Hot Guy- I know this whole process sucks... and it is made worse because we never get any information. The whole idea of waiting without knowing for how long; or what the outcome will be is driving me crazy.
I think I would be even more frustrated if they kept asking me for things like they have with you.. at least in my case, all has been quiet since the interview in April..
I would like to know this whole thing about 'sending the case back to US'. Would they tell you? Why might this happen? Would you have to start the whole process over again? I know there is some sort of "expiration" thing... which I am praying automatically gets renewed.
Agh- too many questions about everything!

Ap is the worst part for that journey and i'm really sick of waiting .we contacted everyone to help us but the white house .and still no news .i even asked the embassy very direct question and i told them to give me a direct answer i said '' are you going to give me the visa or you will send my case back to USA so it will expire and they will close it there ?'' they said the case is pending Ap LOOOOOL.
Well about sending the case back to USA yeah they should tell you that they will send it back to USA for futher review but sometimes they don't say anything about it .cause they don't want you to argue about it with them .and you will not know till the USCIS send you a letter saying that they get your case !
Why might that happen ?
Petitions/applications are returned for a variety of case specific reasons. Returning a petition/application to the USCIS means that the embassy/consulate refuses to issue a visa to the beneficiary, but they do not have specific evidence to actually deny a visa application. So the next best thing to do is return the petition/application to the USCIS office where the petition was originally filed requesting further review and ultimately recommending revocation.
Well talking about if you have to start that whole process over again .yeah maybe you will have to do that.cause in most cases after the USCIS get the case they let it till its expire .and once its expire it means you have to start that sh*t all over again .
here is what will happen if the embassy send the petition back to USCIS
- 221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.
- Petition is returned to the United States by the interviewing consulate for "further review" in what is called a diplomatic pouch.
- Returned petition is received by the NVC. It is reviewed and entered into the fraud database by fraud management.
- Returned petition is sent to the local USCIS service center where the petition was originally filed and approved.
- Local service center receives returned petition.
- Local service center who processed the original petition sends a notice of receipt to the petitioner.
- Local service center reviews the returned petition and consular officer notes on the case.
- Local service center then sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.
- Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.
- Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either original approval is reaffirmed or the petition is officially denied.
- If the petition is denied the local service center sends the petitioner an 'official' denial letter. This can be officially appealed if the denial letter states such.
- If the petition is reaffirmed the local service center sends the petitioner an official notice of reaffirmation.
- Local service center sends the reaffirmed petition AND its evidence provided in the rebuttal directly to the consulate along with a recommendation to issue a visa.
- Consulate notifies the beneficiary of a new interview date.
- Beneficiary has interview for the reaffirmed petition and the visa is either issued, or the case in placed in Administrative Processing which after cleared a visa is issued, or worst case scenario it is denied via Section 221(g) and returned again to the USCIS with a recommendation for revocation.

hi brother i wish i can tell some information about that but really i dont know cause you never understand their next step or act but i will keep praying for you to get it so soon i know well how hard its wish everyone on here done this waiting time ,, today my wife called the DOS then told her no other step just co review then stamp it and mailing the visa to your husband then she asked how long it gonna take she said from one to two weeks ,, so hopefully she said the right thing to give it just short AP , i hope the best for you brother also i do agree about they wont send the case back to us or deny it ,, best luck.

hi all ,, i know its earlier asking about this issue cause i didnt get my visa yet but its important to know to everyone , my question is .... where the imgrant officer start to check your paper is at the first airport you arrive or if you have another flight they let you go and check it at the state which you will arrive at the end of your flight? for example lots take a flight to NY(JFK) airport then take another one to go to any other state like LA or AZ or what ever and time between the two flight three hours or four waiting between each flight so if they start check your papers on the first airport or let you go then check it at the last airport ? this is important to know cause if they check it on the first one need to know how long they take if longer they can let you miss your next flight and i heard they took longer time to check your papers so please any information about that to let everyone know and manage the flight as well choice the right time between the flights and all , thanks so much .

Who is eligible for a K3 visa?

19. A spouse of a U.S. citizen and unmarried children of that spouse may be issued K3/K4 visas. Note that an unmarried child of a U.S. citizen who is not also the child of a K3 is not eligible for K4 issuance; rather, the U.S. citizen must file an I-130 petition for IR2 status for his/her child, see Ref E, 32-33.

