  1. A family member (BigMA) is in the process of applying for citizenship. She has been here for 15+ years, 55+ years old so she can take the Civil Test in her native language (“55/15” exception). I (her son) will be her translator.

    Has anyone been through this? When did you do it? How was it?

    Exceptions & Accommodations

    English Language Exemptions

    You Are Exempt From The English Language Requirement, But Are Still Required To Take The Civics Test If You Are:

    • Age 50 or older at the time of filing for naturalization and have lived as a permanent resident (green card holder) in the United States for 20 years (commonly referred to as the “50/20” exception).
      OR
    • Age 55 or older at the time of filing for naturalization and have lived as a permanent resident in the United States for 15 years (commonly referred to as the “55/15” exception).

    Note:

    • Even if you qualify for the “50/20” or “55/15” English language exceptions listed above, you must still take the civics test.
    • You will be permitted to take the civics test in your native language.
    • If you take the test in your native language, you must bring an interpreter with you to your interview.
    • Your interpreter must be fluent in both English and your native language.
    • If you are age 65 or older and have been a permanent resident for at least 20 years at the time of filing for naturalization, you will be given special consideration regarding the civics requirement.

  4. Adding mom's application status in. Notice that, from the I797C, it reads Received Date and Priority Date are both as August 25, Notice Date is August 27, and we just got the notice in the mail yesterday, September 3. I forgot when did I mail the application.

    We came here all because of mom, but she is the last one in the family to become a citizen, while her grandsons are citizens at birth. ...

  5. The reason this family cannot do a interview now is beyond most people's guess, so I am just going to say that they can not go to the interview.

    I did, however, get a reply from GUZ: as follow:

    Please be advised we can postpone your beneficiaries' application at your request. Please contact us each year to keep the case valid if you want to further postpone. And notify us two or three months in advance when your beneficiaries are ready to continue their application.

    This was a bit surprising, and of course, they did not mention about the CSPA and the child aging out. So, just want to confirm, the interview needs to take place before he's 21, right?

    I wrote the following back and wait for their response:

    I would like to formally request have have the beneficiary's application postponed until further notice and cancel the scheduled interview on March 31, 2015. I will contact you at least once a year to keep the case valid. Questions: 1. Do you need me to put this request in writing? If so, please provide complete street address. 2. How's this postponement impact the pending immigrants, as in, the accompanied child will be over 21 soon, will this child still be eligible for a visa if this case is postponed, let's say, 5 years and the child is 26? 3. Please confirm, when processed, that this case the postponed. Thanks!

  6. A family has an immigration visa interview scheduled for March 31, 2015 at GUZ. This is an F4 immigration visa.

    The beneficiary would like to delay the visa interview (for reasons), for as long as possible, preferably, two years, to have the interview in or after, March of 2017.     "The beneficiary and her family member had been notified of a visa interview scheduled on March 31, 2015. Due to ********************, the beneficiary and her family would like to reschedule the interview.

    (1) Can the interview be reschedule for two years later, in or after March 2017?

    (2) If not, when would be the last day the interview must occur?

    (3) The accompanied child would be over 21 should the interview is rescheduled (born 1995), will he still be eligible for a visa when the re-scheduled interview occurs?

    They should hear back from GUZ in a week. Meanwhile, does anyone have answers to these questions? THANKS!

  7. Just check, Washington DC office is process time for I-485 is now January 31, 2014, on August 31, 2014. Comparing this with the last update--it was January 15, 2014 as of July 31, 2014, its pretty safe to ASSUME that MIL's paper, dated February 24, 2014, should be processed by October 30, 2014.

  8. OK, apparently I was brain-dead when replying to Darnell...

    I somehow think Darnell was saying I-130 was approved because of the issuance of the AP/EAD combo card, now I re-read the posts, and I realized that it is the I-131 was approved so that we have the combo AP/EAD card. Duh!!!

    Now back to the topic, regarding the order of I-130 and I-485, now that the local office (Washington DC) is processing the I-485... So here are the questions:

    1. Who is/will be adjudicating I-130? Is there a timeline to check it?

    2. Is the approval/deny of the I-485 based on the I-130?

    3. If so, I-485 will not be adjudicated until I-130, no?

    IMO, the issuance of the AP/EAD combo card has NOTHING to do with I-485 adjudication queue. I hope you can adopt the same opinion.

