  1. Update: So both of them entered with a renewed passport, while their old passport has the visa information. For his wife, I-94 and history travel shows up when we enter the number of her current passport. For him, travel history appears with the number of his current and valid passport, while the i-94 shows up by entering the number of his previous passport. I am not sure why this happened. 

  2. I am helping a cousin who is processing the paperwork to request Residence for her parents. She is US citizen. Her dad (my uncle) has entered the same date as his wife under the Tourist visa. But when we want to download the I94 for him, this happens: First it did not show up at all. Not found. We tried again and briefly it appeared showing some incomplete data and the page reset itself. 

    So I tried by looking up through the history information, and it showed up but his last entrance as of June this year, doesn't shows at all. But we could not retrieve any data from the I-94 itself. My cousin contacted via the https://i94.cbp.dhs.gov/I94/#/home and she received an email that it was ready. Again, we looked it up, and nothing. 

    What is the best way to connect for real with a person that can help us? what number should we call in? 

    Note that the i-94 and travel history of her mom shows all neat and accurate, nothing misses. The issue is with her dad's information.

  3. Well, if the lady in mention knew how to do her own business, at the start she could have gone through the "legal" way by setting  the proper steps. She did not. Now she wants to brush off her responsibility, knowing that she could be in trouble in the long run. She only can ask for the SNN if she has hired a third party payroll company to setup the proper payment. Your wife is not under her wing so why is she asking for the SNN? Is she intending to provide a 1099 form? Did she pay by cash? Did she provide a receipt with the cash payment? Does she have a clear schedule payment with the exact amount anytime she provided the payment? Or did she pay by check?

    Like others said, let the money go, change your phone number (if you block her, she might try contacting you from another number, my guess). If she is asking your wife to abide by the law, hence she should have done the same from the very beginning. 

    When I got my green card I was hired as nanny by the same family who were my hist parents. And they did it through the lawful channels from the start. They provided to me the contract and documentation to sign and I provided my SNN directly to the payroll company. Also, I know they had hired another nanny after I finished working for them (I found a job through my career) and the woman they had was being paid under the table. She wasn't ever asked for her SNN (she was a student) and never was threatened her like this woman is doing to your wife. 

    I am laughing at the fact she says she has attorneys and that she said from the start that this job would be as an independent contractor. If she was smart, then she could have elaborated a sort of mutual agreement and signed by both parties. I doubt she ever did that. 

  4. Asking for my dad. He has his interview on March 12 in San Juan, Puerto Rico. That is where he has been residing due to his church work since 2018. 

    I have a few questions, if any of you could please help us:

    He is 75, legal resident since Sept. 2014. Will he be required to take the Enñish test (reading, writing, speaking)?

    He has tried his hardest to speak it, he understands fairly well, but speaking is difficult. 

     

    He can't bring an interpreter, but must make arrangements to have available by phone. It is a bit complicated because we are not sure if he would have to place the call or will the officer be and, if his interview is scheduled for 9:30, I m not sure how sharp it will be to start exactly at that time. Because if hiring a professional interpreter, some charge by the hour or by yhe minutes used in the call. This can be an expensive service. 

    On the other hand, I have interpreted for other people, I am a translator too. But I recall during his first interview in 2014 for the legal residence, I couldn't be his interpreter since I was the requestor, so to avoid conflict of interest, we brought another person to do that. Now, for this current scenario, could I be the phone interpreter? 

    And lastly, is USCIS allowing guests to the ceremony? Just wondering how has been lately since COVID-19 changed a lot of our lives and ways businesses were done. I personally would love to be with him for that part. He has been legal resident in several countries but it is the first time he decided to take another's country nationality. 

  5. For adult children of a green card holder there is a very long line to wait for a visa. The person at the front of the line had a petition filed by their parent in 2008, your friend is almost at the very end of the line. There are over 6 years worth of people ahead of her. If she ever loses her student status she must leave, if she marries before she reaches the front of the line she loses her place ( unless her parent becomes a USC BEFORE she marries ) There is no submitting the I485 until she is at the front of the line in 6 or more years ( based on the current date )

    Yes, as she is also reading these comments. Regardless, she wants continue pursuing her career and master, hopefully this current situation will not jeopardize also those studying possibilities. As mentioned above in previous comments, the marriage option with an USC is not in the plans, why to get married for the convenience of getting papers why she has already a person that loves her? :) Since she arrived (2 years ago), some of her friends have suggested her to marry just for the papers. The waiting may be worth for her, hopefully!