How does a consular officer determine K3 eligibility?

20. USCIS must approve an I-129F petition/K3 petition before post can process the K3. Post will receive approved I-129F petitions from USCIS via NVC by scanned e-mail, see Ref E, 7-14. As is the case for K1 fiancé petitions, consular officers are not delegated authority by USCIS to approve K3 petitions. Posts may, however, revalidate K3 petitions, which expire four months from the date of approval, for additional four-month periods, under the provisions of 9 FAM 41.31 N5.2.

What is NVC''s role in processing K3 visas?

22. NVC receives an approved I-129F/K3 petition from USCIS, performs the NCIC namecheck, and forwards the petition to the processing post by scanned e-mail. Posts must keep NVC informed of any changes in the e-mail address at post to which NVC is sending these cases. Send a Visas Hawk to NVC for any derivative at least 16 years old for whom no NCIC has been run. NVC also sends a letter to the U.S. petitioner to let him/her know the case has been forwarded to post.

Processing/Issuing K3 Visas
---------------------------
23. Standard IV processing is followed, including NCIC namechecks, police certificates, pertinent birth/marriage/divorce/death certificates, standard IV medical exam minus the vaccination requirement, and relationship bonafides, Ref E, 18-25. Unlike K1s and K2s, the IV system will not yet accept K3 as a visa class, and so the systems processing takes place exclusively in NIV. K3s must be issued in the country where the marriage took place, unless there is no IV or NIV issuing post in the country, see Ref E, 15-17. Applicants fill out two copies of the DS-156 NIV application form; they are not required to submit the new DS-157 form. Note that neither an I-864 or an I-134 is required; K3 applicants must present the I-864 when they adjust status in the United States with USCIS. Posts should not routinely require an I-134, except in those cases where the consular officer deems it necessary to overcome any public charge considerations that might arise from documents presented or the interview.
24. Unlike the V, and in the same manner as the K-1, K3 visas must be accompanied by a standard IV-style packet of documents, minus the affidavit of support. The K4''s documents may be included in the K3''s packet.

Revocations of V and K3 cases

25. The underlying I-130 petition for a V case is either in storage at NVC or pending approval in an USCIS office. To ask USCIS to reconsider the approval of a petition, post first needs to determine the location of the petition. Begin by requesting the I-130 IV file from NVC. If NVC has the file, post writes the usual revocation memo, attaches any available USCIS I-797, USCIS receipt number, IV case number and returns the file with the I-130 attached to the USCIS Missouri Service Center which handles all LIFE Act processing.
26. If NVC does not have the I-130 underlying petition for the V case, post may assume the case remains with USCIS. Post will write the usual revocation memo to USCIS with an explanation of why the I-130 is not attached, include a copy of any available I-797 or other documentation such as an USCIS receipt number, and send it to the Missouri Service Center.
27. To revoke a K3, post must obtain the original I-129F petition from NVC. Write the usual revocation memo with relevant attachments and send it to the Missouri Service Center.

Processing V Applicants Who Obtained a Change of Status to V from USCIS in the United States

29. V eligible applicants may obtain a change of status to V from USCIS in the United States. They will receive an I-797 in which the case type in the upper right is marked "I-539, Application to Extend/Change NIV Status." V will be indicated after "Class." The notice informs the applicant that if they depart the United States, "he or she must obtain a new visa in the new classification before returning to the U.S." V status holders are unable to reenter the United States without obtaining a V visa.
30. Such applicants should be listed as V-eligible in Class or the CCD, and this would confirm the information on the applicant''s presented I-797. If they are not listed, contact NVC or post''s regional officer in VO/F/P for assistance. USCIS has no reason to forward the I-539 to NVC as the applicant would most likely continue to process with USCIS rather than with an overseas consular section. But applicants may opt for overseas consular V processing.
31. Such applicants must undergo standard V processing, including the medical exam, police certificate, and all the requirements in Reftels B and D. If the NCIC is not done, send a Visas Hawk to NVC.
32. It will be left to post to determine how to schedule these applicants for V processing, based on post''s workload or other considerations.

