  1. well its really not fair that we are paying for their mistakes nd we are citizens nd its a genuine relationship with legit papers. They should think of a better system because real ppl like us are suffering but frauds are coming into the country anyway like tht kid tht came here nd ruined Bangladeshis reputation how come he got his visa when he was not qualified for student visa....my case have been processing for a year when some fraud marriages gets visa within 6 months plus women get visa so fast how come they r not suspected of using the husband for a visa cuz I heard abt ppl who did tht. Its just not fair. They need a better system nd not make ppl like us suffer nd go crazy like this atleast give us a legit time frame.

    You are right - they need a better system. But at this point, it is what it is. I am not saying everyone who gets AP goes through the same thing, some just gets the FBI clearance, some not even that. But you have to think from their point of view - you are claiming that your case is genuine, but so did the ones that committed fraud - how would they know you are genuine and they are not? This is how they know.

    I am not saying their system is 100% correct - but you have NO right to demand anything. Immigration is NOT a right, just be glad that they have an immigration system in place.

    If you are from Bangladesh, you know very well that at the Bangladesh-India border, the security shoots anyone who tries to cross border illegally. However, even though the situation at the US-Mexico border is a million times better, people still criticize it.

    You are not in AP because of missing docs or lawyer f-ups. If there were missing docs, they would ask for them.

    The Dhaka consulate is a HIGH-FRAUD post and they know that the docs an applicant supplies could have been obtained an hour before it was submitted, with false information. Everyday they deny good number of applicants for submitting counterfeit docs that are ACTUALLY OBTAINED THROUGH LEGAL PROCESS FROM PROPER AUTHORITIES - so the documents themselves are not fake, but the info on it is. If you go to Dhaka Embassy's website, they clearly mention the most common type of frauds they encounter - age fraud, marriage fraud and what not. A 25 year old can get a birth certificate that would show an age of 19 in order to qualify under F2A, unmarried couples can get marriage certificate that shows they are married, Nieces and nephews listed as children so that they can be considered beneficiaries - you name it, anything. At Dhaka consulate, DOCS MEAN NOTHING. So, if they have the SLIGHTEST suspicion - let me rephrase it - if they are not overly confident that your case is genuine, they will VERIFY THE DOCUMENTS. That's AP for Bangladeshis (in addition to the regular FBI checks).

    I read on another forum about this three Bangladeshi brothers who were petitioned under F2B (they were over 21) by their LPR mother. One of the brothers was married but they hid it in the visa application since that would disqualify him under F2B. The embassy sent investigators to their village home and spoke with relatives, friends, near-by living people and found out about it. All three were denied and forever barred from coming to US. Doing this sort of field work takes time. TRUST ME - they know ANYTHING AND EVERYTHING about our culture and what's right and what's wrong in our culture - probably better than we do - since they literally study these things. They know that when you say you are the 3rd daughter in the family but married while the older two are not - IT'S A RED FLAG!!

    In short, this is really the result of the tens of thousands of attempts to defraud the US Embassy by our fellow countrymen. You are really paying for their misdeed. I FULLY support the embassy in their effort to reduce fraud cases. If your papers are genuine - then AP is just a matter of time. I know my papers and info are 100% genuine so it's just a matter of time for me.

  3. That is partially true. If you wait too long you can lose your refund. You must file your 2012 tax return on or before 4-15-2015 or you will lose your refund.

    No, what I said is 100% true. You are confusing "filing return" and "getting a refund" as if they are the same. I didn't make any statement regarding the refund amount. There is NO time limit as to when you can file your return. If you do not owe taxes, there are no penalties.

  4. This afternoon I checked the CEAC website and it said that the file was touched today and it read "Issued". I called the State Department to see what we need to do next and they said we are still in AP. I re-checked the CEAC website and it is again saying AP. I triple checked the website when it first said Issued to make sure I'd entered everything correctly and I had. It definitely said Issued. Has anyone else been through this?

    I'm sorry I don't have any info that might help you, however, I do have a question. Before your case status was changed to "Issued" (even though briefly), were there a lot of "status update date" changes?

  5. I'am a tax professional and my opinion is that you file a “Married Filing Joint” return with your spouse,upon her procural of a valid US Social Security number. You can file for an extension, then you have until October 15th to file your taxes with IRS. This will comply fully with all US filing requirements and afford the best tax scenario. I am in a similar situation as you are and will do the same.

    If you are not due any taxes to IRS, you can file ANYTIME without penalties. It doesn't have to be by Oct 15.

  6. send them what they ask from you...May be u will get good news... i get this email from embassy last year in March 2012.. But after sending these documents i am still waiting .My 2nd medical going to expire in next month

    I just don't understand the need for an updated medical report while a case is pending for months. Why can't they just ask for the medical report once they are ready to issue visa? Besides the hassle, it also costs money.

  7. They moved it to October? I bet mid-October, it will say that it will be reopened in November!

    "By the middle of October" .. !!! End of September came and gone, middle of October also came and gone..

    I think we live in an era where "promise" means absolutely nothing. We are becoming MORE AND MORE shameless in our conducts and in our words. Even the government works like it is a greedy corporation.

ClearBlu - I am making no assumptions here, but let me tell you something: There have been thousands and thousands of American citizens who has filed for their foreign born partners / spouses are now considering themselves victim of immigration/marriage fraud. Absolutely everyone of them NEVER had one shred of doubt about the "true and bona-fide" nature of the love of their partners. Just like you, ALL OF THEM were ecstatic that they found true love. Rest is history.

    Just a week ago, I had literally saved a co-worker of mine, who at age 52 was desperately looking for love/companionship and was just about to be conned by this guy from Ghana. Believe me, for a few days, she HATED me, accusing that I was jealous of her happiness. Now she is forever grateful that I stepped in.

    Once again, we are happy for you that you found THE ONE!! And we hope it stays that way. Since we have no other info, we can only present information so that you don't get hurt.

  9. Hello VJers, Ok so i waited and called DOS after a month in AP and was told pending AP. Waited for 2weeks and called again. Was told pending review at Embassy in accra. Don't know why its pending AP in accra. So i called again after a week and was told review at the embassy in accra just to be sure. Dont understand y its back in accra and not Washington. What do you guys think. I know nobody knows what goes on in AP but just want to know what you guys think.

    AP doesn't necessarily mean it's a security check. Many high-fraud consulates do not trust the locally obtained papers/documents submitted by the applicant (such as birth certificates, marriage certificates) and in those cases their FPU (Fraud Prevention Unit) gets involved. Typically FPU consists of local, non US citizens who are very familiar with the local culture and customs and these guys would make off-site visits to verify the accuracy of the information given by the applicant. That's an internal administrative review.

Actually, it doesn't even matter what OP's intention was with his first wife - USCIS prohibits LPRs from petitioning a spouse if the LPR obtained his green card through marriage to USC and the time since obtaining green card is less than 5 years. OP had the GC for few months at most and the petitioned for his wife #2. I don't know how he was able to get USCIS to even accept / approve the petition.