Although our questions may sound so obvious for some, it never hurt us to ask and confirm especially with anyone that may have gone through any similar experience. ;)

    The priority date appears as July 24, 2014. Does this imply that the the form 130 was received before the cut-off date? Can she submit the application for PR? Can she submit the same documents she got back? Or, would she has to checkout the visa bulletin every month until her priority date is current?

  9. she is on a student visa now, but will she be studying during 7 more years? meaning she has to keep studying non stop? I can't answer for that! She will decide but of course, her plan is continue studying.

    only she can adjust status if she has been here legally in the US since she entered and her priority date is current, she can send her adjustment of status packet with evidence that she has been legally in the country all that time

    if she cannot maintain legal status, she has to return to Guatemala and go through Consular processing

    Also, if she marries, the petition will be voided, unless she marries in over 5 years, after her mother becomes a USC. Residents cannot file for married children, only USC can

    Unless she falls in love with a USC and decides to file a spousal visa, then she won't need her mother's petition.

    Anything can happen in so many years Sure, Anything can happen. :) just FYI, she is engaged to her Guatamalan long time boyfriend. Although, no plans of marrying soon either. He visits her periodically as he has VISA to enter legally.

    in order for her to adjust status in the US, she would have to remain legally in the country for all those 7 or more years of waiting, such as a work visa or student visa, she cannot become illegal not even one day

    children over 21 are supposed to wait in their country of origin and have the interview via consular processing, there are countries that have more than 7 years of waiting, that's why I asked from What country she was from.

    For example, Mexicans have 20 years of waiting and they cannot marry until the parent becomes a USC

    The i485 is only for certain categories with no wait, such as immediate relatives: children under 21 of a USC who entered legally, there is no time of waiting

    the i130 is the only form that the mother should have filed, once approved it will be sent to the National Visa Center, center that works with cases that will be processed via consular processing.

    there it will sit and collect dust until the priority date becomes current, where the second part of the process begins. because children of LPR or children over 21 of USC don't qualify to adjust status in the US

    thank you Aleful. Here the only information that seems different, if "children over 21 are supposed to wait in their country of origin and have the interview via consular processing," but USCIS doesn't states that this just the option. Here is the other one:

    As mentioned before, the mother is Permanent resident, residing in the US. The daughter is also in the US under student visa. Anyways, they will contact USCIS and plan to get an infopass to confirm all again.

  11. What makes them eligible to file for AOS within the US? The I-130 was just sent in Sept. You would need an approved I-130 with a current priority date. They would be category F2B. The current Dec. visa bulletin states you will have about a 7 year wait. > It was sent together in July with the application form 485. Pardon if the timelime of how I wrote before wasn't clear.     Now in my own research I see that she shouldn't have sent all form at once.

    Aleful, you were right. My friend should have waited for her mom's application in form 130 to be approved first. I found it in USCIS.gov as well. I will share it with them so they can further read and take the proper steps. Thank you all for your responses.

  13. Yes, how old is the child? How did they enter the US/what visa? She is already 32 and entered the second time under student visa.

    You needed to include a copy of the I-130 approval or receipt notice. Yes, but it is "funny" that USCIS got all documents at the same time, however kept form 130 and sent the other documents back with the rejection note.

    If you are eligible to apply for adjustment of status then follow this guide. The I-485 requires supporting documentation besides just the I-864 > http://www.visajourney.com/content/i130guide2

    All the documents, including, the Biographic form (G325A) were submitted.

    how old is your friend? is she under 21 and her mother a USC? She is 32. Mother is only US Legal resident, who obtained it from her oldest son who is married to a US Citizen and had been living in the US for over 20 years.

    if she is over 21, then she doesn't qualify to adjust status in the US. how long has she been in the US? This is a new information for us. Where is that information available that if she is over 21 she doesn't qualify to adjust status? She has been twice already, first on J1 visa now over 2 years under student visa.

    there are many years of waiting for children over 21 and why did they send in all the forms? You can send all forms, at least that is what they were told by USCIS before sending them altogether. I did this same process as well when I applied for myself and for my dad's residence. However, if there is something different that says that NOT all forms should be sent together, then this is a new thing. Regardless, in the papers she got back, it doesn't clearly say what she is missing. USCIS kept form 130 and sent the other documents back.

