  1. Hello All,

    I don't know where to start and what to write. I have tears in my eyes and my whole body is shivering. I got my VAWA approved after 3 months and 10 days. Its really a big big surprise for me. Today God has blessed me after a long and painful journey. I never imagined when I entered in this country that one day I would have to suffer so much and that too beacuse of the person whom I loved so much. I never thought that he would do this to me. He has abused and humilated me so much and left me homeless without any support. I did not ate so many days, cried so much with so many sleepless nights. I left my job, my family, my carrier everything for that person and he has done this to me. But today God has blessed me and I can think about my life ahead. I thank you all very much for all your support. This forum is like a family which shares their feeling with each other. It has supported me a lot. I am looking forward for the next step.

  2. I went for my interview yesterday. Went with my lawyer.

    The spanish lady was very nice and did not ask any interview questions. Only my name, DOB, when i came into the country and how i came. Then she proceeded to ask me the 20 legal questionnaire (the one in a paper), all which i said no. She asked my attorney if there was anything she would like to give, attorney gave her my job letter and pay stubs. She asked what typed of company it was and joked abit and since i worked in NY-she said "oh you work in NYC, see you around". She asked for my employment authorization back and said i wouldn't be needing it anymore. She brought out the stamp and said "i am going to approve your application". I had a big grin on my face which she saw clearly <img src="http://www.visajourney.com/forums/public/style_emoticons/<#EMO_DIR#>/biggrin.gif" style="vertical-align:middle" emoid=":D" border="0" alt="biggrin.gif" /> and she smiled back. She stamped my passport and waited for it to dry up...she continued to chat with my attorney about if we waited long or not. She wished me the best and said, "now you can move on" i responded...with a big sigh "YES!! MA'AM, THANK YOU. GOD BLESS YOU" And she led us out.

    Yesterday was a very special day to me. Luckily, my church had a bible study event last night, so I went to church in the evening to give a donation and to thank God for his mercies during this past 2 years. It's been a long hard heart-broken time but i pulled through! <img src="style_emoticons/<#EMO_DIR#>/kicking.gif" style="vertical-align:middle" emoid=":dance:" border="0" alt="kicking.gif" />

    I will be visiting my country soon this summer. I called my whole family and my mom is so happy and everyone is so happy for me. I got so many phone calls...from people i have long forgotten i told. Everyone has been congratulating me - yesterday feels like my birthday, today feels even more like it <img src="style_emoticons/<#EMO_DIR#>/laughing.gif" style="vertical-align:middle" emoid=":lol:" border="0" alt="laughing.gif" />

  3. Updated filing address information.

    The beneficiary of an approved Form I-360 based on the eligibility category "Battered Spouse/Children" and you are filing for adjustment of status.

    If you are filing as a battered or abused spouse or child and you are filing Form I-485 (Part 2, Box "h" on the form), file it and any associated forms with the USCIS Vermont Service Center.

  4. Hi everyone, I had my interview today. I arrived at 8.00am, my interview was scheduled for 9.00am. There was a long line to get into the building, I stood in the line for about 20 mins. Once I got to the 13th Floor, I handed in my interview notice, the lady was very nice and told me to have a seat and they would call my name. I sat for about 20 mins before I got called, I was the 3rd person to be called for my interview. The officer walked me to her cubical and swore me in. She then asked me for my passport, she asked me to verify my full name and date of birth. Then she asked for my I-94 card, I told her my attorney lost it but I had a copy and handed it to her. She asked what was my mother and father's first name. Then she asked me the no questions. She asked when was the last time I spoke to my spouse, and asked if we were divorced, I told her no, she said why is there a divorce decree in the file, so I told her its from my spouse's prior marriage, then she apologized. She gave me back my passport and said I should receive the green card in 2 to 3 weeks. Overall the interview lasted about 10 mins or less. I'm so happy this journey is over.   5. I am in tears...tears of Joy. There was a time I thought I was gonna die.

