  1. When I came back from Canada last week, there was one question I was asked twice by two different CBP; ie. how long have you been leaving USA. I told them 16 days. It seemed to me at the moment that they were serious about how long I had left the country. If you leave too long they might deny your entry unless you have a damn good reason even though you have your AP. On the AP, it clearly states that CBP has discretion to let you in or not.

    Also, as other VJers said, your plan have flaws. You would expect to stay here at least three months (most luck senario) after you file AOS given that you do not get any RFE or fingerprints re-print etc.

  2. Hi guys, got a question. I just got my EAD card last week while I was in Canada and now I'm back to US. So I'm ready to send out the copy of my EAD to Service Canada and start collecting EI. My question is the names are a bit different; for example,

    Name on SIN: Mei Fong Chan (Legal name in Canada)

    Name on ROE: Grace Mei Fong Chan (Grace is AKA name used on tax return, student loan, bank account etc)

    Name on EAD: Grace C Brown (C is the inital of middle name which was added after married and Brown is the married last name)

    I know it's a bit confusing so I'd like to know how to make it less confusing. Would sending marriage certificate and a letter with explanation help?

  3. Did you already have your SSN? I took my driving test when I got here... obviously the DL expired with my I-94. So when I got my EAD I went to renew and they told me that "they couldn't confirm my lawful presence". Is this because my Maiden name is in SAVE? I'm not understanding...in fact I'm annoyed. Anyway, they put in some request and said to come back in five days HOWEVER I've been reading on here how it's taken some people at least two months to have been updated #######?

    Ya that sucks! This time I will make sure all the prints "Passed" before I go.

  4. Well we finished my husbands medical today.. He had a positive TB test from the skin test they give so we had to go get him xrays.. They said he was all clear Thank God!! The doctor said the false positive was probably due to my husband getting a vaccine from his country called BCG.. Its not given in the US just under developed countries.. But anyways hoping to have his papers sent back to USCIS monday.. Does anyone have a clue how fast USCIS usually approves(HOPEFULLY) after they accept the RFE back?

    My case resumed two days after they received my RFE. But I have not had any touch since then. Good luck!

    Received AP today. Hubby is going to Fedex it to me :dance:

    Now down to AOS only. Hope to hear some news soon :clock:

    Correct me if i am wrong you guys, but about your case that wasn't transfer or no interview, i saw a few cases that where not transfer and after they got the EAD approved they got the interview letter not far from there... So probably if you are going to have an interview is on its way with the EAD, is my humble opinion...

  6. I got a e-reply about my AOS..and it's an RFE..:( I didn't receive the actual letter yet, but I'm guessing it's about my fingerprints coz I took it twice. I read in some forums here that even if you take the biometrics twice,the FBI still can't read it. :( I may have to pass a police clearance from Norwalk Police Station then which is quite far from here..but manageable. I'm just assuming..hehe. But i'm hoping that's just my RFE and nothing more difficult.

    To CQ & CS: Hang in there, as long as you don't get any RFE's, you're good. Also, try to keep track of the length of the processing period..once you're way past the acceptable time frame, call them and follow it up. :) Goodluck!

    Didn't you get you EAD approved already? That means you fingerprints are okay and that's why they approved your EAD. I might be wrong :unsure:

  7. here we go i had my rfe in the mail yesterday and they want another medical from me.

    so if you read my last post where i was talking about that mysterious small white envelope i know now what is inside of it: a copy of my medical. gotta contact USCIS now and see if we can send that since well i guess they wanted it in the first place which wasnt mentioned anywhere and well i guess none of you guys ever had such an envelope.

    I had that envelop and I had to pass it to the IO when I had my K-1 interview in Vancouver. This was one of the requirements on the check list. Not sure if it's the same in Germany.

    Anyway, contact USCIS and see if you can use it. It must be within one year that you had your medical exam though. Good luck!

    Hope you're doing well.

    We're using the template provided on the site for the letter of intent. Should we add anything to the template in terms of the body of the letter? Or is what's in there enough?

    The real question is which address do I put in for the USCIS service center? Do I put in the Dallas Lockbox address? Or should I assume that since I live in California, that our petition will be sent to CA and use that direct address?

    Are you including your Letter of Intended with you I-129F application? All application should be sent to TX now so I would put whichever address that your I-129F sending to.

    I used the exact body paragraph on my letter (change the names of course).

  9. In real life, the Affidavit of Support is a non issue. Enforcing it would require the US Government to sue the immigrant's sponsor in court. It is very doubtful that this will happen in any but the most severe circumstances where an immigrant has unlawfully accrued tens of thousand of dollars in federal (not state!) money.

    This is exactly what my husband meant. You are right on! :thumbs:

  10. Not sure if this is the right session to post this. Feel free to move it if it's not.

    While reading a post last night about a member here abandoned his wife and wanted to divorce her before her AOS, I had a discussion with my husband on the enforcement of Affidavit of Support. Some members in the thread said he should at least help her get the GC and then divorce her so that she wouldn’t be disgraced by her family.

    I’m not judging if the OP was right/wrong; it was a complicated situation and there are cultural factors involved. However, if I were him, I would do the same thing to pull the Affidavit of Support in order to protect myself. And here’s how the discussion started. My thought was if the GC was granted, the OP would be financially hooked for 40 quarters of work until his wife becomes a USC, cease to be a LPR, or if s/he dies etc and divorce would not get him off the hook.

    My husband’s thought was that the Affidavit of Support thing is hardly enforceable. Even if it’s enforceable it will take so long to have a hearing in the court.

    So how serious and enforceable is the Affidavit of Support?