    I have a friend (applicant) who submitted the following forms in July 26, 2014 (All in the same package):

    I-485

    I-864 (Submitted by her petitioner and sponsor -her mother)

    I-864 (Submitted by co-sponsor)

    Her sponsor and petitioner sent I-130. A letter confirming that USCIS received this latter form was sent back on September.

    However, USCIS sent all the forms back except I-130 along with the uncashed check and a green paper with the following note:

    Dear Applicant,

    We are sorry to inform you that we have rejected your application for the reasons indicated on the I-797 Reject Notice.

    You are invited to resubmit your application package after you have corrected the reason for rejection. If you have any questions please contact lockboxsupport@dhs.gov.

    When you resubmit your application, please enclose this letter with your re-submission.

    Place this letter on top of your application package.

    I am also providing an extract of the Notice of Action she received:

    "This is in reference to the I-485, Application to Register Permanent Residence or Adjust Status, you submitted. Your I-485, fees, and any supporting documentation is being returned to you for the following reason(s):

    Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

    The following documents may be provided:

    Your original Form I-130

    Your original Form I-.140

    Your original Form I-360

    A copy of your form I-797 if the I-130, I-140, I-360, or I-526 petition has already been filed/approved; or

    Other evidence that an immigration visa petition has been filed/approved on your behalf.

    She has contacted by email and by phone but hasn't got any response, just for form I-130 that case is in initial process. Our question is if anyone knows about the "priority date" they mention above. Also, if someone receives this type of notification, does it mean the petitioner is "illegal"? Can she win this case by presenting the Notice her mother got for I-130 in September?

  16. Aleful, it sounds like OP didn't have a joint sponsor and is above 125% of FPL based on their own calculation.

    Ryan_and_Priscy: One thought, is that income consistent? As in were you above 125% FPL based on the full 2013 reported income or just the last several paychecks? or if you provided multiple years are they all at or above that range? It could have also been a previous W2 that maybe looked like the whole year's income?

    Just some thoughts.

    Previously I was working part time for a company and had my own business as freelance translator. The company I worked for as translator hired me last year beginning of April for a full time position while I kept my first part time job, plus I taught Spanish for private students. Basically I just added my full time job to the list from where I get my income. The income from last year is slightly higher, but even though my overall income for the previous years haven't been low. If that is a reason to consider "inconsistent" well, I won't have any other resource to have a joint sponsor, but the more I dig and ask to other friends, who have been able to bring their spouse and even a parent, their yearly salary was lower than mine and they did not even had assets, leaves me wondering....

  17. I am petitioning my father for US residency. He is the only one beneficiary. So we filed out the paperwork back in March, last Monday we took him to USCIS for the fingerprints appointment. Yesterday we got a pink two pages letter stating that we have 87 seven days to submit all the supporting documents for I864 (for which I sent everything, including the last three pay stubs from my two jobs, one full time and the other one part time, the taxes and schedules and my bank account information). Then, the other reason why they cannot accept this request is because I do not meet the 125%. That left me with a big question mark because according the poverty guideline, for 3 people in my household, I am actually over 10K difference from the limit shown in that guideline? They mentions that I should get a joint sponsor....

    If having a joint sponsor, that will be something difficult. I can't ask to my husbands family to help, his parents are divorced, we no longer have contact with his father and his mother is doing her best to survive.

    My father is 70 years old and is the only one closer relative I have. I am married and currently my husband is under temporary disability. He is not a joint sponsor and doesn't really need to support my dad.

    After I called today USCIS, the officer said that that could have been a mistake, maybe somebody overlooked the papers and did not paid close attention.

    She advised me to speak directly to an officer and shown them the documentation I sent (I have copies) and see what they really require from me and why they state that I do not meet the limit... I have already the appointment for May 27th in the afternoon. Depending on how it goes, I may have to hire a lawyer, but first I want to make sure the reason of their arguments...

    I am wondering if someone has had a similar issue? Any thoughts?

