Hi everyone, while I've done my research on benefits between the k1 and k3 visa, delving further into the statistics, I see, as far as I understand, (being a newbie) that according to stats on Pakistan, the K3 seems faster then the K1 by about 39 days. Is there something I am missing such as other processing times before the NVC stage?

    CR-1 and K-3 if you're already married and your s/o is abroad.

    K-1 if you are not married and she is your fiance, you plan on getting married within 90 days of her arrival to the U.S.

  2. Hello, everyone!!! I just recently mailed my initial I-129F petition to the USCIS center in Laguna Niguel, California. I mailed it express mail and received confirmation that it was shipped and received. My first question is how long before I get a final approval from them (on average)? My fiance is in New Zealand. I'm just extremely anxious. . . as I'm sure everyone is at the beginning of these complicated stages! Thanks to all who read/reply!

    Final approval goal is 5 months from USCIS, however, if things go smooth (non complicated petition) you should be out and approved from uscis within 3 months.

  3. I don't think any of us can predict the USPS for you. I did notice when I sent my last package to them in August, there were no updates at all on the website until it'd actually been delivered. A lot of folks do priority but there's no way you HAVE to send it. You just have to take whatever waiting times come with the class you chose. Priority and overnight are faster than first, but first still isn't slow.

    It also depends on where you are and where you're mailing it to (looks like Vermont - but from where?). You've sent it certified so I sincerely doubt it's lost.

    Worst case scenario, if they don't get it, resend it (I presume you made an exact copy of what you sent, as this website suggests?).

    ETA: if you have no patience, this process will absolutely be the death of you. So finding some patience is probably a good idea...!

    I sent it from Houston, TX. I dunno why its taking forever. I have no problem with patience. Me and my fiance have been apart for the past 5 and a half years. So I think the eagerness of seeing each other is whats cuasing this impatientness. I am just worried if the USCIS received it or not. I dont mind resending the package all over again but that also means that my cashiers check is gone right?

    Has it been 5 1/2 years since you last saw your fiance? If so, it will be a problem if you don't have a very very very very very very very good reason for this, please tell me that you did send them a letter explaining why you have not met, and the circumstances that did'nt allow you to meet within the last two years.

    It took me about a 1 1/2 weeks to receive my NOA 1. Don't worry, and find the patience within you cause this process is ever so non-transparent, and it will eat you alive if you worry too much.

    Your cashiers check is not necessarily gone as long as you did'nt throw away it's receipt. Give it another week to 1.5 weeks for the NOA 1 to show up.

    I was kind of like you where I was getting worked up and crazy about why it's taking so long.. But, then I decided that I'm just going to be prepared for the worst and hope for the best... (it's working so far)...

  4. According to USCIS (Vj'ers will tell you different) K-3 and I-130 run parallel although evidence has obviously not proved that to be true...

    Don't look at other peoples NOA 2's... It'll just make you want to scream more... (trust me) You won't be able to talk to CSC, just that stupid call center. And yes, I too feel like screaming at times, the transparency in this process is obviously not present.

    Yes, K-3 is obsolete... so you may ask why did I do it? Cause I was foolish and stupid, wish I did'nt but oh well... past is past...

    Also, it is not necessarily obsolete... depends on the embassy your dealing with... CR-1 will take you through dealing with NVC (NVC will process) vs. K-3 (embassy processes)

    Anyway, you've just filed in August.. so check your status on line if it says "Initial Review" your probably in the background check, as i was told that's the longest portion of the "initial review" portion by my senator.

    Anyway, stay up & happy, we will all get through this extremely long & tiring process.

  5. So, as I'm growing more and more impatient every day for my NOA2. I've decided to kind of turn it into a prediction game (not that getting my noa2 is a game, im starting to get po'd with the transparency of the process)....

    Everyone, when do you think I'll get my NOA 2... Just take a random guess... and please dont pick dates years out !!

    Whoever gets it right (we'll find out when I get it) will get a big old :thumbs: ..

  7. I tried to log in to the USCIS web site to check my status online. But it only says this:

    - Login failed. Your User ID and/or Password are invalid.

    - Multiple duplicate SRs already exist for the customer

    What does this mean? I haven't typed User ID and password wrong. And I also tried by changing my password. But still doesn't work. Has someone else having same problems as I am? I also just created a new account with a new email and was told to log in and got the same login failed message.

    To be honest taking USCIS to court is like getting your hopes up and yet still having to walk off the cliff.

    We did it and we won, They had to have a response to us by the 21st of August 2009, if you look at our timeline you will notice that they never bothered to reply. So it went back to court at the start of September, and that frankly was the last we ever heard of it.