LIFE Legalization Applicants

33. Aside from the provisions of the LIFE Act that created V and K3 visas, another section provides for legalization of those aliens who entered the United States before January 1, 1982 and who are registered as members of one of three class action lawsuits. USCIS has sole responsibility for determining eligibility of and processing these applicants. However, post may be asked to fingerprint an eligible applicant or his/her dependent that resides overseas. Instructions will follow septel.

Future Role of Kentucky Consular Center (KCC) in V and K3 Processing
--------------------------------------------------------------------
34. In the near future, KCC will take over NVC''s role in LIFE Act processing, and mailings to applicants and petitioners regarding V and K3 visas will originate from KCC. I-129F K3 petitions will be relayed to posts via KCC rather than NVC, and KCC will maintain the post contact list that is now sent out with each V letter to applicants and petitioners. V-related 2nd preference petitions will continue to be held at NVC. Further information on this change will be available septel.

my wife called the DOS again yesterday then the agent told her yes now it says the embassy got the divorce certificate , so today i got an e mail from the embassy says we got the divorce paper and its pending to the officer to review it then when it complet we will process your case ,, so they add one other step cause i thought once they got it they will process it and issue the visa , also the DOS says the embassy in cairo at this time now are so busy , so hopefully they done it soon , just love to tell whats going on , wish the best luck for all .

i'm so frustrated but i want to tell everyone on here again an advice before the interview , let me say first something to explain to you all ,, today my wife called the DOS and the agent told her yes now the embassy in Cairo received the divorced certificate then my wife asked her so when my husband will get his visa she said well there is no time about this so my wife got so mad and told her how come where and who i can go then to ask then she said embassy in cairo working like that so noone knows .. then my wife told her can you give me a specific place to asking about my right then she said i dont know , so my wife asked her well is my husband on AP she said yes he is and i will tell you something that is embassy in cairo always put everyone on AP and more when a missing documents came this cause more AP so they can send him the visa within two weeks or two months or more so my wife said to her well can i contact a congress person she said you can then she asked her what if i went there to the embassy myself and asking them for our right to done the visa fast is it working then she said yes it can works very well ,, sorry to be longer but i want to tell all of you this and here is my advice after all of this .... dont miss any documents when you go to your interview ... if any of you got divorced before bring with you the original divorced certificate , if you lived in other country more than one year dont forget to bring with you the police recored from this country , take with you all the original certificate such as birth, militrey, marriage ,, i just dont want anyone who will have the interview soon to give them any reason to make a long AP as AAP which mean adinal administrative processing,, i dont know why they act like that and make it as a big deal , i think as all your papers work right so no reason to cause a huge delay,, good luck for all , may Allah with all of us with this waiting and hard time.

That's a relief your getting your visa yasser/fatimah. Your interview is just 6 days before ours was and Betsy El Sum's a little before that and they got theirs. I hope this is a sign they are getting through all their final administrative review files and we're next along with the rest who are waiting!

I really need help from my fellow Egyptian vj'rs............is your husband's military certificate from the MINISTRY OF DEFENSE also???? It doesn't matter if he's exempt or not........
I'm gathering evidence from official Egyptinan Government websites that the MINISTRY OF DEFENSE is the ONLY place that issues military certificates, to send in with his extra military certificate that he's getting this weekend to send to NVC with our RFE.
The NVC seems to think that there is still a MINISTRY OF WAR that exists, and it does not exist anymore, NVC's info is outdated.
I've had our case forwarded to a supervisor bcz we got an RFE for his military certificate, they said it needs to be from MINISTRY OF WAR, not MINISTRY OF DEFENSE, and I told the operator to tell the supervisor there is no longer a MINISTRY OF WAR!!!!!!!
We are going nuts trying to understand why only we are getting an RFE for this, or are ALL Egyptian petitions getting this RFE????
We appreciate if you can let us know if your military cert. is from Ministry of Defense, too. THANKS

hi ,, i and my wife used k3 so i'm not sure if its the same or not but all i can say my military certificate wasnt from Ministry of war it was as your husband from Ministry of defense and works fine even when i sent it to the embassy in cairo and showed it on my interview so the NVC will accept it dont worry , here is no Ministry of war no longer ,, wish it can help you , best of luck .