Well, I assume it must be separate check but now surprises me that a full check has been accepted too (honestly, would like to find out the officer's name who accepted a single check with the full amount)?! As for personal checks, I just sent two personal checks on with my name and my husband names printed on it, the amount of the money and under memo, the name of the form. A process we are doing to petition my father who is applying for residence. All accepted.

  19. I have my drama now:

    In March 24th I took my father, the beneficiary, to see the Civil Surgeon, Dr. Kun Zhong. We went back on the 27th so the doctor could see the TB test result. After he ruled that my dad had a redness (not swollen) result, he did an X-ray Chest. It took him about an hour and half to tell us that everything was fine and that we could proceed with the process. Nevertheless, when the TB test came positive, I reemphasized to him that my dad was diagnosed with TB in 1994 after he suffered a long term intestinal condition that left him weak and prone to catch any disease. As he was working by then in the medical environment (hospital, clinics) because his business was to provide medical books to all these places, so his doctor assumed that having a weak immune system was easier for the TB virus to attack him. He was treated, the disease was put under control. To make sure that there isn't any condition or recurrence of the TB, he was periodically seen his doctor and done x-rays. The last check up he had was last year before he traveled to South America to visit his family. He came in November to visit us and then we discussed that it would be best for him to live with us. So we started working on getting the paperwork done.

    It was on the 27th when the doctor gave us that sealed envelope and kept saying everything was OK.

    Yesterday I got a call from his office. The lady would not wanted to release any information but insisted to talk to my father. Nicely I had to explain to her that he wasn't with me because I was at my workplace, and if she tried to speak to him directly (she wanted to call him to his cellphone) he wouldn't be able to talk her. My dad doesn't speak English fluently. I messaged my husband and asked him if he could call back to the doctor's office and maybe he would be able to get more information. We are the only ones who have the right to know anything relating to him. I am the petitioner, I am the only one daughter, therefore, there is the total right to know any information they have. The lady asked if we have sent the documents to USCIS. Of course, we did! Her reply was like a "Ohhhh" but sounded more like a another way to say "ooopppsss". So I insisted, was anything serious? Yes, but they needed to see my dad again and they wanted to see if I could take him tomorrow (today).

    My husband called today to the office and was able to speak with the doctor. So it happened that the doctor decided to sent the X-ray to a radiologist and had the result to share with us. He advised that my dad need to be seen by an specialist because the X-ray show holes in his lungs so they are not sure if that could be TB recurrence or...cancer.

    He also highlighted that he would notify USCIS to put the process on hold.

    I just spent over an hour trying to speak with an official, as the representative told me that only an official of a higher level could let me know further information/assistance. All I want to ask is 1) Have they received any notification from the doctor. 2) Is legal that the doctor gave us a sealed envelope and said everything was OK and now comes back saying that there are issues (I thought that such process should have be done we could send these documents to USCIS). 4)Can the doctor put the process on hold?

    After my husband called, I took a short break from my work and called the doctor but I was unable to reach him. So I told the receptionist to let him know that "What was then the result he wrote or put in the sealed envelope?, I trusted the Doctor was giving his final consent that,, if there wasn't any problem, then we were set to send our papers to USCIS. Why he decided now to take it to a radiologist and NOT before he could have given us that envelope?

    The doctor also said that he mail today the results of the X-Ray. I will call tomorrow again USCIS in the morning and ask to the official the same questions I have.

    But as for now, all these situation and the way the doctor handled the situation, honestly we don't feel like relying on him. Yes, I appreciate the fact he decided to have a second opinion but...after he gave us the envelope and said everything is OK?

    I reach anyone here who may have a real advise, or have gone through a similar experience. Please, if you know, let me know.

    congratulations. I bet that you are relieved now that you don't have to deal with USCIS now.

    Thank you both! I heard from other friends that their process took longer, I was hoping for the same but seriously, it wasn't that difficult. My deal was mostly financial but I am so thankful that everything was possible!

  21. I am proud to say that I am now a citizen of the United States of America. I will never forget the ceremony and the moment we all said the Pledge of Allegiance. My husband, my mother in law and three dear friends were there for important milestone in my life. We were 77 people from a very well varied background. Every October 31 will be memorable for me to remember the day I became part of this nation.