    There is nothing you can do, WoM apparently does not apply to them, they lost our case twice, went to court twice and were in contempt of court, and yet we still got nothing, other then a lawyer who stopped speaking to us and being several thousand out of pocket. We ended up having to physically go there to withdraw our K1 as our lawyer wouldn't talk to us (in fact we withdrew it over a week ago and he still hasn't contacted us).

    Like Sara (Estadia) we have made plans to move to the Beneficiary's (me) country at the start of next year, and we got married over the weekend to enable that to happen. No we haven't given up on the US, we are filing to both countries, but we certainly aren't getting our hopes up about it, frankly we don't care were we live, we just want it to be together. It has been a long 14 months in this process, and if we are lucky we have only 6 more left before we can be together. But definitely not holding our breaths.

    Long story short, take the 10K that having a lawyer to sue USICS would cost you and have a holiday together somewhere nice, suing them just really isn't worth the cash.

    Well, first & foremost, Congratulations on your marriage!

    I'm not planning on suing, atleast... I'm wayyyy to early into the process as I've only filed for my wifey on 6/29 and 7/8... I'm hoping they send NOA2 and don't have to get to that. I probably dont belong in this thread cause i'm not even near the 6 mos. mark. But, I just stumbled across it, and thought hey stop by and say hello, and then got to reading some of the posts...

    so anyway good luck, and congrats on the marriage, and i feel for you two and having to go through all of this to be with your loved one...

  10. Can I join the club too? We are 1 week from hitting our 6 month mark. Did you see on Igor's that there's people from JUNE 20?!?!?! Seriously?!? I'm seriously considering moving to be with my fiance at the end of the year... any thoughts? Am I crazy?

    Fingers are crossed that we all hear something soon. Boa sorte!!

    Well, I for one want to join the 6mths+++++ club. We filed in Dec of 2008 and here it is almost a freaking year later and NOTHING except a NOA 1 in Jan, and a RFE in May. Yup we have thought about just withdrawling our I-129F and just going for an I-130 if we don't hear anything by March of next year. What's everyones opinion? What should we freaking do?? :help:

    Sue USCIS, people on VJ have done it. It's called Writ of Mandamus, USCIS needs to realize that they put people family and lives on hold through this long process. Personally, I think anyone who should have to wait 6+ months needs to sue. What would happen if I paid my taxes when I felt like it, and stated, I'm still working on putting my paperwork together and gathering my income information and non-taxable expenses bla bla bla and you'll just have to wait to receive my tax payment...

    im sorry i know ur post is serious but i was laughing cuz i remember when we first got back to the states thats sort of what mom told the irs.........wrong answer got audited lol

    if ur going to file writ of mandamus u have to try everything available to u to try and resolve it first so that they dont come back at u with oh u didnt try this or that .....most of it is a waste of time but has to be done first.......i know that for me and perviz we were like a few months short of moving to india.....already had the plans and we were looking for cheap tickets after the first of the year.....with their ability to use computers seems pretty stupid that it takes more than 6 months to get anything done........

    Apparently the backlog used to be namecheck.. however, they claim there is no backlog now and it should be resolved within the processing times. OBviously you have not seen the result of that...

    I know it sucks! I'm in the background process too... only difference is you've been stuck for a longgggg time and im just getting in there... Try contacting gogo, there might be a way you can represent yourself, although would'nt recommend it...

  15. I'm frustrated as well, no touches still since June 14. We are using a lawyer and I called her today. She says has connections at a Senator's office and they will be making contact with the CSC today or tomorrow to see what the delay is. Hopefully we hear good news soon! My thoughts are with those in suspense like us!

    we received our NOA1 at the start of June and got a touch on 21st September, but since then nothing, so my husband and I are getting really frustrated by this whole process.

    At least it is only a couple of weeks until we can chase up USCIS and tell them they have exceeded their time frames but it's just a really stressful time!

    Let me know how it goes... and G/L... That sux, I agree this process is too long and drains you, and gives you stupid depressing thoughts.

    No concessions - completion of the law through Christ. Islam does not afford such forgiveness.     Actually there is.. Christianity. You quote all old testament verses, and leave out the fact that Jesus came to fulfill the law since humanity cannot fulfill or obey the law. Jesus brought forgiveness, not death. Also, there is no salvation in Islam. You obey the law and hope you were good enough to get in. Though, even in islam it is physically impossible to keep the law. So no one knows for sure if they're good enough (that is unless they become a martyr, then they know for sure).

    The NT is as full of internal inconsistencies (and I mean 100s) as any other religious text.

    I can't believe that in 2009 we have two groups of adults that are trying to have a rational argument over which book of ancient mythology is the "true" one. Ridiculous religious disputes that are based on such nonsense are exactly why there are so many problems in the world.

    No one lost and no one won, because this argument is not winnable.

    i could post scripture from the bible and the quran taken out of context either one will look blood thirsty for either of us to understand the others bible or quran it must be studied just quoting scripture really means nothing...........:-)
