  1. Follow the instructions in Publication 519, it explains how to file in a dual status year. You can use form 2555 to exempt any earned Canadian income and form 1116 to claim the foreign tax credit on any other income ( investment etc.)

    Thanks!!

  2. Can anyone help me out with the whole issue of taxes....

I moved to the US in May and have not had a job since I left Canada. So no real income here in the US. I did have an income prior to moving down here back in Canada. As I understand it, I have to pay taxes in both countries, correct? If that is case, as far as I understand it (at least according to the conversation I had with the IRS) I can declare to the US that I want to be considered a resident of the US for the full 2010 calender year, according to Publication 519 Pg. 9 "Choosing Resident Alien Status." found on the IRS website.

Is this the route I want to go? All of my income is from Canada, my spouse (the American citizen) had a a small amount of money earned this year in the US, and we wanted ideally to file jointly.

Okay, I think that's where I'm at, any advice, tips, websites would be GREATLY appreciated!!!

    Thanks in advance!

  3. I know that this has been discussed before but I just can't seem to find it. What is the best way to send funds from a Canadian bank to my U.S. bank? I know there was a service that was part of the Western Union family that people have recommended on VisaJourney but I can't for the life of me remember what it was called!

    Thanks!!

  4. Wow! Congratulations to the both of you!

That's awesome! kicking.gif Best wishes for the rest of your journey!

I still have a little less than 6 weeks to go now before my interview. But with Matt visiting, at least Ive stopped stressing out about it for now. smile.gif

Kizza, when you finally get approved just as a heads up make sure you get an I-94 when you cross the border, tell them you need it! the border guard didn't get me one and now I have to deal with the headache of getting one given to me retroactively... you need it for the AOS process but as Canadians we usually don't need them (when we visit) but when we want to immigrate we have to have them.... just a heads up for you!

  5. Ah, good times. Same happened to me. YES, this is going to be an issue. You must have the I-94 with your documents to apply for AOS, etc. (actually, I shouldn't really say it's an ISSUE, as it's easily corrected, but just know that you must get the I-94)

I'll assume that you at least got a stamp on your visa/passport when you crossed? Tell me they at least stamped it. lol

Go to your local deferred inspection site : http://www.cbp.gov/linkhandler/cgov/toolbox/contacts/deferred_inspection/deferred_inspection_sites.ctt/deferred_inspection_sites.pdf

They will be able to issue you a proper I-94 dated with the date of your stamp.

Here's more info about them: http://www.cbp.gov/xp/cgov/toolbox/contacts/deferred_inspection/

ugh! my closest branch is 3 hours away!!! that is so frustrating!!!!!!!!!

  7. Congrats Josh and Erin! I was wondering if Erin had made her way to Colorado already or not. :)

That's awesome! Have fun in Vegas too!

And thanks for your good wishes!

Guess what!? I actually received my interview date today! June 14th it is.

Im very excited, this is a good week. Matt is arriving here in 2 days.

Hey Kizza that's AMAZING news!!!! I'm so thankful that you're going to finally take the next step!!!!! I'm sure it's going to be smooth sailing from here on out! I move down to the states in 8 days! I can not wait!!! Our wedding is going to be May 22nd in Wisconsin, I'm so ready to move and to take the next step in our relationship! I'm glad to hear that Matt is coming! I know how much of a blessing time together is, at least I do now! The cliche is indeed true, absence indeed does make the heart grow fonder, and as well, the person who wrote that should be shot! LOL!!

anyways, best wishes with your time with Matt!!!!!! Keep us informed on how the interview goes!

  8. Mitch! I didn't realize you're on VJ. We're the Chinese couple you spoke to briefly in the interview room, and yeah I heard the interviewer go on for about 5 minutes asking about your acting job, lol. Hope your medical was fine and you have your visa now

Anyways, an update on our interview, ours was just as easy. This interviewer seems to get sidetracked easily, as he asked more about restaurant recommendations in Portland where I live!

