    I hope you're enjoying your week.

    So finally I'm ready to send I-130 for my two brothers and their family.

    One brother is married with one child.

    Second brother is married with no kids.

    Question 1:

    Can I send I-130 for two brothers at one time? Do I have to wait till one of my brothers is approved? Or can I apply for them together?

    Question 2:

    Do I need to send the I-130 application for each brother seperately? Can I send both applications in one envelope (2 applications with separate fees)?

    Sponsor question:

    One of my family member will co-sponsor for me.

    Will he be able to co-sponsor for both brothers together?

    I'm applying for my brother and his family.

    Just following basic steps for I 130

    Copy of my birth certificate

    Copy of my brother's birth certificate

    Copy of my U.S. passport

    Copy of my naturalization certificate

    Do I need to include anything else?

  3. First yes she still needs a passport, just coz she has 10 yr GC does not mean she can go without passport.

    You will have to get hold of someone in Indian embassy for duplicate passport, for that you would need a copy of police report that the original was stolen.

    You will apply for duplicate of the GC as well and for that you would need the police report too as it would be good to let USCIS know the GC was stolen.

    You would not need any other documentation for duplicate GC.

  4. Where did she lost it? Do you have a police report?

    Go to local police and file for lost passport report. You will need that when applying to replace the Indian passport.

    You are in Chicago, please visit the consulate...they will tell you what to do next.

    It was stolen in Orlando Florida. We did file the police resport right away.

    Okay, I need to call them to mail me the police report because the cop didn't give me any paperwork.

    I tried emailing Indian Consolate, but I didn't get a reply back.

    You are right, I should make an appointment with Chicago Indian Consolate and personally visit.

    My wife also has to reapply for her Green Card since it was stolen with the passport. It's the 10 year GC.

    I know she has to submit Form I-90.

    Does she have to submit any supporting documents again with Form I-90?

    Happy 4th of July everyone.

    I hope you are enjoying the holiday.

    Little problem we are in right now.

    My wife's Indian Passport was stolen.

    We filed a police report right away.

    I tried calling Indian consulate in Chicago as we reside in Chicago,

    but only automated message plays.

    Questions?

    What are the steps that are required in this situation?

    How do I cancel the passport? If the passport needs to be cancelled, can you please start the cancellation process?

    Do I have to apply for a replacement passport? If yes, how do I apply for another Indian Passport?

    Is there a direct number where I can talk to a live person?

    My wife has a 10 years green card, does she still need an Indian passport to apply for citizenship?

    Please help me solve the problem.

    Hope things are well with you. When we move we filed AR-11 for my wife as a beneficiary, and I-865 for me as a sponsor.

    Yes, you both MUST notify USCIS for change of address by law in order to prevent any problems in the future.AR-11 for the beneficiary. Follow the link:--- http://www.uscis.gov/files/form/ar-11.pdf

  7. Your Residency stands abandoned if you stay outside of the US for more than a Year(There are exceptions such as posted outside by the government, Armed Services etc). Usually USCIS overlooks a stay of about 6 months as per my knowledge, but anything more than that might be questioned. Also, if your spouse is called for an interview while she is away, she may have to be back for that, if its earlier(which doesn't seem very likely).

    PS: Avoid using terms like "flying back home" :). For USCIS, home MUST be within the USA. :)

    I hope the weekend is going well with all.

    I have a question about traveling overseas after fingerprints for I-751 has been done.

    My wife is the GC holder and I'm a USC. My wife had to make an emergency trip back home in January and she has to stay there for a while.

    How long can she stay there? Does she have to come back after certain time? Is there any time limit for the stay for GC holders? Any other concerns that we have to worry about?

    I would really appreciate the response.

  9. i am so confused right now I-864 is the JOINT SPONSOR who does not live with you..but,,the I-864A is the JOINT SPONSOR who is living with you...RIGHT???...and my problem is we cant submit i-864a cuz my spouse is just living alone..but he has relatives who can be our co sponsor but they are not living with my spouse..like my spouse is in TEXAS nad his relatives are in OHIO...

    I-864 is for the Co-sponsor who does not live with your husband.

    I-864A is for the Co-sponsor who lives with your husband in the same house.

    According to your situation, your husband cannot submit I-864A because no one lives in his household besides him.

    According to your post, if he has relatives in Ohio, and he is living in Texas. No problem. Relatives in Ohio can be Co-sponsors.

    Relatives have to fill out I-864. They also need to submit the documents that are needed with I-864 (Tax returns or transcript, Bank Letter, Job Letter, etc.).

    For your information, according to the instructions, A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant.

    So it can be your husband's friend or a colleague.

    Good luck and don't give up. Be patient things will work out. I understand your situation. Give it some time. Patience is the key. :yes:

    A joint sponsor can be any U.S. citizen, U.S. national, or lawful permanent resident who is at least 18 years old, domiciled in the United States, or its territories or possessions, and willing to be held jointly liable with the petitioner for the support of the intending immigrant. A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant.

