  1. After exactly a month from the NOA2 and daily, "We don't have a record of your case," the NVC has finally updated us with something positive.

My fiance called earlier and the operator said: "It's undergoing processing with no known lead time.

The case does not show to be under administrative review."

What does that mean? They have already assigned a new case number but I would like to know what that status actually means.

    FAE :luv:

I wouldn't worry at this point since they just started to work your case. Hopefully it will be transferred to the embassy in a few days.

  2. Hi everybody....i know this is a little late, but I just got back from the philippines, where I attended the K-1 interview with Rhiz. Every thing went very smooth, we got the PINK!!!!!

Also the visa was delivered just 3 days later, wow, seems still not to be real, but in a short time, Rhiz and I will be together here in San Diego, and then ready for the next step, ha ha ha.

Thanks to everybody here and all the information, we had all the paperwork together and everything was great.

    Nice! Congrats!!!

  4. I was searching through the forums and couldn't find an answer, so I'm posting a question here. (Mods: If there is a better forum, please move.)

I have been in my relationship for 4 years now, and we chose to get married, so we started the K-1 visa process in March 2009, CSC. Anyways, It has been a long time, and still waiting on NOA2, and it seems that my background check is causing a problem, of which I have no idea. Clean record, no arrests, nothing. Then I was talking with a friend, and they asked about if I had sent money to my fiance. So, yes, I have sent money directly to my fiance on many occasions. Mostly when I was travelling on vacation, wiring the money there and taking advantage of a good exchange rate was a good idea at the time I thought. There were also other times when I sent my SO money just to help make life easier for her.

So has anyone had this "Sending Money" issue come up at any time in their visa journey? If so, big issue, no issue, anything?

Thanks in advance for your thoughts / opinions!

    Aaron

I doubt that sending money is going to be an issue because I have been sending around $100 a month for almost a year now - no issues what-so-ever... ;)

  5. My friends.....I just got Cory's call. She got the visa. Oh God....I am so happy I think I will burst. Thank you God....and Thank you VJ and its members for your valuable help. Because of this Cory and me made a commitment of staying here and help others. As soon as she tells how it went I will update the timeline and put write a review. Thanks again my friends. So if you excuse me I think I need some time to cry and thank God for his help.

    PEACE!!!!!!!!!!!!!!!!!!!!!

    Congratulations!!!

  6. Eventually (if not at the Consulate) you need to meet 125% of the poverty limit for you family size

    http://www.uscis.gov/files/form/I-864P.pdf

OK, but that doesnt answer any of my questions.

yes, it does because you should be prepared for the AOS stage and not be short sighted. For a family of 2 is $18,212

There are so many fees associated with the k1 and the AOS fee alone is around $1010.00. I would research all the associated costs for the K-1 and budget accordingly.

  7. I'm wondering how people are getting emails from USCIS? If you sign up on their website, do they send you emails or is there some other way to get emails from them? Also, if you have AOS and EAD do you have to sign up to track them separately or is it all tied together? Thanks

Hello tglea, I have received email messages from uscis. However, you will have to create an account at www.uscis.gov in order to receive messages. Under your portfolio you will have the ability to enter your case numbers and specify if you would like to get notified by email and/or text messaging.

  8. i just met my fiance a mounth a go.and she is 18 years .is this not gonna be a problem with filing i-129f

    thanks

    Legally : No problem

Morally : I don't think I need to comment

Meh. We don't know how old Mike is. Maybe he's in his early 20's.

Her age won't be a problem, provided she's legal to marry in the state where the marriage will take place. The length of the relationship won't be a problem for the petition, provided there is sufficient proof of having met within 2 years.

The consulate stage is a whole 'nother story. If there's an age difference, I've heard this CAN be a problem at the consulate in Casa. I've heard it's a bigger problem if the petitioner is a female, and much older than the beneficiary. For reasons I don't fully comprehend, there seem to be a lot of older women petitioning younger men from Morocco. I don't know if a short relationship is a problem in Casa, but I'd be prepared with a truckload of evidence that there has been a serious relationship since the initial meeting. If it's not the cultural norm in Morocco to marry shortly after meeting, then you could expect the CO to seriously scrutinize the case.

I would casually suggest the OP take his time and get to know his fiancee really well before jumping off the board and filing the petition.

 As usual, there's wisdom from our friend Jim...

    Yes indeed!!!