    My case Was approved today. No lawyer, no nothing. Just like that, after 6 months.

    God does exist indeed. Even when I doubted him and cursed..he has seen me thru.

    Thank you for the advised I called USCIS and POst office in my states they said I need to change and forward my old mailing address to my current address so they will able to deliver my mail and everything.

    I think it should be ok soon.. I will wait until they forward and able to recieve mails..

    Change your address using AR-11 on uscis website as well.

    I've just received a letter from USCIS, it says

    "on 12/30/2009 you, or the designated representative, contacted us about your case."

    and "please send your inquiry in written form with the original signature of the inquirer"

    I guess that what my case touches were about. My lawyer is actually working :)

    No touches since then.

Well I'm a bit nervous since you said they asked for a copy of your USC birth certificate because I don't have a copy of my USC BC. I'm very nervous about that now and I don't know what to do.

    I wish you ALL THE BEST for your interview on 25th Jan 2010.

    Don't worry about the USC Birth Certification, each of our case are unique and different.

    During the interview, I wish they won't ask you for the USC BC and if they do, explain the situation Y you r not able to have the BC and they will completely understand.

    Even though I don't have the GC interview experience, Its makes sense to me to share the information and I did it now.

  9. Thank you Lost, Yahya and everyone here, the interview ran smoothly, it did not even take 10 minutes. I was sworn in first, then the officer asked me basic questions, e.g. my name, current address. Asked for a copy of my birth certificate, added it to my file. She said if I have a copy of my USC husband's birth certificate, I showed it to her, she looked at it but did not take it or asked for a copy. Then she said, "I believe, everything is in order, you should expect your GC in 2-3 weeks."

    I truly believe that your prayers, advice and support helped me throughout this whole process, I can never thank you enough. I promise, I will never forget you and I will include all of you in my prayers.

    Sorry to hear that and sorry to be in this situation, my case is similar to yours, we are here to assist and console one another. First of all did you change your address to the new address you at right now, should in case they ( USCIS or Vermont Service Center ) want to sent something to you. And secondly if your EAD is related with VAWA packet that you sent i.e ( I-360, I-485 and I-765 hopefully I-131 ) and your EAD is about to expire all you have to do is to file for EAD I-765 renewal form, follow the renewal procedure/instructions and file it ASAP they should renew it for you and if you can't pay the filing fee, request for fee waiver. I think you can file it to Vermont. You should be fine if you change your address, you can move to anywhere in the USA provided you notify USCIS/Vermont of your new address. Pertaining to your I-360 petition write them and request for the status of your case and for action on your case as well. Is your Prima Facie still valid if not also request for your Prima Facie Determination Renewal/Extension. Legal Aid folks should be able to help you better. Take action and Good Luck !

    I have been out of pocket, was struggling with some family issues, and threats of my spouse. I need some help - my EAD expires in 4 months time. I was being helped by legal Aid - I had to change states. Now that I am in a different state and my EAD is about to expire - my attorneys would not help me with the renewal.

    What forms would I have to fill for renewal and where do I send them - because originally everything in my case was sent to Vermont Service Center with my VAWA packet..

    I filed my VAWA in May last year, got EAD within 20 days of filing with a Prima Facie. I haven't heard anything on my petition since then, no rfe's, nothing. I am kind of getting very stressed out because I don't know what to do from here.

    I am sorry to hear about your situation. Click on the below link and you have all the EAD Renewal information and where to send the EAD application.

    You can renew 90 days before the EAD expires.

    No fee is required if filing for a renewal EAD under any of these categories:

    Citizen of Micronesia, Marshall Islands, or Palau;

    Granted Withholding of Deportation;

    Deferred Enforced Departure; or,

    Dependent of certain foreign government or international organization personnel.

    If you are filing for a replacement EAD, and you are a dependent of certain foreign government or international organization personnel, no fee is required to file this form.

