he said "we are working a different part of the case."

    I came home and called the NVC and they dont have my case and they fwd me to a supervisor and she was very nice and looked through each system and was not able to find anything. WHATTTTTT????

    I am soo confused. Has this happened to anyone before????

    P.S. Our case is straight forward, neither of us ever married before, I've never petitioned for anyone else before.

    1. Fact! NVC is complicated. I had two cases at NVC last month. I had many weird experiences with the NVC. I have found few "black holes" in their system.

    For example: my wife's cases didn't have any delays. our baby's case was delayed because they though I was not a US Citizen but a Permanent Resident.

    for our baby's I had to pay the $400 dollars IV Bill FIRST than the AOS Bill

    2. The phone number you placed is an actually department of state number so I wouldn't worry too much about scams or fraud.

    3. Here's the cherry on top of the cake. My wife case was complete on January 11 and I called today and NOW the AVR said that their are reviewing the DS230..........

    bottom line:

    Everything is possible at the NVC. Don't worry and keep us updated.

    I was trying to find a Step by Step guide or a Flow Chart for the process after your NOA2, I know that I saw one on here some months back but I cant seem to find it now. If anyone could include a link for me, or tell me how to look it up... I tried searching it already. I think it was a process that claimed if you followed it you could get through the process in 1 month... or something like that..

    Let me give you some advice. have every single document needed for the NVC ready NOW! NVC is fast and if you don't have everything ready you will slow yourself down.

    Very very important. check for your case # everyday. Put the NVC on speed dial. Once you have your case #, speak with and operator and give them your e-mail address.

    NVC can turn complicated so if you need help, ask.

    Just wondering for those that have been down this path before, how did you ship your fiancees things to the USA? I won't have big items like furniture or cars, but my fiancee has books, clothes, her daughter's toys, etc...

    We'll be shipping from Costa Rica to the USA.

    Hello. I have a similar problem and this is what I'm going to do:

    I know that I can take with American Airlines 2 luggage with 50 pounds each and one carry on with up to 30 pounds. So I'm planing to go with my wife to her interview next month at the embassy in Bogota Colombia; She is going to have those 3 luggages ready for me to take them back to the States. Then about 2 weeks latter when she gets her passport back from the embassy with her VISA, she is going to travel with another set of 3 luggage TOTAL : 260 pounds. We think that this is more than enough.

  7. I don't understand what you mean "sign in failed."

    They probably didn't give you the tourist visa because of the US PR link and the old asylum application. . .often they will not issue tourist visas if they assume someone has immigrant intent, which obviously she does. That is probably why she was denied the tourist visa.

    If the CO is truthful and your story accurate, then probably she will not need a waiver, however, you need to do a consultation with an EXPERIENCED attorney so that they can review all aspects of your case. . .things we cannot see or evaluate. Since you had court cases and applications pending, there will probably be no illegal presence, but we cannot make that determination like an attorney can.

    Laurel Scott would be a good one to consult about this case.

    Thank you for your answer. Ok I have all her immigration documents. She was never without status. I did a very detail "time line" and she applied for asylum with in legal tourist status. then the motion to reopen was filed and stamp by USCIS before the voluntary departure dead line.

    by the way. I learned here in VJ that when you are trying to log in at the NVC payment site and you get a message that says "sign in failed" is because your case is about to be complete.

  8. Hello. Ok a short story so you can see what I'm talking about.

    My wife came to the States back in 2000 when she was 15. Her mother applied for asylum. The asylum was pending until 06 when her mother decided that it was safe to go back to her country. She asked for voluntary departure for her and her daughter. The dead line was 08/02/2006. My wife was my girlfriend since high school so we decided to not wait anymore and get married. on 06/23/06 we applied for "a motion to reopen" before the voluntary departure dead line (08/02/2006) her mother left before the dead line but my wife stayed since we were waiting on the Motion to Reopen. In the last week of October immigration went to our apartment looking for my wife. We told them that she didn't leave because we were waiting on the motion to reopen. They took her to one of their offices and they let her go on the same day in the afternoon around (6:30pm). They gave her a new dead line 11/3/2006 (about 15 days) to left the United States. She left b4 the dead line. Some years latter, we applied for the I-130 (we were waiting for me to become a U.S citizen) The I-130 was approved and we had a sign in failed at NVC last week.

