One of those things, if work is a priority, then marriage first, and apply for a spouse visa is the better approach, CR-1 spouse visa costs less overall, and gets green-card upon arrival to the USA, could conceivably take a job the same day as arriving in the USA, even have one lined up before coming to the USA on the spouse visa...

    K-1 is a fiancee visa, not a work visa, the K-1 is an option offered for cases when US citizen getting married overseas is difficult or impossible due to laws or requirements overseas that prevent marriage, however this is not the case in the USA. Many use the K-1 traditionaly as a "Fast" visa, however due to improvements, it is not much faster than the spouse visa.

  2. They don't give EAD at JFK anymore. You need to apply for EAD and it USUALLY takes 3 months from the filing date. How soon you can work depends how soon you are getting married upon arrival. The sooner you get married the sooner you can apply for AOS and the sooner you get your EAD. If you wait three months to get married then AOS, it could take 6 months+ to start working legally in USA.

  3. Did you call the customer service? It happened to me too. I called them 30 days after I received my NOA1 and they told me I had a RFE :angry: and that's why I did not have biometric letter. After I sent the response of RFE I received biometric letter right away.

    I know some people receive bio letter shortly after their NOA1 and then RFE later if that's the case. But in my case, it seemed that they hold on my bio letter until I fullfilled the RFE. It all depends how the IO handle your case.

  4. Yes you can but petition for a sibling is the 4th priority of the "family preference category" and there are a limited numbers of visa available in this category. I read somewhere in this forum that it take years to petition a sibling to come to USA and he cannot wait in USA.

    May be it is way more easier for him to get a work visa and adjust from there. I'm sure other VJers have better suggestion than mine.

  5. Yes she will be "Out of Status" as of tomorrow but you have filed AOS so that is another story. By the time you get your AP to travel you should have had your NOA1 for I-485 already. Usually, USCIS sends NOA1 for all of them (AP-AOS-EAD) at once so you should be expecting three NOA1 from mail. According to the timelines, it takes approximately 10 days from the date they received your package. But some people wait longer/shorter than that. You are still less than 10 days so sit back and relax!

  6. Well..I am privileged to have 4 names listed on my birth certificate..lol. I only use 2 of them which are the 2 in the middle. All my documents have the 2 names i currently use..so I guess she was informing me that my green card would have a different first name from my other existing documents. I guess I'll have to walk around with a copy of my birth certificate or do a name switcheroo.. :blink:

    Did you put the middle 2 names as your desired name on your AOS application? The reason I'm asking is that my birth certificate and canadian passport do not have Joyce as first name but my HKID has. I put Joyce as first name on AOS application. I applied for a legal name change but the hearing date is not till May. My EAD and AP both have my desired name so I'm hoping my GC would have the same name too.