    If you are filing this application concurrently with Form I-485, Application for Permanent Residence, no fee is required to file this form. As of 07/30/07, if you file your Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, as a receipt of evidence for the filing of your I-485.

    If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee.

    Its good to hear you again and you got your NOA for you I-485 and 765.also they waive your fee waiver.

    I still didnt get any from Them coz i have a problem about my address post office cant deliver here into my mailing address I dont know what to do so i would be able to recieve mail regarding my case.

    Jan 5. 2010 they touched my case to initial review as I said the mail that they sent last its undeliverable.

    As this step USCIS check my history background .

    I dont know what that means ,ARE THEY GONNA DENIED MY SeLf Petition or something?

    Dear Ashley,

    You can better have PO BOX address which will be $24 for 6 months and they will give you 2 keys.

    You mail will no longer undeliverable as this PO BOX will be in the POST OFFICE nearest to you house.

    Take a PO BOX from Post office and call USCIS and update them with the new PO BOX address and also send the address to USCIS by writing letter.

    You're welcome.

    As Victoryismine saying, if you have enough evidence you will get the primafacie as the first level of accepting your case as a genuine one.

    If you want to work and nobody there to help you financially, its better you can apply for I-765, I-485 to get the EAD to work in United States.

    If you do have any other working visa you can work too.

    As for the marriage question this is what the lawyer and the lady who interviewed me said....

    If I stay married, I can file in 3 yrs. If I get a divorce I have to wait for 5 yrs.

    I have a few questions to ask, am still wondering about it.... Is it possible to approved VAWA I-360 without requesting for RFEs ? I filed on January 12, 2009. I received my 1st Prima Facie Determination on January 13, 2009 which expired on July 12, 2009 also received my 2nd Prima Facie on November 07, 2009 which will expired on May 06, 2010. But I haven't received RFE like everybody else in here. Am confused and getting scared also worried, what is going on ? Is it normal like that or what ? I need opinion of you guys that went through this situations or already going through it right now. I was in removal proceedings but Immigration Judge recently Administratively Closed my case in order for me to seek the benefit am eligible to with USCIS. So my Attorney filed in my I-485 and I-765 concurrently to join my VAWA I-360. My I-360 was fully detailed with lots of evidences and facts. So guys what do you think ?

    I heard many VAWA cases are approved without RFE and they do have couple of PRIMA FACIEs

    The RFE's generally about good faith marriage, police report, affidavit, proof of violence, etc.

    There is no harm, if you submit all the forms at the same time. If you married to an US citizen then you're fine.

  18. I just have a quick question from an abused wife.

    I have my 2 yr conditional green card. entered USA under I-130. If I filed for VAWA, do i still need to go through AOS?

    1. I got no job yet, no benefits, so I can waive the fee?

    2. I have police report, (my husband saw a counselor to seek help for his anger mngt, and a record of him battering me, and his personal problems) is the counselor's assessment record of my husband's case can serve as a proof or evidence?

    3.And since my mom in law is our co-sponsor, she is willing to give out a statement that she indeed witnessed the abuse to me, is her statement will be fine? or should it be notarized?

    What are the chances of my case?.. please help. Thank you!

    Welcome to this Forum. Since your in conditional Green card. Please check with some attorney.

    I would suggest you the best place to start with is Catholic Charities. Google it for your state you live in and call them to get an appointment. Its very less money or sometime free too to get an legal suggestions and also they help you to file your forms (i-765,I-131, I-485). They deal with lot of cases like us on daliy basis and they know in and out of the legal process.

    My best wishes to get some answer for your issue.

  19. Got my 2nd Prima Facie.

    My first was to expire on 12/26/2009, but I received the renewal 12/16/2009, 10 days before the first expires.

    Question: Why does it say my case will not be done before the 180 days?

    Its says for like that but they will process according to their processing date.

    PRIMA FACIE is just a information sheet which tells you that your case is under process. Many of the member in this forum don't even get it.

    So don't worry. You will get the approval one day. Keep check your case status online.