We did have a small problem though. Her police report from China that we presented was the same she used to get her Canadian student visa, and was dated August 2008. They said that technically it's expired (over a year old) and we need to get a new one. Never mind the fact that she's never left Canada since she arrived there, so her criminal record in China could not possibly have changed.

So now we wait for her new police report to arrive from China so she can take it to the consulate and get her visa. Fortunately her mom has a friend in the police department in China, so she got a new one generated pretty quickly and my fiancee should get it some time next week. Just a bit angry at myself for not having noticed the date on the China police report before, causing us to have to wait just a little longer for our visa. I'll update again once she gets the new police report and takes it to the consulate.

HAHA! wow! I didn't think there was anyone from VJ there on Tuesday!! I'm sorry to hear about the police check! Remind her when she goes back to the embassy she's allowed to head to the front of the line with that piece of paper... that's what I did the next day with the results of my medical... there was a line up of 45-75 people picking up their visa's so I skipped all of them and was able to get upstairs in about 5 minutes. Once I was there it only took about 3 minutes. I guess all of that to say, once you get the police check it will not be long before you get your visa!! I got approved and I'm waiting for the embassy to mail it to me... anyways... keep us updated on how it's going for you!

  9. Wow! I hadn't looked at this thread in a while..it is so nice to see everyone getting over the hurdles. I just got off Skype with Yi and she passed with a two minute interview! OMG...all the preparation and planning and paperwork we had ready as proof...and the VO didn't want to see any of it...just handed her the pink after 5 simple questions. I am so lucky and so blessed to have her in my life and so happy that the embassy decided not to have a bad day. I will check back from time to time, but I think that our thread is coming to the end of its' run....ahh the memories. Kizza, let us know the good news soon, girl! I spent more time worrying about your NOA2 than my own..so glad to see you are on to P3!

So I was approved today pending the results of the medical which I have bright and early tomorrow. Vancouver is nice for that, you can interview on Tuesday and do the medical on Wednesday. As for the interview my experience was a BREEZE! the guy interviewing me actually was more interested in the fact that I'm an actor and he wanted to know more about that than the actual visa application! Like you said garfield... all that work all those pictures... and they didn't even ask for them!

anyways... I'm so thrilled! I don't expect anything to go weird tomorrow with the medical so I should be good to go!!!

  10. hmm i thought you didn't need that for k1..just bring 131 cash..or is that just montreal?

    Montreal takes cash... Vancouver doesn't...

  11. Hey everyone, I'm trying to get all of my stuff together for my interview next week and I'm trying to find the form that I need to take to the Scotia Bank to pay for the K-1 Visa. I know I've seen it on here before but I just can't seem to find it! If anyone can get me a link I'd really appreciate it!!!!!

NEVER MIND!! I found it! sheesh I must be slipping, it's right there on the Vancouver Consulate page....

  13. Hmm... that's not promising!

At least it's not the results that they lost!

Do you have an interview date mitch? or are they waiting until after the Olympics to even schedule?

Yeah Kizza, March 9th for the interview and March 10th for the medical, Vancouver is nice for that, they'll let you do the interview and approve it pending the medical... So that's good! I probably would have been close to interviewing this week had the Olympics not been happening but I really didn't want to have to deal with that nightmare so I just pushed my interview till after. I can't move down to the US right away anyways, I have to finish school first... so as long as the interview goes alright and they give me the Visa, I'll be heading down around May 1st, with a May 22nd wedding.

  14. I tried NVC today, since it's 5 days after my NOA2. They didn't have my case yet, I talked to the operator. She was nice, and wasn't reading from a script like the USCIS people do.

the lady I talked to when I was calling them was GREAT! Extremely helpful! to bad everyone involved in the process wasn't like that! I just found out the clinic that is supposed to be doing my medical lost my application so now I have to reapply.... not a big deal, but still mildly annoying
