  1. Hello again fellow VJ'ers.

    When paying the fee for filing for the I-129, would it be okay to use one of the temporary checks that I got when I opened up my account from Bank of America? We prefer the check rather than the money order, but now wondering if we actually have to order regular checks for the accounts or if we can use these? We'd like to send the package off right away if we can and not wait additional days for the new checks to be ordered and mailed out.

  2. Ok So I did another extended search after reading the replies here. At first I thought I (the US citizen) could fill out the I-134 while the co/joint sponsor did the I-184A and that both of these forms have to be included with the first K1 package we're sending out.. even though I did read the checklist stated here before and it doesn't say anything about adding additional forms to it.

    At this point, after reading these replies and doing a bit more research I assume both me and my co sponsor have to fill out the I-134, which will not be included in the I-129 package but to mail these to my fianceè once the I-129 has been approved..? Am I starting to get somewhere with my assumptions here? ^_^

  3. Thanks for the replies, and also wanted to apologize for posting at the wrong place. I think I might be even more confused now though. While it's not hard to get 3 years of tax transcripts (also well over the 125% limit, yes) like first mentioned here, I am now not sure whether to fill out the 864 or I-134? I have already read the guides several times before, but will do so one more time.. perhaps things will become more clear this time :P Thanks again for the replies, it's appreciated!

    I just wanted to thank everyone who helped out with our last questions and unfortunately we got a couple more questions about this.. they seem to appear when we least expect it :blink:

    I don't meet the financial requirement right now due to being in college, so I am using a sponsor in addition. I am currently in his household and he is filing me on his taxes as a student living in his home on last years tax return. I am not sure if he should fill out the I-846 form, the I-846A or perhaps both? Any pointers here would be great!

    Also I am wondering if last years tax return will be enough to prove his annual income, or if we need to include more proof of this? Any help would be greatly appreciated here. This is all we have left before finally being able to send out our K1 package :star:

  5. Hi Gary and Alla, thank you so much for the detailed answer. It sure sounds a lot more clear than the wage answers we have been getting from the embassy as well as the department of immigration. I guess we'll get in touch with the right people as well as preparing for our son to travel to the capital in Norway where the embassy is at! I assume we can file for the K1 at the same time, so there won't be any additional delays.

  6. Thanks for the quick reply! We were hoping we could just file him as a K2 and later on fix his citzenship, but it seems as if we will have to take him to the embassy and have the paperwork done prior to his arrival. What confuses me, is how the US embassy have told us tree times now how he can be filed as a K2, if this is not the case..

    When filing for citizenship for our son, they state we might have to prove physical presence in the US for me (the US citizen) . Does anyone know what this means, and how exactly we can prove this, what sort of documentation we need etc?

    We're new to posting here but have been reading and watching for a little while now. I'm about to file for a K1 visa for my fiancee and we also have a son together. He was born in her country, Norway, and we have not filed for a citizenship or adjusted his status yet. We're wondering if we're able to file him as a K2 on the same form, or if we will have to bring him to the embassy in her country to get him a US passport and citizenship first?

    We've called the embassy here in the US and asked about it, and they seem to think he can be filed as K2 and later on fix his citizenship. In order to be sure of this, we've called them back a couple of times and spoke to a couple of different people working there in order to make sure of this. The reason we are a bit insecure of this, is because we came across a thread here regarding someone else who seemed to be in our situation. In their case they had a delay because the daughter was eligble for a US passport and citizenship and therefor was told she should not be requesting a visa. However, the officials have told us they can't see a reason why our son could not be filed as a K2 and travel with his mother here after (hopefully) they get their visa approved.

    Any thoughs, advice or help on this would be greatly appreciated!