this post i made here right now not for me this for my friend Ahmed his wife in VJ too and suerly we all here to help each other ,, so he have a big problem i tell you wish someone can help to calm him down ,, well he was with me same day doing his interview hes K3 also our interview was OCT 22 .2009 so three years ago he living in France for like five years or four so the CO asked him to sending him the police recored which from France to show it in the embassy in cairo so the problem is he was illegal there also he left France three years now so he dont know how he can bring it to the embassy in cairo , on other hand if he cant get this police recored from france so is that means they won't give him his visa or what ,, please if someone pass that before or know anything about this issue tell on here to me tell him and calm him down , about me i still waiting to hear anything from the embassy or atleast they say yes we get now your wife divorced certificate , wish all the best luck to everyone and done this journey with happiness , thanks to all .
mounir let me say first hw much i missed u my brother u really good man to aske help for afriend any way i will help u as i can first i want know is he was stay there illigal and then be ligal or what if he in this case i think thats okay cuz i think what can show in police record if they caught him when he living there illigal and will give him some thing called (stop list) that mean he is not allowed to back to this country for 3 years but if he kill or do any crime there he will get some thing call(black list) and thats not allow him to come gaine to this country so i think the situation with ur friend will be okay he just should go and aske in france embassy and they might help him more i just told u what i know and if iam wronge hope from my friends here to fix for me.god with u my friend

thanks to all of you , i know all everyone on here is helpful , i keep saying everone on VJ is great , i will try to relax , my wife called the DOS today and the agent says the same as the embassy have had e mailed me ... we are waiting for the divorced certificate , then she told him but we checked the DHL website and it says its there already then he said well give the embassy one to two weeks to process then she said whattttttttttttt how come take this time once it there already then he said well you can call the embassy and ask cause it all depend on thier speed of system ,, so guys i cant deny that i'm kinda sad cause i thought after my interview and how it went smoothly everything will be fine after i send them this documents then i will get my visa within two weeks as the CO said but seems as all you said they so slow and i'm in AP now wish not took longer or cause huge delay , thanks again for all of you , best luck to all .

The same happend to us, they usually put u on 3 months ap before issue the visa, this is the normal procedure when u forget any document, after 2 or 3 months they will send back the passport. Just wait everything its ok, if u start pushing them they will delay u more.hi to all , after i done my interview OCT 22 they asked me to send them my wife original divorced certificate cause they need it and then they will issue my visa , so i sent it to them last Sunday then i kept e mailing the american embassy in cairo to ask if they get it or not they keep telling me they didnt get it yet ,, so i called the DHL company to ask then they told me yes the embassy receive it Monday morning and you can check it your self online with your shipment number , then i did and they were right it says the embassy received it Monday morning and i sent this page to the embassy too as PDF file but still get the same mail from the embassy telling me they didnt get it yet so i called the counslar secation in this number 27972200 they said we cant answer any question on the phone you must e mail us and not let me ask ... i tried also the other number which is 090070600 but they didnt know either so please if anyone on here knows an excat number to check the visa statue and asking how the DHL says that my documents arrived in the embassy and they said we didnt get it yet , i'm so confusing dont know what i can do to be sure they get it ,, cause some says they took some time to arrange the mails to sending it to the right secation so i wonder how long it take , please help me if anyone knows the right number to call and talk to someone ,, thanks to all of you ,, by the way i'm k3 visa .

We had the same problem when we called, we were told to email. DHL website said they recieved it but when we called DOS to check it wasnt enetered into the system yet. It took almost a week to show they received it. Try not to worry b/c they are so slow in Cairo! Good luck....hope you receive it soon!

i want to add something it might give a good information to all of you ... when i was in my interview was with me a friend by the way he and his wife here in Vj he like me in k3 visa and have had same date as me for the interview OCT 22 but he went to France from three years ago and stayed there five years so they asked him to send them the police recored from France cause he stayed there more than one year and they need a poilce recored for each country the person stayed for more than one year and gave to him his passport back saying send us this police recored we cant issue you a visa until you sending us that ,, so i wish he can do it cause he left France for three years right now wish all the luck to him ,, just i want to say that on here to let everyone knows so if anyone did the same then he or she get ready and get this paper ,, i will send the embassy soon the divorce paper they asking me for then waiting for my visa , best luck to all of you and thanks so much to all of you guys .