  9. Hi everyone!

I have been living with my fiance for almost a year and soon I will have to return to my hometown and wait for the k-1 approval.

Does anyone have any tips on how you spend your time away from the one you love? How do you make time go faster when you're missing someone bad?

Hello Marlies and james. The best thing to keep the relationship healthy and not get bogged down by time is to keep up communication and make sure that you stay busy. I talk to my fiancee every chance I get via Skype using a webcam and headset. I also have two jobs, going to school full time, and sometimes hang out with my friends while still spending at least 10 hours a week talking my fiancee. You know what? five months went like poof! However, I know I'm going to lose the part time job once my fiancee gets here.

  10. They interview my wife(USC) for an hour while i'm wating outside and they only ask me one question.

But whats worst is that they told my wife that our marriage is fraud because they were able to open facebook, friendster

And it doesnt say on status that married and they didnt see any pictures of us on it.

But ofcourse she said that the marriage is true and the IO told us to wait the decision on mail

Is there any case like these before?

This is astonishing and I had a feeling that something like this could possibly be considered. The reason I felt this way is because on news you hear of people getting fired over their online Facebook or MySpace profiles a lot. I wouldn't be surprised if they are also looking at this site for additional evidence. If your information is visible then there are search engines such as Google or profile builders that will point someone in your direction. If you haven't updated your Facebook profile in a long time and it's used against you, I would consider hiring a lawyer. If the IO officer mentioned anything about potential fraud, be aware that this is a felony and you should consult an attorney as soon as possible.

  11. I was all set to start the K1 process. I had done plenty of research and come to the conclusion that this is the best route for me and my fiancee.

So, I met with an attorney yesterday to begin and the attorney says me and my fiancee have to have known each other for two years before sending off the I-129 petition. If not, it will not get approved. I told the attorney that it was my understanding that we only have to have met once within two years of applying. The attorney says those statements are essentially the same, and that we have to have known each other for two years before even applying.

I checked the US Dept of State website (http://travel.state.gov/visa/immigrants/types/types_2994.html#Filing) for info on K1 visa, and with regards to a fiance(e) it says:

"In general, the two people must have met in person within the past two years."

Am I wrong or is the attorney incorrect? Do I have to know my fiancee for two years before even applying? I do not interpret this statement to mean we have to know each other for two years before applying. The operative word is "within". "Within two years" could mean I met her anytime between right now and two years ago and still apply for the K1. It could mean if I have known her for 10 years and the last time we met was three years ago we can't apply.

I was blown away by the attorney's statement, as I have known my fiancee for less than two years. I thought I knew what was going on, but now I am a bit confused. If the attorney is indeed wrong, I wasted $100 on a consultation fee for bad advice, from an immigration attorney who should know.

Please let me know what is correct.

Hello Mr. K, your lawyer doesn't know what he is talking about. I have met my fiancée online and we have been talking close to a year before I actually got a chance to visit her. I was then able to fulfill the K-1 requirement "must have met within two years" and submitted the K-1 even before discovering this website (www.visajourney.com) on my own (without a lawyer). I was just recently approved and now I'm waiting for the NVC to receive our case. I'm not sure where your lawyer stands but he might be new to this process and probably misunderstood. Since you have discovered this website, just follow the K-1 guide in preparing your packet and you will be fine. The money you will invest in a lawyer will be best used toward K-1 fees.

Good luck on your K-1 journey, and keep us updated on your progress!!! Your participation on Visajourney.com will help others on a similar quest as yours. B)

  12. Hooray :star: finally my husband's case has been completed as of Sept 24-09. The NVC tells me they have scheduled all the appointments for Oct, so I'm praying for him to be in the Nov interview. I thought this was going to be a hard battle, but it went rather smooth. Sorry I never got a timeline set up. Now I don't remember the dates to start one. I pray for each and everyone of you that has a loved one far away things will work out in God's favor.

Great news! Congrats!!! just the interview and then POE!!! :D Good Luck!!!

  13. I just wanted to thank the admins of this website , users, bloggers, who made my experience a lot easier. my fiancee past the interview and we are both very elated. we still have a long journey to go but the biggest hurdle has been tackled.

thank goodness I found this website. that saved me tons of money from immigration fees had I hired a lawyer. again I thank VJ enough..

**preparation is the key to having a worry free interview**

    CONGRATULATIONS!!!!!