    Yes it is a combo card for AP/EAD. I know it is different when wife went through the same process and the AP was a piece of paper and the EAD is a card.

    So you are saying that now that my MIL has the AP/EAD, her I-131 is approved?

  10. MIL was here on a visitor visa and we petitioned her for a green card earlier this year.

    I-130 and I-485 has no movement since the NOA 1 was issued (02/24/2014), while I-131 and I-765 has been approved and we received the combo card for travel and employment authorization in May 2014. The last communication was a letter (postal mail) informing us that interview may be waved because of back log, since then, nothing.

    I checked USCIS's field office processing dates, and found that the latest date available for Washington DC is 1/6/2014 for I-485. I thought I-131 needs to be approved before I-485 can be approved, but nowhere I can find out which office is adjudicating I-131. All 4 forms (I-130, I-485, I-131 and I-765) are MSC cases.

    Thoughts?

    Also, they cannot leave the country after the application has been filed correct?

    I guess the wait to get a green card various, but 8-10 month is not surprising, as you can see, we are at the 7-month mark and still waiting.

    They can leave the US once they received the I-131 form is approved (I-131 and I-765 is now using a combined card, so you will only receive one card for both approved I-131 and I-765), but I would strongly recommend you not to leave the US without a green card on-hand unless you are absolutely necessarily needed to leave.

    I have a question. If you have one or both parents visiting the U.S on a visit visa, can you apply for their immigration while they are in the U.S and apply for a change in status at the same time? Any help would be great.

    Yes, that's what we have done for my mother-in-law, basically the USC needs to file the petition in a whole package, I-130, I-485, plus I-131, and I-765 if you like, the fee was about $1,400. We filed in February and still waiting, last mail received was a possible interview waver due to backlog.

  13. OK, so let's say that the child is not qualify under CSPA, can the child's parent petition for him once themselves receive their green card AND the child retain his original priority day, 9/9/2002? If so, what are the procedures and forms to fill out?

  14. So here is the case:

    Brother is USC, petitioned for sister and her family (sister herself, her husband and her child).

    The petition was approved on 9/9/2002, the child was 13, now the child is 26 (not married).

    The original petition is now processing, just paid the $88 AOS fee, however the petition only listed the sister and her husband, the child, now 26, not married, is not listed.

    Does the child still eligible for immigration?

  15. MIL came here on as a visitor, we filed for status adjustment. Latest case update on the I-130 is "Initial Review", the I-485 is "Acceptance", but over the weekend we have received the card for her I-131 and I-765. Looks like it is a new card design, because one card serve as the purpose of travel document and employment authorization.

    I understand that I-130 and I-485 is badly backlogged, but does this mean her case is approved/will be approved (just a matter of time)? We don't expect otherwise, but just curious, as in, have there/will there be a case that I-131 and I-795 is approved but I-130 and I-485 is not? Thanks!

  16. Getting this done for mother-in-law who is already here in the US as a visitor, so we are filling for I-130, I-485, I-131 and I-765 all in one envelop.


    2/24/2014: receive message for each of the forms submitted: Your case has been accepted and routed to the USCIS National Benefits Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number MSCxxxxxxxxxx. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

    In regards to MIL, we bought several "white book" from China on our recent trip, so we should be good there. The question is the birth certificate for both her and her mother, they got different last names. We may have to get a "white book" for her mother's birth certificate as well, I am sure we have th "white book" for the relationship that they are mother and daughter.

    you've got the right idea, to file the big adjustment of status set, I-130 + I-485.
    The steps are almost similar to what's in GUIDE2 in the Guides Section, but you might have some hurdles on civil docs.

    She have a birth certificate? is not enough to have a hukuo book. If she has a birth certificate, it needs to be translated into English. If'n she obtained a Notarial Translation Document, a white book, on her birth certficate, hey - yer golden.

    Prep each set as a seperate collection, though. The I-130 is one set, the I-485 is another. Sure, it's perfect to submit all together, in fact you must - but on the prep, do it seperately. Don'e forget the EAD and AP with the I-485 - the filing fees are waived when submitted with the I-485.

    Any civil doc on you or your mother, submit a photocopy.

    The big difference from GUIDE2, for this type of adjustment of status:
    1. you must show proof of USCitizenship and
    2. you must show family connection (usually via your birth certificate)
