Ok...just burst our bubbles...lol...j/k
They know ppl need to vent & they know this site is for helping eachother out, so I think if we all start worrying about every little thing that they might read that we right we will stress ourselves out. They want to know the truth...they will read the truth when we pour it out in our posts. I want them to know how I feel about the whole situation...that's why I wrote a page long rebuttle letter. If we weren't on here fighting and defending our relationships, and upset about what's going on...then how important were they to us in the first place?? So we care...if they will deny us for that, then nobody has a chance...seriously!! I hope they come read everything that I've said...maybe then they will see how serious we really are. They NEED to research more in to the actual relationships instead of just little stuff they happen to get from us. Go & see our facebook pages & see how are family & friends are involved on both sides and how they are affected by the handling of our cases. They need to see the whole picture instead of the little window of evidence that we are able to get in front of them. Just my little two cents...sorry for the rampage...lol Done now
Monica
Hey, by all means vent and rant as much as you want and need...I certainly do! Just be aware that this site is sometimes read by those who make decisions about our lives, and what may seem like an obvious joke to a few posters who have a camaraderie might not be that obvious to them, and worse case scenario if something is misinterpreted who knows how it can affect a poster's case.

Call me paranoid, but I don't think that kind of stuff is the best thing to post right along with your pictures! Who knows who reads this site, ya know?
But if it's the consulate you're referring to, they can tell who we all are by our timelines anyway - just looking at a few key dates is enough for them to know who is who...

In the Application Inadmissibility Provision, it does cite the misrep section of INA, but it also says he's guilty of 212(a)(9)(B)(i)(II) of INA relating to uninterrupted unlawful presence in the US for a year or more. #######? He was never here for more than 90 days at a time.
That could be precisely what you need! Yes of course it's a right royal pain the ####### that you have to appeal/resubmit, but they've clearly made a mistake...please speak to the best lawyer you can find to see what they advise you to do.

I'm so sorry, Julie. Is there really no way that you and your mum go to Ireland whilst you appeal?
-
Like most everything else things expire after one year. Sorry you are having so much trouble and I hope this is a good sign.
How do fingerprints expire?

I will post greater detail later when I'm not at work (I just disrupted the office for a solid HOUR by crying tears of joy!), but...Congressman Shuster's office says
WE ARE APPROVED!!

Yeah and there'd be no real point at this time, they give me enough trouble crossing when I had a job and a home, now that I'm unemployed, homeless and with a visa app in question, I doubt they'd let me across the border.
Gonna look into getting a temp job here, anything to pass the time..
I agree - even though I had no problems visiting the US during the process, now I'm unemployed, living at home and in AP, I very much doubt they'd let me in...however having one's passport back does mean that one can travel to a third country to see one's SO. Perhaps not so practical for you, Kevbev, as you're relatively close in Canada, but for those much further away (eg 26 hours away!!) it does make life easier meeting half-way
-
lol...that makes sense. lol...so the next question...can she not request her passport back? Would there be something wrong with that?
You can ask for your passport back, but it delays the visa being issued as the embassy then asks for you to return it, by the time you do, by the time it gets there, by the time it re-enters the system, perhaps by the time it re-enters the queue, by the time the visa is actually stamped in there...you get the picture
-
Can you not apply for a passport?
I think her passport is at the embassy

It's strange that we were completed on the 8th, but it took a week to update the list. You'd think that in that week, the necessary paperwork would have been sent to Dublin?
If you've followed the thread, then you know that I've been on a rollercoaster a few times. I keep checking and double-checking the list to make sure it says completed, and it does indeed, so I know *something's* happening, but...
I'm barely functioning here....
You'd think so, wouldn't you?
No rhyme nor reason...
Yes, I remember the last time you (we lol) thought you had reason to celebrate...I just wish that those involved remember that they're dealing with people's lives...we can but live in hope
Fingers crossed that it's good news, and that if it indeed is, that they issue the visa very quickly

My fiance and I are a 4 hour drive apart right now but I have no passport to get into the US and he isn't allowed into canada.. almost worse to be so close and yet unable to see each other
So close, yet so far!! As the embassy kept my passport, it's been my husband visiting me here - it's hard to see him return but I keep hoping that the next time we see one another it'll be in the US

JustJ I was just reading a post in another thread from and this jumped out at me:
"My fiance received clearance from DOS today. He received an email from the London IV unit (the email address was not from LondonConsular@state.gov, it was from LondonIV@state.gov) saying that they received clearance today for him and that "we will issue your visa shortly and send it with the courier in the next few days". Now to confirm this, I called DOS in the morning (15 minute wait ) and the DOS rep told me "pending" and then I asked her whether the system shows anything about receiving a clearance from DOS for my fiance and I told her about the email he received, and she confirmed that yes it is INDEED TRUE. And then again, (call it Obsessive-Compulsive if you want) I called DOS again just now (only 3 minute wait!) and the DOS rep told me that it is still pending and then I asked her again about whether the system shows up his clearance and I narrated the email to her and she also confirmed that yes that is correct, DOS gave clearance for him today. And then I decided to quiz her because I wanted to know why it showed pending when the London emailed me with their intention to issue the visa, she told me that DOS will continue to say "pending" until the visa is actually printed. So even if someone was approved at the interview and the embassy says (like in London's case) that they will send the visa within 5 working days, if you call DOS after your interview, they will say pending because as she told me "its not over until it is really over" meaning until it is physically in the passport, they cannot say issued. So this is the info she gave me and she also said the embassy knows first before DOS, even though DOS gave the clearance, but in the case of printing the visa, the embassy will make a note in the system and then she can say "visa issued". But yes, he has received clearance from DOS"

Husband just called the Dublin Embassy. They told him they have nothing yet.
I'm really confused, and I don't know who to call to get answers.