    We have a 17 months old baby boy and he was approved also at USCIS. He's almost done at the NVC (I send the DS230 just waiting for sign in failed)

    oh one more thing. I did an InfoPass about a year ago regarding my wife's status (deported or not deported) The officer she was very very very nice with me she said the only thing I see is a voluntary departure on her record. (She mention that she checked in both of her systems)

    and also FYI we applied for a tourist visa for her (you know the worst that could happened was a denied tourist visa) and the consular officer took a lot of time with us he ask me if our I-130 was approved already- which by that time it was still pending- and he reviewed a lot of thing in his computer. He went to the talk to other officers few times and after an unusual long interview for a tourist visa he said that the he couldn't give as a visa at that time but that we could try again with a different officer those were his words. He didn't mention anything regarding deportation or waivers.

    So with all this information I think you can give me a better answer to my problem.

    Do I need a wavier. If so, I'll take the waiver with me at the embassy interview next month but how does it work ? they will ask me for the waiver right at the interview and the will take a decision the same day ? Someone told my that it usually take ONE YEAR !!!!

    Please help me with this. If it's going to take ONE YEAR OR MORE I think I better move to her country to be with my wife and our baby. I will just give up

So, I finally got my oath ceremony date, Jan 11th, almost 50 days after my interview, and what is doubly annoying is my interview office does same day oath's, but since I live about 60 miles away they do not have jurisdiction over my zip code to do the oath. But... here is the great part, the office I have go to for my oath ceremony is almost the exact same distance away, simply in another direction. Anyways, at least I have a date!!

    The question I have is that there is a possibility that I need to travel internationally on the same day as my oath, I really do not want to reschedule my oath, but am wondering how much hassle I will get when I try to return to the US. Can I take my citizenship certificate with me and use it to get back into the country? Or am I stuck, rescheduling the travel is not going to be easy since it will be for work.

    I had the same problem My wife is in south america and I wanted to go and see her right after my citizenship, I ask the officer who did my interview (he was at the ceremony) and he told me that is not a good idea. can't travel with a foreign passport on one hand and US Citizenship Cert. on the other.

    You have 2 options: one is to get the passport ultra express it cost $200 dollars at the post office I did this the same day after my interview. The down part is that you have to give them your certificate of naturalization you will get it by mail latter. I received my passport in about 7 days.

    Go to the passport office: I don't know if this is available where you live but I'm in Miami FL and here there's a passport building where in some cases you could get a passport same day. I know it is not that simple. You have to explain why you need it so fast and the may denied to give you a passport same day.

  10. I noted in your other thread that someone said they never received an email, paid it anyway and it was fine. So maybe it would be better to also advise that if you don't receive the bill in X number of days that you call NVC to confirm that it can now be paid?

    What is the X number of days? How long does it normally take to receive that email once the fee is available to be paid?

    I think is a good idea, I have two cases at NVC (wife and baby) they made it to NVC with a difference in time of 10 days. So I compare each other.

    the IV Bill was "invoiced" at the payment website on Dec 16th in the afternoon (6pm+) and I received the IV Bill e-mail on the 18th around 4:30pm.

    The AVR message "IV Bill generation" was updated on the 21.

    a. Time to pay your IV Fee Bill

    Important note: Do not pay the IV Fee Bill until you have received the bill, via email, from NVC

    You should keep checking the website in item #9 to find out when the IV Fee Bill is available online to be PAID

    Once you have PAID the IV fee bill, in a couple of days it will post as PAID on the website.

    Print the bar-coded sheet from the IV fee bill website and include in your IV package and overnight it to NVC.

    If you are unable to pay your IV Fee Bill online, you will have to wait for the bill from NVC, and pay it via mail.