hi everyone on here ,, before i start saying anything i just want to say really all the people on here is just a great people lots of them helping me and wish with all my heart for everyone most of the good luck and the best always ... now i will start saying my experince for my interview which i done today OCT 22 .2009 in the American embassy in Cairo to let you all know .
first of all i was there at 6:45 then they start call us to make two lines one of imgrant visa other for the other visa so we were inside at 7:15am everyone got a number and we sit then they start working at 7:30am then they start to call for the papers work was an egyptian woman who checked my papers work and she said everything was fine except she asked me about the divorced original Certificate for my wife cause my wife divorced before so i said i dont have it then she said no problem you just later dhl it to the embassy then all my papers was fine i tell you what the papers :
1-original birth Certificate
2- original marriage Certificate the arabic one and englishe one.
3-original Military Service Certificate
4- my passport .
then she asked me to go to pay the dhl fees was 67LE (egyptian pounds)
then i sit and waitied for the another call which for the finger print then they called me to to finger print i did that and i went to sit again wating for the last calling for the interview which we all waiting for lol.
then they call me to go to my interview and really guys the interviewer was a man around his 45 or 46 he was so so nice and friendly asking so some few questions not so hard really or silly questions and treat me with smile and good respect i will tell what he asking me to it might help all of you ..
he said what's your ful name ,,, for how long you know your wife ,, what's her name ,,, how you know your wife ,, when did you met her in person and for how long ,, when you and her get married ,, what do you do for living here ,, what your wife doing for living ,, where your wife live in the USA , what you plan to do when you go there , have you ever been in the us before ,,, then he asked me do you have a pictures to you and your wife while she was here and yes i said and i show him some of our pictures ,, he said thats cool everything is fine , then he said well we just need from you the original divorced Certificate from your wife and he gave me a form which says my case number and my name saying i need to send to the embassy my wife original divorced Certificate ,, he said i can send it from here by DHL or she send it from the us to the embassy by DHL also , then i asked him and when i can get my visa he said after you send it to us then you will get your visa within two weeks ,, so i wish he said the truth but the interview was nice and easy not hard at all really ,, ah i forget to say that the interviewer kept my passport with him ,, wish i can explained every little detials on my interview to all of you , wish the best luck to all of you guys .

hi everyone on here ,, before i start saying anything i just want to say really all the people on here is just a great people lots of them helping me and wish with all my heart for everyone most of the good luck and the best always ... now i will start saying my experince for my interview which i done today OCT 22 .2009 in the American embassy in Cairo to let you all know .
first of all i was there at 6:45 then they start call us to make two lines one of imgrant visa other for the other visa so we were inside at 7:15am everyone got a number and we sit then they start working at 7:30am then they start to call for the papers work was an egyptian woman who checked my papers work and she said everything was fine except she asked me about the divorced original Certificate for my wife cause my wife divorced before so i said i dont have it then she said no problem you just later dhl it to the embassy then all my papers was fine i tell you what the papers :
1-original birth Certificate
2- original marriage Certificate the arabic one and englishe one.
3-original Military Service Certificate
4- my passport .
then she asked me to go to pay the dhl fees was 67LE (egyptian pounds)
then i sit and waitied for the another call which for the finger print then they called me to to finger print i did that and i went to sit again wating for the last calling for the interview which we all waiting for lol.
then they call me to go to my interview and really guys the interviewer was a man around his 45 or 46 he was so so nice and friendly asking so some few questions not so hard really or silly questions and treat me with smile and good respect i will tell what he asking me to it might help all of you ..

i'm new on this great web site but from what i seen its so helpfull site everyone on here want to help i can tell , so please i'm on k3 visa i got the letter from the american embassy in cairo which call package 4 telling me about my interview date then they called me telling me that the date changed to other day in the same month and e mailed me the new date but i'm worried to not be able to get access on there and not let me enter cause the letter i have has the old date so what i should do ? another question is there any time line for getting the visa after the interview done ? thanks to all , good luck to everybody.

i'm from egypt and my wife from usa we on k3 visa , i have two questions wish someone can help me ... is there a time line to getting the visa after the interview ? i got the letter from the embassy telling me about the day for the interview then they called me and changed it for one week later so what i should to do is to asking them to send me other letter or print out the email they sent to me about the new date to be able to enter inside the embassy ?