Exactly! If we were together and going through AP--I would totally be fine. Even if my flight time was 5 to 6 hrs i'd be fine. I would go visit often. But it takes freakin 26hours to get there. : ( And, we can't make any plans re: our life b/c of AP. He is scheduled to start a job in another state in Jan. And, I don't have a job lined up yet---so we wanted to get the AOS over with while we were in my current State and to go find housing at this other state. UGH!!! I just get so depressed when I think about it.
Snap! If it's any comfort, I know exactly what you mean. The only difference is that it's only an 11 hour flight between our two cities, and that's long enough!!

Refusal form received today with 221(g) checked off...said they were going to send it back to the US, and that we can get the visa under different circumstances (in other words, getting married) Contacted Sentator & Congressman...hoping to keep it from getting back to US...any pointers??
Thanks,
Monica
I'm sorry to hear that
Don't have anything to add apart from wishing you luck in your next step
PS I think there's a thread pinned in the MENA forum regarding K1 petitions that are denied and returned to the US, have you gone through that?
PPS Here it is:

Yes, I am sure there will be AP when we are going through AOS ... AP is normal!!
Mal
Well, at least you're prepared for it mentally, and next time you'll go through it together. Much, much better than being thousands of miles apart!!
-
Phew, at last!!
JustJ it's good to hear that your case has been completed at last - I sincerely hope that it is the good news that you're expecting, and that even if it isn't at least it means you can embark on the next step of this journey
Andrew and Traci - has there been any movement in your case? Any other VJers out there?

Thank you all so much for this thread!
My wife and I just got married in Vegas after 6 months apart, and she had to leave today to go back to the UK so we can start on the CR1. I have to say it was harder than the last time I left.
That being said I will be filing my I130 as soon as the marriage certificate gets here (stupid NV and their taking ages to process!).
I have to say I hope this all goes by quickly. It's been rough, but its nice to know that I'm not the only one.
On a related note, does anyone that is going through the CR1 process have experience in visiting the UK? Any problems crossing the border? I would lik eto visit in a few months, since from what I hear its near impossible for her to come here.
Hey there! I'm the Brit, and I visited the US during the CR-1 process without any problems...the CO asked me why I was visiting the States, and whether my husband was a USC or an LPR...we chatted very amicably about how we met, but it really was very pleasant and easy and not only did he let me in, he said that he hoped to see me again very soon as an immigrant

Thanks, Traci and Andrew
I do hope we ALL hear good news this week

Something I found interesting, although it may no longer apply as this was about three years ago, is that they only do one check at a time. For example, if they need an FBI, CIA, and Interpol checks they will do one first, wait until it is cleared, then send the request for the second, etc rather than sending requests for all three at the same time.
Hang in there and don't let DOS discourage you too much. I actually told them one time that instead of paying for people to answer the phone to give non-information they should fire all them and use the money to hire more people to process the cases.
Why oh why do they only do one at a time? That's like only doing one application at a time - how insane!!
I love your suggestion, though I'm sure you can tell that in the three years since you and your SO went through this nothing's changed
-
A quick response to Alan - I'm sorry if I got the wrong end of the stick.
Additionally, what I like about the US is that, generally speaking, people are much more integrated than in the UK, and they are proud of all aspects of their national/ethnic heritage. That is yet to happen in the UK, and it might never do
It is a very peculiar feeling when some immigrants take advantage of some of what the UK has to offer - and yet refuse to acknowledge the responsibilities that come with those rights.
-
Yeah. He worked in Hayes but lived in Slough if that tells you anything.
'Nuff said!
-
No, you're right - and I probably should have qualified my statement a bit more. Its akin to hubby thinking the NHS sucked - his trust did, but I've heard of others that do not.
Unfortunately, if it's Hayes we're referring to, then yes, the local NHS sucks. There's still a disparity between areas when it comes to all sorts of services, and part of it does have to do with the demographics of the local area. It's not a coincidence that there is a correlation
, and so yes, I can definitely understand why your husband and his family might have felt that the quality of their lives went down.

I think both of us see the problem more as one of the UK's immigration policy (or lack thereof) than anything else. I hope things have changed on that front, but it doesn't appear that way from the last article I had read - though again, maybe I have outdated information.
As a matter of fact I agree with you - the UK does have issues with its immigration policy that other countries, including other EU countries, don't have. Despite that, the indigenous population still constitutes 95% of the total.

I'm, perhaps foolishly, going to wade back in here. Even the use of the word 'alien' as opposed to foreigner gives us non-USC the impression that we're from another planet, quite literally. Yes of course, American English differs from British English, and a country can use whatever terminology it wishes. Doesn't mean that the rest of the world is necessarily going to enjoy being referred to that way.