  12. Hello, This is regarding LingChe NVC Shortcut.

    I was using this guide and I found it to be amazing, I wouldn't be able to have so much control and confidence over my case without it. However, there's something highly important that this guide is missing and I think a moderator or senior member at VJ should add it to this guide.

    the issue is with the IV fee. This fee becomes available to pay (once the DS3032 is entered) at the NVC payment website few days before the agent (petitioner) receives the fee bill by e-mail from the NVC. A lot of VJ's members had paid this bill before receiving the invoice by e-mail from NVC and have fallen in to a "black hole" for about 15 days.

    I call NVC regarding this issue and their answer was that one is not supposed to pay anything without instructions from NVC. I think 10 to 15 days lost at NVC are unacceptable especially with the increasing rate of RFE that I have been seeing lately.

    So Do not pay the IV Bill before receiving the invoice by e-mail from NCV. Wait for the invoice! then pay.

    It has been 8 yrs since I sponsored my brother back home for his I-130. In these 8 yrs, 4 yrs ago I changed my address and notified immigration of my new address. Today I went online to check the status of my brothers case and it stated that they sent out a letter to my address on September 25, 2009 regarding further notice and need of documents for the case. But I never received any documents from them at all. I called up the toll free number and the address that they sent out the letter was my previous address and I changed my address 4 yrs ago and now I dont know what to do. Is there any expiration because the notice online says that until the required document is received this case is in suspension. I called the toll free number and they said this case has been denied since there was no action taken. I want to know if the letter was mailed out September 25th, and its only 3 months now can the case be denied in such a short notice even though it was not my fault since I changed the address. However, I know what has happened has happened. What is the best course of action now, will this have any effect on my brothers case being delayed further and how long will it take to bring it back on the right track. I appreciate your help.

    I think you should call your congressman ASAP! This will be a complicated case you should get as much help and experience advise as possible.

  14. We received the NO2 more than 6 weeks ago. The NVC still hasn't mailed us our case number. My husband called NVC to enquire but was told our case is not in the system. The NO2 instructs us not to call the USCIS Service Centre (California) as they will no longer have our file. Anyone know what we should do? HELP!!

    NO! 6 weeks is too much. Do an infopass and find out what's going on. You can call tomorrow try to talk to a supervisor at USCIS if he does not give you any info then the infopass is the way to go. My son's case took 3 week to get to NVC I was worried because my wife's case both approved at the same time made it to the NVC in less than 14 days. So I call USCIS, in spanish because their customer service in spanish is much better for me, and he told me that if by the 4th week your case is not at NVC, do an infopass; we will do a formal inquiry.

    if at the infopass you still don't get any answers, go to your congressman they have a special number and access at USCIS.

    Citizen on Dec.15,2009.

    mailed upgrade letter to NVC on Dec.15,2009.

    register Petitioner and benificiary email Address on Dec.17,2009.

    Please Share your advice and timeline.

    Dec 4: wife's case was entered at NVC

    Dec 9: Received the DS3032 and AOS Bill (I-864) by e-mail

    Dec 10: Paid the $70.00 AOS Fee

    Dec 11: $70.00 showed PAID. Printed cover letter and mail it next day DS3032 and AOS (I-864)

    Dec 15: NVC Entered DS3032 in their system.

    Dec 17: IV Bill ($400.00) Showed at NVC's Payment Website (DO NOT PAY UNTIL YOU GET THE BILL FROM NVC!!!!)

    Dec 18: Received IV Bill by e-mail and Paid IV Bill STATUS: IN PROCESS

    And that's my journey so far at NVC I hope on monday the IV bill status will change to PAID and I will next day the DS230.

    I have a little problem. I was waiting for the IV bill ($400) to show up at the nvc's payment webpage and it finally did it yesterday. However, I was told that I should not pay that bill until I receive an e-mail from NVC telling me to pay it.

    and.... NO e-mail yet!

    How long should i wait! can't resist the temptation to pay it much longer.... :wacko:
