Hi,
Acutually speaking DCF is not that good option for the USCs. DCF requires lots of procedures for an USC to become eligible for the process. Me and my wife, had a basic idea abt this process and went to delhi to apply it. But, my wife was not eligible since she cant prove her domicile in India. They are not accepting FRRO letter, Affidavits or 3 months of Stay here. They actually require USC to work here, pay taxes to Indian Govt, have some property, bank transactions and ofcourse a long stay.
So any USC who is planing to do DCF should have the above points in their mind....

Other than being legally married, there are no conditions to applying. If you are back in the USA now, you can file right away, but if you want to file via the US embassy in India (ie DCF, which is a faster process), you need to be living legally in India for some time- it is usually 6 months but I believe in India it is only 3 months. Hopefully some Indian DCFers will come along and clarify that. -
Hi All,
My wife filed I130 on Nov 24th 2009 and we received the NOA1 (I797c) on Dec 7th 2009 stating that our petition is pending at CSC dated Dec 1st 2009. Is it advisable to continue filing I129F (K3) now. Whtr it is quicker than CR1 through I130. I chked the processing time in USCIS site, it says the processing time for both I130 and I129F is 5 Months ( as of Sep 30th 2009). Whats the difference and whtr it is true that K3 process is faster than I130 process.

Those who are planing to process from Delhi, India, Please note that, Effective Nov 2nd 2009, DCF fee will be INR 17040 and not INR 17750.....

My wife is an US citizen and we are planning to apply for my greencard through the DCF process in New Delhi. Does my wife need to stay here for the whole DCF process or can she return back to the US after she files the I-130 for me in New Delhi. I mean does she need to stay when or if we submit package 3 or for the interview?

As long as she has a co-sponsor to fulfill the affidavit of support, she does not need an ongoing job. In DCF cases, most USCs do not have a job in the USA, so your case will be quite common.

Dear All,
I have decided to file my GC through DCF process and my wife is an US citizen. She holds a job there and she is here on 3 Months Leave. She will be losing her job if she is not reporting back by Mid November. Whether my wife needs to have a job in hand through out the process or she can quit her job and go along with me once I get my GC. Her family is there to give an affidavit of support or co-sponsor for her. Please guide me in this regard...

Dear All,
My wife is an US citizen and she had got her Residential Permit. She came to India on 22nd August with a multiple entry visa. My query is whether we need to wait till Nov 22, so that she completes her three month stay to apply for DCF or is she eligible to start the process with the residential permit which she have with her right now.

I am Raj residing in Chennai got married to an US citizen on 14th Sept 2009. My wife came to India on 22nd Aug 2009 with a multiple entry visa. Now she got her Residential Permit for the stay in India...We are planning to process my GC through DCF from Delhi.....Whether she is eligible for the process or should I need to apply OCI for her....Also we have the following documents with us..
Marriage Certificate
Her's American and Old Indian Passports
Her's US naturalization Certificate
Her's W2 and Insurance Docs
My Passport
My Tax returns
Whether we need any additional docs....

Hi All,
My wife is an US citizen and we are planning to apply GC through DCF process in Delhi....She came here on a Tourist Visa and she is eligible to stay here for 6 Months...We enquired in Chennai US consulate about the DCF process for getting clear information...They said, Since my wife is here on a tourist visa, she should apply for a stay permit through Indian Immigration office.....I come to know for applying the Stay Permit, I have to give an Affidavit of Support to my wife and also we need to produce the following Docs., Marriage Certificate and My Address proof. Can someone guide me whether these doc are enough and what kind of affidavit I have to prepare in this regard....

-- It is always good to have OCI ( overseas citizen of india ) (duel citizenship) , but some time they dnt even see oci booklet...but as you have time u can go for OCI for ur wife...
3, whether she need to hold a job over there
she can hold the job,but she must be permitted for 90 days of stay india..in india..no jobs required in india
4, What are the documents I need to have with me
you should have this many things :
• I-130 petition filed by US Citizen , petitioner on behalf of ALIEN, beneficiary.
• Copy US citizen's US passport biographical page
• Copy of US citizen's Certificate of Naturalization
• Copy of Alien Relative's passport biographical page
• Copy of Alien Relative's birth certificate
• Copy of Marriage Certificate
• Form G-325a completed by US citizen
• Passport type picture of US citizen
• Form G-325a Completed by ALIEN.
• Passport type Picture of ALIEN
• Proof of Bona Fide Marriage
- Affidavit of Bona Fide Marriage by Neighbor of Alien
- Picture of Wedding as per Hindu rituals
- A copy of Joint bank account book’s biographical page
- Copy of Fixed deposits held jointly as joint property
before applying for I-130
5, Like Canada DCF, Police clearence certificate is necessary in my Passport
ya police clearence certificate is required but after filling and apporval of i-130...aprolixly after 3 month of submission of i-130..at final visa interview
6, How long the whole process will take after the filing of I 130.
it can take 4 month to 8 month for whole process , depends on case

Hi All,
Good to start a topic for Dec 2009 fillers. I am interested to add our case in this topic too. Got married on Sept 14 2009, Wife goneback to US on Nov 16 2009. I-130 Petition sent to Chicago lock box on Nov 23 2009 and it reached CSC on Dec 1 2009. Got our NOA1 on Dec 7 2009 (Glad to get our case no). I-129F sent on Dec 17 2009 and got our NOA1 for I-129F on Dec 28 2009.
Hope all our cases will be processed soon.....