    To be on the safe side, call USCIS or NVC regarding this situation and regarding which forms to submit for the co-sponsor.

    According to your situation, if you don't have anyone living in the house beside the sponsor, I don't think you can use I-864A.

    Your spouse has to find someone who can co-sponsor like relatives, family members, etc.

    That Co-sponsor will have to fill out another I-864 with the supporting documents needed.

    Even if one or more I-864s are submitted for an intending immigrant, the petitioning sponsor remains legally accountable for the financial support of the sponsored alien along with the joint sponsor(s).

    First of all, you are the beneficiary, correct?

    If you already went for the interview, I believe your spouse already send the AOS (Affidavit Of Support) package long time ago. If that is the case, then all you have to do is, ask your spouse to mail you the I-864 that they sent with the AOS package. Also tell your spouse to complete I-864A with both signatures.

    Did your spouse send the following with AOS package?

    *W-2 forms for year 2010

    *Evidence of current sustained income

    *US Federal Income Tax Returns for year 2010

    If yes, that's good. If no, then you need to submit all that's listed.

    Also, follow the instructions for the documents that need to be submitted with I-864A. I think this list is about the documents they are requesting from the Co-sponsor with I-864A.

    I tried copying some info. from USCIS website. Hope it works.

    Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the Immigration and Nationality Act. It is an optional form, completed and signed by two individuals: a sponsor who is completing Form I-864, and a household member who is promising to make his or her income and/or assets available to the sponsor to help support the sponsored immigrant(s). The combined signing of this form constitutes an agreement that the household member is responsible along with the sponsor for the support of the individual(s) named in this form.

    A separate Form I-864A must be used for each household member whose income and/or assets are being used by a sponsor to qualify. This form must be submitted simultaneously with Form I-864.

    Form I-864A may only be used when a sponsor's income and assets do not meet the income requirements of Form I-864 and the qualifying household member chooses to combine his or her resources with the income and/or assets of a sponsor to meet the requirements. The obligations of the household member under this contract terminate when the obligations of the sponsor under the Affidavit of Support terminate.

    How Can My Relatives and Dependents Help Me Meet the Income Requirements?

    You may use the income of your spouse and/or any other relatives living in your residence if they are willing to be jointly responsible with you for the intending immigrant(s) you are sponsoring. If you have any unrelated dependents listed on your income tax return you may include their income regardless of where they reside.

    The income of such household members and dependents can be used to help you meet the income requirements if they complete and sign Form I-864A, Contract Between Sponsor and Household Member, and if they are at least 18 years of age when they sign the form.

  13. My husband and I just realized we need to file the change of address forms. We moved at the beginning of December. Do we need to file both the I-865 and the AR-11? What is the difference between these forms? Also, will it be a problem that we are submitting the forms late - I read that they should have been filed within 10 days of the move.

    I-865 is for the USC. AR-11 is for the Permanent Resident.

    Talking about our case, we were also late in submitting change of address. We still sent I-865 and AR-11 and received the letter from USCIS that the address is changed for both.

    USCIS and immigration services need to know your new address so you get your mails at the correct address, or if they need to reach you in case of certain situations. So, as long as they receive the change of address request, that's all they care about.

    You should submit I-865 and AR-11 ASAP. You can submit AR-11 electronically. I think you have to submit I-865 by mail.

  14. My husband and I will be filing in a few months to remove conditions. He would like to spend Ramadan at home this year, as he will not have seen his family in 2 years by then. We will send in the application to remove conditions a couple of months before the trip but will USCIS need anything from us? For example, what do we do if biometrics are requested and he is not here? Also, what will he need to have in order to return since his green card will have expired by then and I don't think the new green card will be generated yet?

    First to answer your question: If he plans to travel and the biometrics letter comes, you can always Request For Rescheduling.

    When you receive the NOA for Biometrics, it will give you instructions on how to reschedule. But my opinion is that you should always follow their schedule like Inky mentioned.

    How long does it usually take for the biometrics appointment once the application has been filed?

    We sent the I-751 on December 6th through express mail next day delivery and we received the NOA-1 Biometrics appointment letter at the end of December. This letter says that Your conditional resident status is extended for a period of one year. During the one-year extension you can travel or work. So, it took less than a month. But it all depends. Just mentioning our experience.

    FYI

    Letter for one year Extension of the GC comes first, then the NOA-1 Biometrics appointment letter.

    Hope ya'lls' week started on the positive side.

    I have a question regarding AR-11(Change of Address form for the Alian Relative 'Spouse for me') and I-865(Change of Address for the Sponsor)

    We had to move to the new place back in early August but I didn't find out that we needed to submit the change of address forms within 10 days or so from the moving date until recently. Is this going to cause any problem with the immigration. Like when my wife has to file for I-751(Removal of Condition) that is going to be early November, is there going to be any problem?
