  4. Hey strangers, welcome to VJ!

    A lot of people do get married at the courthouse to fulfill the visa requirement and have a celebration with family later.

    Dave and I did just one wedding, so if you choose to do it that way, here's my advice (copypasted) from a previous thread:

    It's *possible* to plan a large wedding in the time allotted by the K-1 visa. Using most of the 6 months before moving would be useful for that. Have everything that's not time-sensitive ready to go (guest list, attire; pick out menus, invitations, favours). To save time on printing invitations (printers typically take about 5 weeks), use packaged blank invitations formatted to print from your computer printer. Have a few choices for each vendor: location, officiant, photographer, caterer, DJ, florist, cake artist, etc. Find a hotel that will let you reserve a block of rooms with no penalty. Gather information for a few hotels in different price ranges to pass on to your guests. Keep your guests informed that they'll be invited to a wedding on short notice. Address envelopes.

    Once you get the visa (and not before), put the plan into action: pick a range of dates (remember you have 9 months total to work with), and find out which of those work for the people who *must* be there (closest family, wedding party?) Call your first choice vendors to find out which of those dates all of them are available; contact backup vendors if necessary. Book everything. Reserve a block of hotel rooms for out-of-town guests. Mail invitations. E-mail or call guests, as well, so they know when the wedding will be before receiving a snail-mail invitation.

    Whichever way you decide, we wish you two the best! :)

  5. I was looking for info on this before my husband came here on a K-1 visa. This is the order we did things related to his name change:

    • Filled out the marriage license; Registered with Selective Service; Applied for SSN (first week here)
    • He received his SSN card in the mail
    • Got married (2 weeks after POE)
    • The JP who officiated personally delivered the signed marriage license to the Town Clerk's office the day after the wedding.
    • Got certified copies of the marriage certificate (3 days after wedding)
    • Went that day to the local probate court to petition for name change. I think they said they would schedule appointments for our hearing dates and it would take about a month. I requested it be expedited if possible, for Adjustment of Status. They scheduled our hearings for about a week later. :)
    • Showed up to hearings, swore in, confirmed we weren't wanted for any crimes, and that the names on the petitions were what we wanted our names changed to, and the judge granted our name changes.
    • Update name with SSA
    • Update name with Selective Service

    I suggest looking up your state's laws for adult name change, and if any questions, calling the courthouse that services your town to inquire.

    The law may include wording about being a resident of the county. It's a different concept from "legal permanent resident". Once he moves in with you, he'll be a resident of the county you both live in, because that's where he resides.

  6. I think one question asked at the B1 visa interview is being overlooked in this thread.

    OP, where you said this:

    I take that to mean, the CO asked you 2 separate questions:

    CO: "Are you single?"

    Joe: "Yes."

    CO: "Do you have a girlfriend?"

    Joe: "No."

    Is this correct?

    My opinion is that if you did not consider her your girlfriend at the time because of gf/bf relationships not acceptable in your culture, then it was not a lie and not misrepresentation.

  7. To clear up some confusion in this thread for others even if OP is all set.

    I believe it is 5x the 125% number for your house hold.

    From VJ Guide for Affidavit of Support:

    "When assets are used, the assets must equal 5 times the difference between the annual income and the

    needed 125% of the poverty level, this is because the affidavit is in effect for 5 years. For instance, if you

    needed $15,500 income and had an annual income of $13,500, you would need an extra $2,000 of assets for 5

    years, or a total of $10,000 in assets in addition to your income."

    So required assets/savings is not 5 * petitioner's annual income.

    It's 5 * (125% poverty level for your household size minus petitioner's annual income)

    ya makes sense lets say someone makes 19,000 a year what needs to be in the savings ?

    19,000 x 5 = 95,000

    just use the calculator on your computer lol good.gif

    95,000 for 2 people does not last long on bills, food etc.

    As has been answered correctly before, 19,000 per year for household size of 2 people is over the 18,387, so no need to show assets.

    But let's say for the sake of doing math that the petitioner who makes 19,000 per year has 2 children so the household is size 4.

    125% poverty line for household size 4 = 27,937. (From http://www.uscis.gov/files/form/i-864p.pdf)

    Back to our equation:

    x = 5 * (27,937 - 19,000)

    x = 5 * (8937)

    x = 44,685

    So this made-up petitioner with household size 4 and income of $19,000, they need to show $44,685 in assets.

  8. If we were starting again from our starting point in time, but knowing what we both know now, we would probably file the paperwork for me to move to Canada instead of him to move here.

    From the point we're at now, moving back would require us to be physically separated again. We chose to endure that part during engagement and now choose being together, so for now we're in the US.

    In hopes that some of "what we know now" will be of use to someone else:

    Once you have new information that contradicts what you previously thought, reevaluate it and integrate it into the whole picture.

    Just because someone complains about their job, doesn't always mean they don't love it.

    It's hard to compare one person being more picky about their job than another.

    It's hard to compare one person being closer to their family than another, especially when one has and one hasn't been living with their respective family and experiences communicated are coloured by this.

    Contract-to-hire in this economy may not mean what it once did. Even a permanent job may not be permanent.

    If you're planning to live with in-laws "temporarily", realise it may be longer than you planned, and ask yourselves if there's an alternative.

    Being an only child isn't an obligation to live near your parents in their later years. Make the best life with your spouse, wherever that may be.

    Once you've made a decision and mailed the paperwork and fees, it's easy to convince yourself anything that makes it look like the wrong decision is only a little thing.

  9. Just making sure I have this straight, because I've read the instructions but it seriously seems like cheating!! BTW, I've always done my taxes by hand, not using any program, just the instructions. My husband has an SSN and we're married filing jointly. We can elect to have him treated as a resident alien for all of 2010. And using the 2555-EZ exclude all of his foreign-earned income, which is all of his income, as it's been taxed by Canada. AND I can file the Schedule M, "Making Work Pay", because I've earned an appropriate amount of income in the US for that. And because we're married filing jointly, we get the $800 credit, rather than me getting the $400 as the only one with US income. :wow:

  11. We knew on our first visit that we were perfect for each other. We knew that *before* ever meeting in person. The only thing I personally needed the visit to confirm was that he smelled right. This probably sounds weird to some people, but oh well, I'm weird. :P

    But you asked about visits before *marriage*, not before *engagement*. Our 5 visits:

    1. He flew from Ontario to visit me in California for a week. (Unofficial proposal the day after we met face to face. Planned to file I-129F after this trip, but decided to wait because I decided to move to the East coast.)

    2. After I moved to Connecticut to live with my family, he flew to visit me for 3 weeks (& official engagement. Filed I-129F after he left, just so I could answer "No" to the "Is beneficiary currently in the USA" question. And have a scan of his return boarding pass.)

    3. We both drove to meet halfway (USA) for a week.

    4. We both drove to meet halfway for a weekend. (so short!)

    5. We both flew to Montréal for his interview, then later that day flew to Toronto for the rest of the week and I finally met his family.

    I'll let someone who knows more than I tackle the "what to bring" because I'd probably leave something out. :) For that I'll just say bring originals of things you mailed in copies of in the AOS packet, and bring multiple types of evidence of bonafide marriage, both originals for them to see, and copies for them to keep if they want to.

    Here's my personal list, I'm sure others can add to it:

    joint bank account & credit card statements

    car title/insurance/registration in both names

    lease or mortgage in both names

    photos of wedding, honeymoon, families together

    wedding scrapbook

    cards to each other

    cards mailed to both at the same address

    e-mail inbox searched on spouse's address

    phone bills (same address), calls/texts to each other highlighted

    health insurance in both names

    life insurance showing spouse as beneficiary

    retirement account statement showing spouse as beneficiary

    joint tax return

    hotel receipts showing both names

    I answered question 1 the way most people have answered question 2 (perspective of sitting upright in bed) even though I've always thought it the other way. You guys seem to be "right". (As opposed to "wrong", not "left".) 3/4 people in my house have just always assumed the same, that it's from the perspective of being in bed facing the foot.

    I've always thought it from a decorator's perspective, viewing the room from the foot of the bed. When I first read the question from AOS interviews, I started pondering whether others thought the same. I could see the more common way of thinking of it, sort of like in a car, right and left are viewed from inside facing forward, not from in front looking at the car. So now my family is teasing me about "driving a bed"! :rofl:

    When they explain that it was lying on one's back though, I'm like, "well what if you sleep on your stomach?" :blink:
